The Inspectors from the State Division of Professional Licensure requested my presence. Upon arrival, I was shown the room in the rear, where previously you had denied you were living. It was obvious that you are in fact living there. A bed, refrigerator, food, bottles of wine and numerous wardrobe items were present The owner of the mall, Jager Management Inc, of Maple Shade, New Jersey received a letter from me on or about August 4, 2003 concerning building code violations. Jager Management sent me a letter on September 17, 2003making you aware that a "residential use" is a violation of your lease. They also asked you to cease this activity. I then received a letter from you dated September 22, 2003 in which you state, that you don't live at the premises. Under the Authority of the Mass State Building Code 780 CMR, the following items are in violation 1. Occupancy Permit Section 120.1 Building has occupancy under a "Business Use" classification. No residential uses are allowed. 2. Salem Zoning Violation-Strip Mall exists by the granting of a Special Permit by The Salem Zoning Board of Appeals decision dated March 21 of 1984: The residential occupancy places the Special Permit in violation. 3. Electrical Violation: Article 110 State Electrical Code Table 110.26 (A) (1) Working Spaces Clear space of 3 feet. Must be maintained Therefore, you are directed to cease the residential occupancy of your tenant space. Furthermore, you are required per 780 CMR, Section 115.6 to arrange for an inspection of the entire premises within 10 days upon receipt of this letter. Just today, Detective Eric Connolly, who is investigating a break-in at my business which happened on August 3 , 2003, came to my business to give me a citation because he says he saw me at Dunkin' Donuts across from my business on or about August 30, 2003 driving my Toyota truck. Instead of stopping me at the scene, he waited four days to issue the citation. Here is a police detective who is investi- gating a robbery at my store. He never issues traffic violations. He has taken further steps to persecute me. I was at Dunkin ' Donuts at or about 11:00 AM on August 30 getting coffee for my employees but I walked across the street as I always do and walked back. It is only 50 yards from my store. Detective Connolly was not there. He lied on the police citation. He is in collusion with other evil doers at the Salem Police Station who want to silence me so they have resorted to making up completely false accusa- tions to discredit and silence me. Instead of interviewing Scot Timsen who was probably responsible for the break-in at my Salem store, he spends his time trying to annoy me. Every day I notice a police cruiser staking out and watching me and my business . To make matters even worse, I appeared in Salem District Court on August 28, 2003 to present my Motion to Dismiss which is enclosed. Unfortunately, I was subject to the decision by Judge Robert Cornetta. The reporter, Julie Manganis , of the Salem News never read my Motion to Dismiss or any of the letters written by me, or never interviewed me concerning this matter but did quote verbatim the Police Reports that were loaded with outright lies and printed a story on the front page of the Salem News which is slanderous toward me. This letter is to advise you that I do not sleep at the business but live and sleep at 98 Corning Street in Beverly where I have lived for the past ten years. There- fore, I am not in violation of Section 8 (a) on the lease. As you know., however, I am 62 years old and have suffered a heart attack about six months ago, accordingly I've set up a small cot in the back office where I also have an oxygen machine, computer, safe , and fax machine, and some medicine in the event .I get sick. Sometimes I use this area to rest but never spend the night there. This office space is less than six feet wide and less than ten feet long. It has no windows or ventilation. It is impossible for anyone to live in this cramped area. The Quality Cuts Hair Salon is open from 9 :00 AM to 8 :OO. PM every day. It is important that I be there most of the hours because of employee theft. Sometimes I leave the business as late as 10 :00 PM to complete bank deposits, cleaning and computer read-outs. Carol and I have enjoyed our relationship with you in these past years. We are eager to continue this same relationship in the future. Brook, age 62, graduate of Salem State College in 1965 and Northeastern University (Masters degree) . I am currently a retired elementary 5th grade school teacher ' with over 22 years of public service in teaching. Currently, I own six Quality Cuts Hair Salons but work primarily at my Salem Salon located at 5 Traders Way. We represent the largest hair salon on the north shore, employing over 16 hair stylists. We average between 200 and 300 hair cuts daily. I am in the midst of any respectable person's nightmare. On Friday, June 7, around 1 : 30 AM I was arrested in Salem on Harbor Street for a one-way violation and operating under the influence of alcohol, my first offense. At that time, I was yelling and screaming at the arresting officer, Brian Butler, because the handcuffs were put on too tight and were cutting my wrist . Despite my cries for help, Officer Butler refused to loosen the handcuffs. About one hour later, when the handcuffs were finally removed and I showed Butler the cuts on my wrist , he said that he had seen worse cuts on other prisoners in .his career. At that time, I told Officer Reardon that I 'm 62 years old, own a local business here in Salem, and had major health problems, including a heart problem, high blood pressure, and sleep apnea among others, and further, if I was confined for more than one hour I would need to be brought to Salem Hospital for medication. At that time, both Reardon and Butler assured me that they would immediately summon Bob Murphy, a bail bond person to set the bail papers because I had over $138 .00 in cash in my wallet and that I would be released within one hour. At that time, I called my wife to tell her that I would be released within one hour and for her to come and pick me up . The Intoxilyzer-Alcohol Analyzer administered by Kathleen Makros at the Salem Police Department showed my alcohol level at .08 indicating only a few beers slightly above the safe level . I have never had a problem with alcohol and I was not drunk. As it turned out , Reardon never called Bob Murphy as promised Gordon C. Brook, Defendant Case: 0336CR001939 (348163) Page 2 of 3 4. When.arresting me, Officer Wilcox placed the handcuffs on my wrists with undue force, causing them to cut into my skin. Despite several hours during which I repeated pleaded to have the cuffs loosen, no officer came to my aid. Again, a lack of proper Police procedure. 5. When I arrived at the Salem Police Station, I again pleaded with the booking Officer Reardon to remove the handcuffs because they had cut into my wrists. He informed me that they could only be removed after the Intonilyzer-alcohol Analyzer Test. Despite Officers, Butler, Wilcox, and Reardon being present, they still refused to loosen or remove the handcuffs. An obvious breakdown of police procedure, standard to any normal police department. 6. During the interview section of the police report, Officer Butler admitted that I had physical defects, specifically a heart condition. At that time, both he and Officer Reardon promised me that I would not be incarcerated for more than an hour. However, they left me isolated in a cell for ten times longer than that ... ten full hours. 7. At booking, I called my wife and asked her to pick me up within an hour. She arrived at the Police Station within said hour, only to be turned away because no bail had been set for my release. She returned four additional times, calling over ten times, and consistently received the same response ... no bail had be set. She informed the Police yet again, that I had a heart condition, and other medical problems and needed to be released immediately. In spite of her pleas, no correct procedure was followed. 8. The Intonilyzer-alcohol Analyzer administered at the Salem Police Department by Kathleen Ivfakros indicated my alcohol level to be .08, indicating only a few beers, and was barely at the cusp of the safe level. I had only 2 beers and was not intoxicated. The Intonilyzer measured in hundredths and could easily have been off in calibration by a fraction ... putting me on the other side of the safe level. I respectfully request the Court extend me the benefit of the doubt in this matter. 9. Officers Butler's account of the Field Sobriety Test as recorded in the Police Report, do not reflect my recollection of the events as they occurred that evening. They are fundamentally inaccurate, and in some cases appear to be out and out fabrications. Officer Butler stated that when he asked me to perforin a field sobriety test 1 started to curse and and I was left in the cell without any contact whatsoever until around twleve noon on the following day, some ten hours later. My wife came to the police station at least four times and called countless more times to get me .out but each time she was told that nothing could be done until. bail had been set . All night long, and into the day, I kicked and shook the prison cell door and yelled for help but no one came or cared-to help me. There was absolutely no contact from anyone until the day officer arrived around 9:00 AM to inform me that Bob Murphy would be arriving shortly from Middleton. Later, when I was released, Bob Murphy told me that if someone had informed him of my situation, he would have arrived immediately to set bail, but no one informed him. Yesterday, I called the police department to find out the procedure for filing a complaint and Sergeant Pooler informed me that I got what I deserved. She didn't understand why I was calling to complain. This is not the first time I 've had a problem with the procedur< of the Salem Police. I had a similar problem back in July of 1998. See attached letters. That problem ended in less than five minutes after a jury found me not guilty of all charges. It appears that the Salem Police make their own rules without regard to decency and respect . Since they are the law they . abuse the power that citizens place in them. I am determined to expose this police department for what it is. I will use media and letter writing and customers who frequent my business. There is no place in the United States for a police department that operates like yours. When people are treated in the fashion presented herein, the smell extends throughout the system and reflects directly on you. In my 62 years of life, there are two events that have caused me to react in this manner and both of these heretofore mention4 incidents are concerned with evil in your department . Furthermore, I 'm absolutely sure that several Salem Police Officers enjoy inflicting pain and emotional and physical suffering on innocent victims who happen to get arrested by your department . They are able to succeed at this because they are able to hide under the arm of the Salem Police Depart- ment where they are safe to hurt people. Back in 1998, when I started a letter writing campaign against the Salem Police Department , they immediately made up some phoney charges to arrest me again so as to quiet me but , instea, it motivated me to write more letters . It will not surprise me if you make up some phoney charges to punish me. even further. It is my plan to publish this letter, along with several other Gordon C. Officer Butler admitted in the Police Report that I have a heart problem,yet somehow failed to find import in the fact that I also said I had high blood pressure, and sleep apnea. I informed him I was on medication(Hyzaar) for both hypertension and heart problems. I further informed him I was on more than 10 different prescribed medications. 11. Officer Butler related in the Police Report that I was wobbling from side-to-side when taking steps back and forth, and further that I missed the number"3" in the counting sequence of the test. I believe here again that he misrepresented what really occurred, I walked a straight path in both directions, and recollected all the numbers in the correct sequence. 12. Officer Butler stated that in the finger to the nose test I missed my nose,touching the right side of my face. This never happened. 13. Lastly,Officer Butler stated in the Police Report that I refused to be examined by a doctor. This is the largest of his prefabrication. I "ASKED"to be taken to the hospital if I was not released within the hour. Based on the information supplied herein,not limited to the fact that I was, in essence,denied access to a bail bonds person,medical care, and inconsideration of the fact that the alleged event OUR would have been a first offense,I respectfully and humbly request the court to grant my Motion to Dismiss. As you know, however, I am. 62 years old and have suffered a heart attack about six months ago, accordingly I 've set up a small cot in the back office where I also have an oxygen machine, computer, safe, and fax machine, and some medicine in the event I get sick. Sometimes I use this area to rest but never spend the night there. This office space is less than six feet wide and less than ten feet long. It has no windows or ventilation. Healey Salem District Court 65 Washington Street Salem, Massachusetts 01970 Dear Judge Healey: I am being persecuted, singled out, and constantly harassed by the Salem Police because I 've written letters criticizing their policies and methods . Just today, Detective Eric Connolly, who is investigating a break-in at my business which happened on August 3 , 2003 , came to my business to give me a citation because he says he saw me at Dunkin' Donuts across from my business on or about August 30, 2003 driving my Toyota truck. Instead of stopping me at the scene , he waited four days to issue the citation. Here is a police detective who is investi- gating a robbery at my store. He never issues traffic violations . He has taken further steps to persecute me. I was at Dunkin ' Donuts at or about 11 :00 AM on August 30 getting coffee for my employees but I walked across the street as I always do and walked back. It is only 50 yards from my store. Detective Connolly was not there. He -lied on the police citation. He is in collusion with other evil doers at the Salem Police Station who want to silence me so they have resorted to making up completely false accusa- tions to discredit and silence me . Instead of interviewing Scot Timsen who was probably responsible for the break-in at my Salem store, he spends his time trying to annoy me . Every day I notice a police cruiser staking out and watching me and my business . To make matters even worse, I appeared in Salem District Court on August 28 , 2003 to present my Motion to Dismiss which is enclosed. Unfortunately, I was subject to the decision by Judge Robert Cornetta. The reporter, Julie Manganis, of the Salem News never read my Motion to Dismiss or any of the letters written by me, or never interviewed me concerning this matter but did quote verbatim the Police Reports that were loaded with outright lies and printed a story on the front page of the Salem News which is slanderous toward me. I never offered any free haircuts to any police officer, 2 nor did I fail the field sobriety test as was stated in her article in the Salem News . This is the first time in my life that I am ashamed to be an American. The evil doers on the Salem Police Department will stop at nothing to completely destroy me or even put me in jail. They have no regard for decency or justice-at all. They will lie at every turn to win this case. They will make up stories to support their version as to what happened and will not stop until they put me in jail or force me to move from this area. The idea of freedom of speech does not exist with the Salem Police. They are the ones with power. They become judge and jury. If you cross them you'll pay, just as I will. If all else fails I plan to keep writing letters to everyone and I 've scheduled an audience with the Boston Globe September 17 for a possible feature story. I am currently a retired elementary 5th grade school teacher ' with over 22 years of public service in teaching. Currently, I own six Quality Cuts Hair Salons but work primarily at my Salem Salon located at 5 Traders Way. We represent the largest hair salon on the north shore, employing over 16 hair stylists. We average between 200 and 300 hair cuts daily. I am in the midst of any respectable person's nightmare. On Friday, June 7, around 1 : 30 AM I was arrested in Salem on Harbor Street for a one-way violation and operating under the influence of alcohol, my first offense. At that time, I was yelling and screaming at the arresting officer, Brian Butler, because the handcuffs were put on too tight and were cutting my wrist . Despite my cries for help, Officer Butler refused to loosen the handcuffs. About one hour later, when the handcuffs were finally removed and I showed Butler the cuts on my wrist , he said that he had seen worse cuts on other prisoners in .his career. At that time, I told Officer Reardon that I 'm 62 years old, own a local business here in Salem, and had major health problems, including a heart problem, high blood pressure, and sleep apnea among others, and further, if I was confined for more than one hour I would need to be brought to Salem Hospital for medication. At that time, both Reardon and Butler assured me that they would immediately summon Bob Murphy, a bail bond person to set the bail papers because I had over $138.00 in cash in my wallet and that I would be released within one hour. At that time, I called my wife to tell her that I would be released within one hour and for her to come and pick me up. The Intoxilyzer-Alcohol Analyzer administered by Kathleen Makros at the Salem Police Department showed my alcohol level at ,08 indicating only a few beers slightly above the safe level. I have never had a problem with alcohol and I was not drunk. As it turned out , Reardon never called Bob Murphy as promised . and -.I.-was left--in -the -cell without any contact whatsoever until- around twleve noon on the following day, some ten hours later. My wife came to the police station at least four times and called countless more times to get me out but each time she was told that nothing could be done until. bail had been set . All night long, and into the day, I kicked and shook the prison cell door and yelled for help but no one came or "cared to help me. There was absolutely no contact from anyone until -the day officer arrived around 9 :00 AM to inform me that Bob. Murphywould be arriving shortly from Middleton . Later, when I was released, Bob Murphy told me that if someone had informed him of my situation, he would have arrived immediately to set bail , but no one informed him. Yesterday, I called the police department to find out the procedure for filing a complaint and Sergeant Pooler informed me that I got what I deserved. She didn't understand why I was calling to complain . This is not the first time I 've had a problem with the procedure of the Salem Police. I had a similar problem back in July of 1998 . See attached letters. That problem ended in less than five minutes after a jury found me not guilty of all charges. It appears that the Salem Police make their own rules without regard to decency and respect . Since they are the law they abuse the power that citizens place in them. I am determined to expose this police department for what it is. I will use media and letter writing and customers who frequent my business. There is no place in the United States for a police department that operates like yours. When people are treated in the fashion presented herein, the smell extends throughout the system and reflects directly on you. In my 62 years of life, there are two events that have caused me to react in this manner and both of these heretofore mentione incidents are concerned with evil in your department . Furthermore, I 'm absolutely sure that several Salem Police Officers enjoy inflicting pain and emotional and physical suffering on innocent victims who happen to get arrested by your department . They are able to succeed at this because they are able to hide under the arm of the Salem Police Depart- ment where they are safe to hurt people. Back in 1998, when I started a letter writing campaign against the Salem Police Department , they immediately made up some phoney charges to arrest me again so as to quiet me but , instead it motivated me to write more letters.- It will not surprise me if you make up some phoney charges to punish me even further. He informed me that they could only be removed after the Intonilyzer-alcohol Analyzer Test. Despite Officers, Butler, Wilcox, and Reardon being present, they still refused to loosen or remove the handcuffs. An obvious breakdown of police procedure, standard to any normal police department. 6. During the interview section of the police report, Officer Butler admitted that I had physical defects; specifically a heart condition. At that time, both he and Officer Reardon promised me that I would not be incarcerated for more than an hour. However, they left me isolated in a cell for ten times longer than that ... ten full hours. 7. At booking, I called my wife and asked her to pick me up within an hour. She arrived at the Police Station within said hour, only to be turned away because no bail had been set for my release. She returned four additional times, calling over ten times, and consistenthv received the same response ... no bail had be set. She informed the Police vet again.. that I had a heart condition, and other medical problems and needed to be released immediately. In spite of her pleas, no correct procedure was followed. 8. The Intonilyzer-alcohol Analyzer administered at the Salem Police Department by Kathleen Makros indicated my alcohol level to be .08, indicating only a few beers, and was barely at the cusp of the safe level. I had only 2 beers and was not intoxicated. The Intonilyzer measured in hundredths and could easily have been off in calibration by a fraction ... putting me on the other side of the safe level. I respectfully request the Court extend me the benefit of the doubt in this matter. 9. Officers Butler's account of the Field Sobriety Test as recorded in the Police Report, do not reflect my recollection of the events as they occurred that evening. 'they are fundamentally inaccurate, and in some cases appear to be out and out fabrications. Officer Butler stated that when he asked me to perform a field sobriety test 1 started to curse and � rK Gordon C. Officer Butler admitted in the Police Report that I have a heart problem, yet somehow failed to find import in the fact that I also said I had high blood pressure, and sleep apnea. I informed him I was on medication(Hyzaar) for both hypertension and heart problems. I further informed him I was on more than 10 different prescribed medications. 11. Officer Butler related in the Police Report that I was wobbling from side-to-side when taking steps back and forth, and further that I missed the number"Y'in the counting sequence of the test. I believe here again that he misrepresented what really occurred,I walked a straight path in both directions, and recollected all the numbers in the correct sequence. 12. Officer Butler stated that in the finger to the nose test I missed my nose, touching the right side of my face. This never happened. 13. Lastly, Officer Butler stated in the Police Report that I refused to be examined by a doctor. This is the largest of his prefabrication. I"ASKED"to be taken to the hospital if I was not released within the hour. At a regularly scheduled meeting of the Planning Board held on Thursday, March 17, 1994, the Board voted by a vote of seven (7) in favor, none (0) opposed, to approve the application as complying with the requirements of a Special Permit, subject to the following conditions: 1. CONFORMANCE WITH PLAN Work shall conform with plan entitled "Proposed addition to Highlander Plaza Shopping Center, City of Salem, Essex County, Commonwealth of Massachusetts", sheets A-1 to A-3 dated November. 27, 93 and revised through 2/23/94, prepared by Barnett Berliner; and plan entitled "Retail Stores Highlander Plaza" , ;sheets C-1 to C-5 dated December 24, 1993 and revised through January 25, 1994 prepared by CID.
