4 Landscaping
Because of the timing of the construction phase completion, several items have not been
installed that were detailed on the Landscape plans. These items will be installed first
things when the spring planting season arrives.
The Home Depot stays focused on providing an aesthetically pleasing site and will
maintain the property to the best interest of the City and its customers.
S Signage
A. Permits were issued for the wall and freestanding signs
B. The directional sign on Swampscott Road is waiting placement by the City.
6 Lighting
The Home Depot is in the process of changing the on-site lights designated as B2, B3,
B4, and B5 from 40 to 20 feet in height.
The Home Depot will also review if shielding is required as well on lights B2-B5 and
will continue to work with the City and the residents on all lighting matters.
The Home Depot will revise the scheduled times that the site lighting turns on and off
from X p.m. to X p.m. and X p.m. to X p.m.
7 Construction Practices
All construction practices as outlined in the March 24, 1999 document from the City have
been observed to the best knowledge of the engineer.
8 Clerk of the Works

9 Board of Health
The 14 Standard Requirements requested by the BOH have been upheld throughout the
entire construction period.

10 Fire Department
The hydrants that were installed on-site were American Darling#B6213 as requested on
the comment sheet from the Salem Fire Department, dated March 12, 1999.
20 feet wide fire lanes have been established in front of the Home Depot building as
stated in the: Salem Fire Prevention Regulation #29D.
I 1 Building Inspector
Please review the attached letter from CASCO Corporation dated February 10,2000
regarding the construction of the building in compliance with the codes, laws and
ordinances of the City.
12 Maintenance
The Home Depot will remain committed to maintaining the property and ensuring the
highest quality of aesthetics and access for the site as possible.
13 Hours of Operation
The Home Depot will comply with the hours of operation set forth in the March 24; 1999
letter.
14 Traffic
a. The new pavement markings on Traders Way are scheduled to be installed in the
spring of 2000.
b. The 100%design for traffic signal improvement at Highland Avenue/Traders
Way/Marlborough Street intersection is currently under review by MassHighway.
We anticipate approval of the design within two weeks, and anticipate that the signal
modifications will be implemented in the spring of 2000.
c. The 25 percent design of the Highland Avenue Northbound right turn lane has been
submitted to the project's attorney,Joseph Correnti, for review and discussion with
affected property owners.
d. The traffic signal at the intersection of the First Street/Traders Way has been
installed. During a recent field visit,it was observed that traffic signal is on flashing

mode. Salem's City engineer will determine the time to switch the signal from
lashing operation to fully actuated operation.
e. Additional traffic data will be collected as requested by the Planning Board or City

The writer arrived at the above site at 6 : 30 AM and met with Mr. Bill
Breen, Superintendent of J. J. Vaccaro. The purpose of this visit was
to perform field tests and a visual inspection. The following was ob-
served: The masonry work scheduled for today is : To grout along column
line A at the rear elevation and to continue the placement of 12" C.M.U.
At column line AI-2 . 5 and column line 1, A-B, the first (7) courses
were placed, at column line A 2 . 5-9, the 8th to 12th course was placed
and grouted, at column line A2 . 5-4 . 5, the 13th to the 24th course was
placed and grouted. The #6 rebars were placed and lapped 3 ' prior to
grouted, the grout was 3000 psi fine delivered by Wakefield Concrete .
All cells with reinforcing were grouted solid, the Bond Beam with 2
#6 rebars placed horizontally was grouted solid. Type "S"1800 .psi
Quikcrete with color and added dry block was mixed onsite and used to
mortar the C.M.U. together. Random samples of the mixed were taken
throughout the day for lab testig. Two sets of grout prisms, and two
sets of prism blocks were fabricated for lab testing.
These observations were related to Mr. Breen prior to departure.

Dear Mr. Wilson:
Per your letter of June 27, 1989 to Salem City Planner William Lester
concerning our proposed Somerville Lumber project at Traders Way and First
Street and the Swampscott Road-Highland Avenue intersection, I would like
to call the following items to your attention:
1) The Highland Acres P.U.D. project, which includes the Somerville
Lumber site, received its MEPA Certificate of Approval (EDEA #4573)
on March 21, 1984. This included a review of traffic generation and
mitigation measures based on: 185,000 SF Commercial Space
290,000 SF Industrial Space
700 Units Condominiums .
The projection then was for 14,385 ADT.
2) The estimated traffic generated for the 344 completed condominiums
and 223,453 SF of commercial and industrial space either constructed,
approved for construction, or presently under Planning Board review
(including Somerville Lumber) is 10,615 ADT. Thus our residential and
commercial P.U.D. ' s are expected to generate, after this 223,453 SF of
commercial and industrial space is completely constructed and occupied,
some 3,770 fewer average daily trips than proposed under the 1984 MEPA
approval certificate.
We feel that no further state review is necessary because:
1) Our project has been approved by MEPA; and
2) The project as currently constructed and proposed is smaller than what
is approved by MEPA.

II. The Special Permit and the exercise of the rights granted hereunder shall be subject
to the following conditions:
A. Traffic
1. Following the comprehensive traffic study to be undertaken by the
City to determine the traffic needs of Swampscott Road, an
easement, to be defined by the Planning Board, shall be granted for
the widening of Swampsscott Road along the southerly side of the
developer's property to allow for an-increase-in roadway capacity-
Such easement shall be provided by the developer in a form
satisfactory to the City Planner and the City Solicitor. In addition,
the developer shall bring to grade the area of said easement to
permit the widening, and shall construct an adequate sub-base.
2. The developer shall work cooperatively with the City in planning
appropriate improvements for the intersection of Swampscott Road
and Highland Avenue and the developer shall contribute toward such
improvements, as mutually agreed to by the Board and developer
prior to approval of the second phase of the development.

Dear Councilor:
Enclosed please find copies of letters from Unit Owners at the
Sanctuary Condominium Trust, Salem, MA. The letters pertain to
problems owners are experiencing as a result of the blasting
going on across from the Highland Plaza. As I'm sure your aware,
the Fafard Companies, in building the new home of a Somerville
Lumber have been using explosives to prepare the area.
As is evident in the letters before you, some of the owners have
experienced damage to their units as a result of the blasting. I
have been at the property on numerous occasions when the blasts
have occurred and experienced the ground and buildings shaking
as a result of the detonations. The Trustees and Owners of the
Sanctuary Condominium, request that the City of Salem address or
cause the builder to address the damage done to various units,
in that it was the City that issued a building permit to the
developer and permitted this type of excavation.
If you have any questions or would like to set up an appointment

I am writing to confirm our discussion of yesterday
afternoon. I was working at home yesterday. At approximately
1:50 p.m. , I heard a loud boom and then noticed that the whole
condominium shook slightly. I looked in the direction of the
boom, out of our kitchen window, and noticed that the wallboard
above the dishwasher was cracking. A crack ran from the edge of
the window frame, through the two outlets, and over to the wall .
I called your office immediately and also left a message for
Trustee Sandra Hallett. Ms. Hallett suggested that I call our
Ward 3 Counselor and the City Planning Office. I am concerned
about the immediate damage that I witnessed and also about the
on-going, hidden damage that may occurring as a result of the
blasts.
Please make a note of this for your file. I would
appreciate any recommendations from your office that may be

As you know, the Fafard Construction Co . is erecting a large
building (: Somerville Lumber) at the corner of First St . and
Traders ' Way in Salem. For the oast several weeks , the
construction crew has been blasting at this site, causing quite
noticeable tremors .
On January 29, my wife observed a crack running around the
perimeter of the whirlpool in our master bedroom. Since I am
certain that this crack was not present prior to the commencement
of the blasting, it seems reasonable to conclude that the damage
to our property is directly attributable to the construction . / I
have not as yet completely inspected the unit and, therefore ,
there may be additional damage ) .
Kindly inform me of the action to be taken to address this
situation .

Amendment to the Planned Unit Development Special Permit and Site Plan Review
On Thursday, January 21, 1999,the Planning Board of the City of Salem opened a Public
Hearing regarding the application of Home Depot to amend the Planned Unit Development
(PUD) Special Permit pursuant to Paragraph K of the Decision dated March 15, 1984 for the
construction of a Home Depot Store on an approximately 16 acres in size at 17 First Street. The
Home Depot Store is proposed to consist of 118,072 square foot building, plus a 16,200 square
foot garden center.
The Public Hearing was continued to February 4, 1999, February 18, 1999 and closed on March
18, 1999. At a regularly scheduled meeting of the Planning Board held on March 18, 1999, the
Board voted by a vote of nine (9) in favor, none opposed, to approve the application as
complying with the requirements of the requested amendment to the PUD Special Permit, subject
to the following conditions:
1. Conformance with the Plan
Work shall conform with the set of plans entitled, "Site Permit Plans—The Home Depot,
Traders Way and First Street, Salem, MA",sheets C1-C10, A1.0, A2,0, prepared by Rizzo
Associates, Inc, dated December 22, 1998, revised February 25, 1999 and February 26, 1999.
Work shall also conform with plan titled Traders Way Traffic Improvements Schematic Plan
dated February 25, 1999.
2. Amendments
Any amendments to the site plan shall be reviewed by the City Planner and if deemed
necessary by the City Planner, shall be brought to the Planning Board. Any waiver of
conditions contained within shall require the approval of the Planning Board.

3. Planned Unit Development Special Permit
a. As stated in Paragraph B, the height of buildings is not to exceed 30 feet. The Planning
Board agrees to waive this requirement and allow the Home Depot to not exceed a height of
35 feet.
b. As stated in Paragraph D, retail, supermarket, etc. uses shall not exceed 185,000 square
feet. The Planning Board agrees to waive this requirement and allow the Home Depot to
exceed this square footage in the PUD so as to be able to construct the site as shown on the
approved plan.
c. As stated in Paragraph E,the gross floor area ratio of retail uses to industrial uses shall
not exceed .88. The Planning Board agrees to waive this requirement and allow the Home
Depot to exceed this ratio in the PUD so as to be able to construct the site as shown on the
approved plan.
4. Landscaping
a. All landscaping shall be done in accordance with the approved set of plans.
b. Trees shall be a minimum of 3 %" caliper.
c. Maintenance of landscape vegetation shall be the responsibility of the developer, his
successors or assigns.
d. After such landscaping is completed, the developer will add further landscaping if such is
requested by the Planning Board or the City Planner.
e. The screening trees currently located on the First Street side of the parcel shall not be
removed or destroyed.
f. The rip-rap slope located adjacent to First Street will be cleaned of debris by Home
Depot. In addition, the rip-rap slope will be maintained by Home Depot.
5. Signage
a. Proposed signage shall be reviewed and approved by the City Planner and the Sign
Review Committee.
b. Directional signs to the Home Depot Store will be provided on Swampscott Road to
direct patrons into the Home Depot site through Swampscott Road and Traders Way. The
directional signs will be located in City of Salem right of way, but will be maintained by
Home Depot. The directional signage shall be reviewed and approved by the City Planner.
6. Lighting
a. Lighting shall be installed as shown on the approved plan.
b. No light shall cast a glare onto adjacent parcels or adjacent rights of way.

c. A final lighting plan shall be submitted to the City Planner for review and approval prior
to the issuance of a building permit.
e. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of
a Certificate of Occupancy.
7. Construction Practices
All construction shall be carried out in accordance with the following conditions:
a. No work shall commence before 8:00 AM on weekdays and Saturdays. No work shall
continue beyond 5:00 PM. There shall be no work conducted on Sundays or holidays. Inside
work of a quiet nature may be permitted at other times.
b. All reasonable action shall be taken to minimize the negative effects of construction on
abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to
commencement of construction of the project.
c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM.
There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be
undertaken in accordance with all local and state regulations.
d. All construction vehicles shall be cleaned prior to leaving the site so that they do not
leave dirt and/or debris on surrounding roadways as they leave the site.
e. All construction shall be performed in accordance with the Rules and Regulations of the
Planning Board, and in accordance with any and all rules, regulations and ordinances of the
City of Salem.
f. All construction vehicles left overnight at the site, must be located completely on the site
and not on Traders Way.
8. Clerk of the Works
A Clerk of the Works shall be provided by the City, at the applicant, his successors or
assigns' expense, as is deemed necessary by the City Planner.
9. Board of Health
All Board of Health requirements shall be strictly adhered to.
10. Fire Department
All work shall comply with the requirements of the Salem Fire Department.
11. Building Inspector
. All work shall comply with the requirements of the Salem Building Inspector.
12. Maintenance
a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the

developer, his successors or assigns.
b. Winter snow in excess of snow storage areas on the site shall be removed off site.
c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors
or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a
two-(2) year period.
13. Hours of Operation
a. The hours of operation for the Home Depot shall be 6:00 AM until 10:00 PM. Any
amendments to hours of operation shall require the approval of the Planning Board.
b. The Garden Center located in the Home Depot shall be closed by 10:00 PM. The paging
system in the Garden Center shall be shut off at 8:00 PM.
14. Traffic
a. Home Depot shall be responsible for preparing design plans for the re-striping of Traders
Way and for all construction costs associated with the implementation of the new design.
Traders Way shall be re-striped in accordance with the approved plan. The re-striping shall
provide for two lanes of traffic with turning lanes when necessary.
b. At the intersection of Highland Avenue and Traders Way, the City of Salem shall
improve the intersection as shown on the approved site plan. Home Depot shall be
responsible for preparing design plans for the intersection and for all construction costs
associated with the implementation of the new design. The improvements to the intersection
shall be comprised of a right turn lane onto Highland Avenue from Traders Way and
improvements to the timing of the traffic lighting system as shown on the approved plan.
c. Home Depot shall support the City of Salem in the construction of a deceleration (right
turn only) lane onto Traders Way from Highland Avenue. The lane will be adjacent to the
Ground Round parcel (Map 8, Lot 129). The lane will be approximately 200 feet in length
and 12 feet of pavement with a five foot sidewalk. Home Depot shall be responsible for
preparing design plans for the deceleration lane and for all construction costs associated with
the implementation of the new design. The final design of the deceleration lane will be
approved by the City Planner and the City Engineering Department.
d. Home Depot shall design a fully activated lighting system at the intersection of First
Street and Traders Way and shall be responsible for all construction costs associated with the
implementation of said lighting improvements. The lighting system shall be capable of being
coordinated with the other lights in the area.
e. Six months from the date of the store opening, Home Depot shall provide additional
traffic data to the City, as requested by the Planning Board and City Planner. If it is
determined by the Planning Board or the City Planner that the traffic flow in the area has
substantially worsened since the store opening, Home Depot shall provide additional traffic
mitigation for the area.

f Police details shall be provided, at the expense of Home Depot during the peak hours of
operation when determined necessary by the City Planner.
15. As-built Plans
As-built plans, stamped by a.Registered Professional Engineer, shall be submitted to the
Planning Department and Engineering Department prior to the issuance of the final
Certificate of Occupancy.
16. Violations
Violations of any condition shall result in revocation of this permit by the Planning Board,
unless the violation of such condition is waived by a majority vote of the Planning Board.
I hereby certify that a copy of this decision and plans has been filed with the City Clerk and
copies are on file with the Planning Board. The Special Permit shall not take effect until a copy
of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and
no appeal has been filed or that if such appeal has been filed, and it has been dismissed or
denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the
owner of record is recorded on the owner's Certificate of Title. The owner or applicant, his
successors or assigns, shall pay the fee for recording or registering.
