DECISION ON THE PETITION OF RICHARD AND ROBERTA WILLIAMS FOR A
SPECIAL PERMIT FOR 3 THOMAS CIRCLE (B-2)
A hearing on this petition was held August 10, 1988 with the following Board
Members present: James Fleming, Chairman; Messrs. , Bencal, Nutting, Luzinski,
and Strout. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in
accordance withe Massachusetts General Laws Chapter 40A.
Petitioners, owners of the property, are requesting a Special Permit from
sideline setback and use extending non-conforming use to construct an
addition in this B-2 district.
The provision of the Salem Zoning Ordinance which is applicable to this
request for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance
the Board of Appeal may, in accordance with the procedure and conditions
set forth in Section VIII F and IX D, grant Special Permits for
alterations and reconstruction of nonconforming structures, and for
land, structures, and uses, provided, however, that such changes,
extension, enlargement or expansion shall not be substantially more
detrimental than the existing nonconforming use to the neighborhood.
In more general terms, this Bcard is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public
health, safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence and after
viewing the plans makes the following findings of fact:
1. The proposed addition would be in keeping with the surrounding
neighborhood.
2. There was no opposition.
On the basis of the above findings of fact, and on the evidence presented,
the Board of Appeal cond_udes as follows:
1. The granting of the Special Permit request will not be detrimental
to the public good and will not nullify or derogate from the district
or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
Special Permit, subject to the following conditions:
1. Building Permit be obtained, and occupancy permit from the
Building Inspector.
2. The petitioner meet all the requirements of the Salem Fire Department
relative to fire safety;

Mr. David Mitchell,
I am sending you this letter so you may be informed as to what
actions A. E . S. has taken for the Williams family of 3 Thomas Circle
in Salem. As you know a plastic line on their solar system which we
installed burst a small hole in it and caused their basement to be
flooded on 07/12/81.
The enclosed letters which have been sent to Mr. Williams
clearly states that our actions to attempt to quickly "temporarly
repair" their system so they could have hot water and solar hot
water back on line the morning of 07/13/81 . As is stated Mr.
Williams refused to allow our men (who were on their way ) to enter
their home and make temporary repairs so they could have hot water.
The morning of 07/13/81 our insurance company and equipment
manufacturer were notified so things could move as fast as possible.
Also I have been on the phone with Mr. Williams to try and convince
him to allow us to provide him with hot water , but , he demands
answers - that I , at this time do not have but should by
07 / 20 / 81 . This is the time when we should here from the
manufacturer as to what can be done.
We are prepared to provide Mr . Williams with " temporary
equipment" until new equipment can be aquired. This means we will
gladly put him back on line forthwith . At this time and date we are
not allowed into his home .
Should you have any questions please call anytime at
617-887-6555 or at my home phone of 617-887-5903.
I would like to assure you that we will work with you in any
way to try and come to some kind of agreement so the William' s
family can have hot water as soon as possible. All their personal
items are covered by our insurance company.

Dear Mr. Williams,
Alternative Energy Sources Inc . apologizes for the
inconvenience caused by the leak in your Rheem Solar Domestic Hot
Water System. We are attempting to cooperate with you to rectify
the situation.
For the record , this is the sequence of events as we see it
1., Sunday A. M. July 12 , 1981 . Mrs . Williams called
installer John Broughton and informed him of a leak in
their basement . Mr . Broughton got equipment together as
soon as possible and arrived at your home to perform
temporary repairs.
2. Monday A. M. July 13 , 1981. Mr . Williams called
A. E. S . and talked with Keith Dayton to discuss the
unfortunate situation . An offer was made by A.E.S. to
send men to your home this day , 07/13/81 , to make
temporary repairs enabling you to receive solar and have
hot water as soon as possible . Your statement to Keith
Dayton was to the effect that no one would be allowed to
work on the system until you received a statement from
A. E . S . which outlined that you are to receive a new Solar
- Tank.
3 . In response to to these and other demands , Keith
stated that immediate action by A.E.S. would be limited
to restoration of hot water and making active the Solar
System. Additional remedies to be discussed after A.E.S.
contacts the manufacturer , Rheem , and our insurance
agent . Hot water could have been provided and the men
were in the process of getting the equipment ready for
putting you back on line ; but with your verbal refusal ,
proceedures were halted.
Again Mr . Williams , A. E .S. apologizes for the inconvenience
caused by the leak in your system. We will work in good faith to
rectify the problem. Such rectification shall , however , be
governed by our written contractural obligations , application of
manufacturer warranties and limited by statute. A.E.S. will not be
responsible for damages not defined by the foregoing. parameters.

Dear Roberta and Dick,
This letter is to outline where Alternative Energy Sources
stands on your unfortunate accident caused by the hose on the Solar
System we installed. The first items I would like to review is that .
you did receive quick service on the day you observed the water in
your basement. You made a call and within hours a man was there to
attempt to repair the system. Remembering that this was a Sunday
and the following day being Monday left us little time to acquire
answers to some of your questions. This is the first insurance file
we have had to make out and report , and under the circumstances I
feel we have done quite well.
The request for you to have your complete system replaced
indicates to me that you don' t realize completely the workings of a
Solar Tank . As I have stated we are willing to return your system
to full operational working order . This would include the
replacement of the following items:
1. electronic system controller , a new updated model with
extra freeze sensor.
2. new relay and wiring to controller.
3. all new wiring inside the blue electrical box.
4. all electrical parts which were exposed to water , except
the circulator pump which is hermetically sealed and is
---- made of stainless steel.'
The removal and cleaning of the following items shall be
performed:
1. removal of the outter shell , dried and treated with a
protective coating
2. removal and replacement of insulation on the outside of
the Solar Tank.
3. drying and treatment of the outside of the tank itself
with a protective coating.
What you would end up with is a tank which has more protection
on it than one from the factory! Plus an updated controller which
is not availiable from Rheem.
Once again I must mention that you could have had hot water and
received Solar Hot water Monday 07/13/81 , but you refused to
receive any of our men to work on your system.
Our intension is to repair your system to better than origional
conditions as we have learned and engineered many new and better
installation proceedures since we installed your system a year ago.
This has always been our intensions and shall remain so.

Dear Roberta and Dick,
To let you know what we are doing for you I shall outline the
events as they were done . First , on 07/13/81 around 9 am our
insurance agent was called and they stated that they would send an
adjuster out to your home to get an estimate of the water damage.
Second , the very next phone call was to the Rheem Manufacturer
represenativ e , who was not in at that time and .a message was left
for him to get in touch with us as soon as possible The reason for
our call was explained in the message . Third , we called Rheem
Manufacturing Co. and explained the situation to them and the
proper authorities were not in the office at that time and they were
to call back as soon as possible.
We beleive that A. E . S . contacted all the proper persons
concerened as soon as physically possible to assure you that we are
working as fast as possible to receive the answers to your
questions . I would like to state again that we are prepared to
provide you with hot water and put your solar back on line forthwith
,. we are waiting for your permission to enter your home and make the
required temporary repairs until the proper equipment can be
located and delivered.
You have spoken to Rheem Manufacturing Co. and they stated that
the person responsible to make the required decisions would not
be back until 07/20/81 , so until then we can not give you any
answers relating to equipment . Also after talking to you tonight I
once again called our insurance company and they assured me that
they would call you and that an adjuster would be at your home as
soon as possible.
I have outlined in my letter of 07/14/81 all the new
equipment and service we are willing to do on your solar tank.
During our conversation I was pleased to here you say that you would
go over our proposal and possibly agree to the proposal . I
believe that you agreed with me that if we were to remove the outter
lining and dry it down and cover it with a protective coating and do
the same proceedure to the solar tank itself that you would have
an outter liner and tank which would last for many years longer than
a tank with no treatment.
We are concerned that you have no hot water and wish that you
would allow us to put in temporary equipment until we can aquire the
new equipment. This would at least allow you to have hot water and
collect solar hot water . This has been our offer since 07/13/81
I assure you that we are doing all that we can , as quickly as
possible.

departments having jurisdiction over the project, as listed
below. The Contractor shall pay all charges assessed by utility
companies and all state or federal authorities having or
asserting jurisdiction. Fees and charges which will be waived
include:
1. Fees for permits for street openings, curb cuts, and public
utility connections normally charged by the Department of
Public Works.
2. Fees and charges for work described in Paragraph 1A.103.C.2
of the summary of the work performed by the Department
