Dear Mr. Leahy,
This Department continues to receive complaints regarding crushing activities and the receiving of ABC
(asphalt,brick and cement) materials at this site.As we discussed in my office almost a year ago,you are not
permitted for processing of ABC materials and you agreed to stop receiving the ABC materials.You also
agreed that the crusher would be used to process the existing ABC material to remove it from the site and going
forward,the only crushing would be of stones that were a by-product of the recycling operation.
Enclosed is a citation for a zoning violation($50). Be advised that the fines increase each day to$150 and then
$300 per day of violation . If you feel; you are aggrieved by my zoning interpretation,your Appeal is to the
Salem Zoning Board of Appeals .
Additionally,please let us know when construction of your office building will commence. This issue is also a
Zoning issue and is over a year old .
The third item is your truck traffic tracking debris onto Swampscott Road. We discussed this issue last year and
to date there has been no resolution of this problem,.

As a result of complaints made to this office regarding the business you are operating at 149 Swampscott
Road, it has come to our attention that you are operating a business in a manner that is not properly permitted or
allowed by zoning. For example ,it appears that you have substantially increased the nature of your business
without the necessary Special Permit and are operating your business from a trailer, which is prohibited by
zoning. Additionally, it is likely that your business requires site plan approval.
