In regards to a letter dated April 16, 2008 entitled 7 —9 Thomas Circle, I
have addressed all issues regarding Lot 3 and 4 with the exception of the
drainage pipe on Lot 4. 1 anticipate that I will have the appropriate
equipment on site within the next 30 days to install a drywell to rectify this
problem.
In response to the four items listed on the above referenced letter that
involve the sub-division, these items should be addressed at the appropriate
time during the construction phase of the finished road. At this time there
is work remaining on Lots 1 and 2 which must be completed before these
issues can be resolved. These are Planning Board matters and I will keep
them informed of my progress as well as the Building Department.

Dear Mr. Tiro,
Since my April 16 letter to you on the subject of the above properties you have made some progress in
addressing the issues raised in that letter. We have also granted a Certificate of Occupancy on the completed
house after being assured by you that all the items would be addressed:
The following is a list of issues from the April 16 which still un-adressed
• The prefab house at lot 3 does not match site-built foundation.
You need to address how you intend to remedy that situation. Your statement to me that the
existing detail was done intentionally to provide a brick shelf is patently ridiculous.
• A Drainage Pipe has been installed so as to discharge on adjacent property at Lot#4
• Pavement of public roads is incomplete and patches do not match adjacent pavement
• Road layout does not provide 20' wide access at beginning of circle
• The 155 if guardrail indicated on the approved Site Plan has not been installed
• Drainage swale adjacent to lot#1 not built per approved plan.
In addition to previously cited problems
• there is no portable toilet on site for workers at the unfinished building
• excavation equipment remains on site long after work is completed
• partial foundation excavation lot 2 is unprotected and poses a hazard
These issues must be addressed immediately. Failure to do so may result in further action including the filing of
complaints in District Court.

Dear Mr.Tiro,
At a recent visit to Thomas Circle, several violations of the Building Code (CMR 780) and of the Salem Code of
Ordinances Section 12-56 were observed.
These violations include:
• Uncontained construction debris left on site and migrating to adjacent property
• Roof Shingles have blown off the House at Lot#3
• The prefab house at lot 3 does not match site-built foundation.
• A Drainage Pipe has been installed so as to discharge on adjacent property at Lot#4
• Wood posts for side egress stair and rear deck are bearing directly on filled earth without
Foundations at Lot#3
• Deck posts at Lot#4 are improperly installed
• Pavement of public roads is incomplete and patches do not match adjacent pavement
• Road layout does not provide 20" wide access at beginning of circle
• The 155 If guardrail indicated on the approved Site Plan has not been installed
• Drainage swale adjacent to lot#1 not built per approved plan.
