Dear Commission Members,
We are the holders of the property at 56 Swampscott Road, Salem MA(Map 7
lot 64), that abuts along a line, the applicants property at 4 Technology Way,
currently under permit review. We have some issues concerning the property located
at 4 Technology Way and we have decided to bring these issues forward now.
During Farfard's clearing & grading of the industrial park, they had brought
the buildable portion of their property, to the same elevation as the rear of our
property (see Photo 1).
We understand, for your reasons, you required that water run off from
4 Technology Way be routed through the storm drain system at Technology Way.
We concur as we do not want their water run off entering our property either.
We assume that is why Farfard had then raised the topography of their lot.
They did so by delivering a large amount of soil and spreading it out over their
property in order to grade their topography to a considerably higher elevation where
their property abuts ours.
You may not be aware that, in doing so, Farfard had spread some of this soil
over the stone boundary that had remained after their first grading (see Photo 2).
This stone boundary, now covered, had continued along the same line as a fieldstone
boundary that delimits their property from ours. We state that, we reserve the right
that if and when alterations are to be made to our topography, they would be in a
manner acceptable to us and at a time of our choosing. We are displeased that
Farfard had altered this, though small, portion our topography, regardless of their
intentions in this act.
Second, since Farfard had raised their topography above ours, no retaining
wall had been placed against the edge of this higher elevation of soil (see Photo 2
again)which is technically required. Without a wall in place, their soil will spread
further onto our property from the compressing and squeezing out of the soil caused
by the motion of construction equipment during future construction, and from the
continuous changing weight distribution of the future parking lot along that edge, and
also from weathering against that open edge. All of the above will result in an erosion
and a lessening of the current slope of the grade along this edge of their property,
which may also be of concern to you.

Ultimately we seek correction of these conditions as follows:
1) The removal of the soil that currently extends onto our property.
2) The construction of a wall, on their property, to retain their soil.
We would assume that customarily, the seller being the cause of, would be
responsible for, regardless of any potential buyer, and in this situation, the most
skilled and able to make these corrections; would offer to make these corrections
prior to the property's sale, so as not to hinder a buyer's efforts. Though now that
the seller and buyer are under agreement, they could re-negotiate their terms to
include these corrections, we hope, amicably, and swiftly, if they have not already
done so.
So, for the present:
We ask that the buyer & seller determine which party will be
responsible to make these corrections.
We ask for the party assuming these corrections to provide us with a
written agreement stating that the corrections will be made within two
years, or prior to further development, whichever occurs first; in lieu
of immediate correction.
We_ack.fnr the City Of Salem to attach a proviso onto the building
permit requiring that these corrections are to be made prior to further
development, and that they provide us with the written agreement to
correct, stated above.
We pray that the City Of Salem will consider our requests and concur with us.

3. The petitioner,Davita Healthcare Partners is requesting a Special Permit per.Sec. 3.1 Principal Uses to
operate a medical clinic in a portion of property located at 4 Technology Way.
4. The current use of 4 Technology Way is research, technology and general office space.
5. The proposed medical clinic is a dialysis center that would provide services
patients per day and staff thirty-two (32) employees per day, to approximately 66-88
6. The current facility located at 10 Colonial Road in Salem does not meet current service demand.
Therefore the company is seeking the possibility of relocation to 4 Technology Way.
7. The proposed hours of operation of the dialysis clinic are from 5am to 8pm.
8. Approximately 22 patients would access the site independently by car or by ambulance services in
three shifts per day starting at Gam, l lam,and 4pm.
9. The facility will also have 1-2 deliveries made per week by a tractor trailer.

We have been at the site repeatedly over the last 3 months and,to be blunt,work was proceeding very
slowly until the past month beginning in early April. In that 4 to 6 week period a lot of the cosmetic work
has been substantially completed. That work includes:
• Interior painting
• Vinyl tile flooring
• Suspended ceiling installation
• Installation of carpet tiles in most areas
• Ceramic tile floors in toilets and janitor closets
• Installation of toilet fixtures and accessories
• Installation of electrical devices and fixtures with completed wiring
• Completion of fire alarm and life safety equipment
• Installation of welded stair rails at egress stairs
Work in process for this report:
• Continuation of glass rail installation at front stair and atrium(bases and clips are in place)
• Enclosure and completion of egress stairs
• Installation of porcelain tile in main lobby
• Installation of vinyl base at vinyl tiled and carpeted floors
• Installation of interior glass walls,windows and doors
Also substantially complete:
• HVAC systems (currently operating in all"occupied"areas of the building.
• Elevator(inspection scheduled the week of May 21-25)
• Emergency generator installation(equipment in place—wiring in process)

The exterior of the building is complete with the exception of 2 broken windows and some door hardware
replacement.

In the original design of the building US Biological was proposing to occupy 60%of the first floor and
50%of the second floor. Those percentages have remained thru the construction but the layouts have
changed,mostly by field changes co-ordinated by the Owner,his interior designer,our firm and the MEP
engineers. There is currently some discussion about modifying the back area of the building by installing
a floor over the existing atrium and developing tenant spaces. We are encouraging the Owner to allow us
to further study of that back area while we assess the changes required(architectural,structural and
mechanical)to incorporate any such modifications. We feel strongly that the US Bio portions of the
building should be completed and occupied prior to any work being done in the back. The only work in
process is the enclosure of the back egress stair as required by Code.
Although we are not responsible for it we offer the following regarding site work. The site is still in some
state of disarray but,as we understand it,is getting closer to completion. The Owner has engaged the
services of Alliance Engineering from Saugus to survey the site,the utilities as installed,the drainage and
grading. Alliance has the list of concerns form the Conservation Commission,the Planning Department
and DPW. He is addressing those areas of interest to them including:
• Existing site grading and pavements will be modified as required to ensure slope to drainage
structures
• The site drainage and structures will be surveyed and modified(if required)to ensure proper
drainage to the detention basin
• The slope on the left side of the site will be designed as a sloped stone revetment to safely hold the
bank(the wall has been designed and submitted to Dave Knowlton and written permission from the
abutter is in hand)
• The street repair and catch basin at the comer of Technology Way and Swampscott Rd has been
designed and submitted to Dave Knowlton,he has made some continents which will be incorporated.
• The final parking layout has been determined(at a meeting with me,Danielle McKnight and Tom
Devine) and will be incorporated in"as built'site plan.
• Grades and final configuration of sidewalks and HC ramps as shown on the approved site plans.
The interior work being performed appears to be in substantial compliance with the contract documents
and in accordance with the Code requirements. If the work proceeds at the current pace we anticipate we
will be prepared to issue Final Affidavits by the end of the this month.

Dear Mr. Knowlton:
On behalf of our client, U.S. Biological, Engineering Alliance, Inc. (EAI) is pleased to submit the
following for your review regarding the above referenced project:
• One (1) copy of a plan entitled "As-Built Plan" prepared by Leblanc Survey Associates,
Inc. and dated December 17, 2012.
• One (1) copy of a letter by Roome & Guarracino, LLC Consulting Structural Engineers
dated January 21, 2013.
Representatives from EAI have been on-site at various times since June, 2012 to witness
construction activities at the subject property. Based on our review of the enclosed As-Built
Plan and inspection of the site, we find the project to have been constructed in substantial
compliance with the approved plans, Planning Board Decision and Order of Conditions issued
by the Salem Conservation Commission.
The As-Built plan illustrates some deviations from the approved plans; however, based on our
review, we feel that overall the plan is in substantial compliance with all approvals and generally
accepted engineering practices. The deviations include the following:
• CB-2 shown on the approved plan was eliminated and replaced with a high point and CB-
3 was shifted to the north. Although this results in a slight change to the grading and
drainage, all storm water runoff generated from the site is captured on-site, treated and
discharged to the proposed storm water detention facility. The storm water detention
facility was built in accordance with the approved plan. In addition, the slopes of all
drainage pipes meet or exceed the designed values (many were designed at 0.05 ft/ft,
and most were constructed at 0.08 ft/ft). Based on our review, the storm water
management system is functioning as designed and meets the goals of the original
drainage design.
• The transformer and generator were relocated from the area shown on the approved plan
(South side of building)to the south side of the parking lot. The relocation of this
equipment does not appear to have an impact on the layout of the site. The additional
parking spaces that were added to the rear of the building offset the spaces that were
lost due to the relocation of the generator and transformer.
• The landscaped island to the rear of the building is smaller than the previously approved
plan. Although this area is smaller than shown on the original plan, all storm water
generated from the site is captured, treated and discharged to the down gradient storm
water facility. The storm water detention facility has ample capacity to handle this
modest increase in impervious area.

• A stone wall was constructed on the northerly side of the site in lieu of the modular block
wall and a 1:1 stone slope was constructed on the south side of the parking lot in lieu of
the proposed ledge cut. The stone wall and rip rap slope were inspected by Roome &
Guarracino, LLC Consulting Structural Engineers and determined to be structurally
stable and adequate.
Overall, the site was found to be stable, well constructed and functioning as the original design
and approvals intended. We are hopeful that upon your review of the site and this information,
a recommendation for a final occupancy permit may be granted for this project.

The office of ROOME & GUARRACINO LLC has been retained in order to review the stone
wall construction at the above referenced project address. The review is based solely on our
visual observations made on site, as well, as conversations 'and discussions with the general
contractor and site contractor in charge of the wall construction.
After careful review of the walls in place and the methodology of construction and back-filling
operations, it is our professional opinion that the walls appear to be stable, safe and built in
accordance with the applicable provisions of the Massachusetts State Building Code 8th Edition.

I received your letter regarding the reporting of construction as required by the Construction Control
Affidavit. I have visited the site at frequent intervals(sometimes more than weekly)since last May and
have kept written records of those visits. I will assemble those reports and send them to you immediately.
While we have made some internal floor plan changes to accommodate the Owners program the building
is substantially the same as shown on the Permit drawings. In all cases in the course of my visits the
work observed has been proceeding in accordance the plans and specifications and entirely in accordance
with the Building Code.
By copy of this letter I will refer you to Peter Varone and Peter Holland to confirm the actions required by
a Site Engineer. I know that Engineers have been on site to lay out the site and utilities, confirm the
foundation location and dimensions and lay out the site perimeters and grading.
I apologize for not getting these reports to you sooner.
