Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner request a Special Permit to allow a Dance Studio in a light industrial building for the property located at 96 Swampscott Road located in a BPD zone. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section 5-3 (2)(8)which provide as follows: Notwithstanding anything to the contrary appearing in this Ordinance,the Board of Appeal may,in accordance with the procedure and conditions set forth in Section 8-6 and 9-4,grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion, of nonconforming lots,land, structures,and uses,provided however,that such change,extension,enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms,this Board is,when reviewing Special Permit requests,guided by the rile that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health,safety,convenience and welfare for the City's inhabitants. A. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or structures in the same district. B. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise,to the petitioner. C. Petitioner Croom Construction Company through its principals Thomas and David Groom seeks a special permit to sublet space for a nonconforming use in a building known as Salem Commerce Park, located at 96 Swampscott Rd, in a BPD District 2. For several years the property housed a nonconforming use by Atlantic Extrusions,a manufacturer of plastic extrusion material. The nonconforming use was discontinued some 5 years ago,and the property was vacant and unused prior to the current ownership. 3. Through their Attorney Scott Grover Esq.,Groom stated it has agrecd to lease 31, 370 square feet of area in the building for its business operations as a construction management firm. Of that area, Groom wishes to sublet 3,300 square feet of space to Deane School of Dance to operate a dance studio and offer dance classes. 4. Deane School has operated for 75 years in Salem and is currently seeking new space for its classes. Shauna Tremora,granddaughter of the school's founder and a co owner of the Deane School,stated that about 30 classes are offered each week, with in all between 100 to 175 students. 5. According to Ms. Tremora,the proposed location is convenient to students from Lynn and Swampscott as well as Salem. Parents dropping off students would use a turnaround in the parking lot,and those wishing to park could use the 45 spaces leased to Groom in the parking lot. Due to the limitation of space,no performances would be held there. Both Ms. Tremors and the Groom's attorney stated that the uses were compatible with each other. 6. City Councillor President and Ward 3 Councillor Jean Pelletier spoke in support of the petition,citing the benefits to the City of accommodating to family businesses.The petition also received support from members of the public whose children were enrolled in the Deane School and form people in attendance. On the basis of the above findings of fact,and on the evidence presented at the hearing,the Board of Appeal concludes as follows: 1. Literal enforcement of the provisions of the ordinance would involve substantial hardship on the petitioner. On the basis of the above findings of fact,the Zoning Board of Appeal voted 4 in favor and 0 in opposition to grant the Special Permit requested,subject to the following conditions. 1. Petitioner shall comply with all city and state statues,code ordinances and regulations. 2. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 3. All construction shall be done as per the pians and dimensions submitted and approved by the Building Commissioner. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. Petitioner shall obtain a Certificate of Occupancy. i 6. Petitioner shall obtain approval from any City Boards or Commission having jurisdiction including,but not limited to the Planning Board. 7. Parking plans shall be submitted with the drop off area to the Building Commissioner. The Conservation Commission has determined the bordering vegetated wetland to be significant to the protection of the Act. Therefore, no work may be permitted on the "Business Park Development" site which destroys or otherwise impairs a bordering vegetated area in excess of five thousand (5,000) square feet. 3. The Fafard Companies, Inc. shall submit a detailed plan covering all construction activities outside the boundary of the Maynard Plastics site but within the "Business Park Development". Said plan shall include, but not be limited to, roadwork, grading drainage, control structures, and wetland replacement area. Any damaged- or impaired bordering vegetated wetland up to, but not to exceed five thousand (5,000) square feet shall be compensated for on a one for one, square foot for square foot basis in the following manner: a) The replacement areas shall function in a manner similar to the area that will be lost. b) The replacement area shall have surface and ground water, elevations approximately equal to the wetland areas to be filled. C) The overall horizontal configuration and location of the replacement area with respect to the bank will be similar to that of the lost area. d) The replacement area shall have an unrestricted hydraulic' connection to the same water body associated with the lost area. e) The replacement areas shall be located within the same general area of the waterway as the lost area. 4. All replacement areas to be constructed shall be lined on their surface with topsoil excavated from the wetlands to be filled as a ' result of the project. Arrangements shall be made for storage and protection of the topsoil after removal and before replacement. 5. At least 75% of the surface of the replacement areas shall be re—established with indigenous wetlands plant species within two growing seasons. Prior to vegetative re—establishment, any exposed soil in the replacement area shall be temporarily stabilized in accordance with "Erosion and Sedimentation Control Guidelines", Publication #13, 529-39-1000-2-84—C.R. , dated August, 1983. 5-6 6. Any compensatory wetland area which does not revegetate with characteristic bordering vegetated wetland species over 75% of its surface area within two growing seasons shall be re-planted with characteristic species. A planting plan for such purposes shall be presented to and approved by the Salem Conservation Commission prior to its implementation. 7. Prior to any construction within one hundred feet of the wetlands as shown on the above referenced plans, an erosion control and sedimentation barrier shall be installed between the construction site and any down gradient bordering vegetated wetlands. The erosion controls and sedimentation barriers shall be established in accordance with "Erosion and Sedimentation Control Guidelines", Publication #13,529-39-1000-2- 84-C.R. , dated August, 1983, and approved by the Salem Conservation Commission or its designated agent. 8. The Fafard Companies, Inc. , and its successors and assigns, shall be responsible for maintenance of all drainage inlets and outlets and for ensuring that said maintenance becomes a condition of all leasing or ownership of those properties for sale or lease within the Business Development Park. Copies of all such maintenance agreements shall, be forwarded to the Salem Conservation Commission and the DEQE. 9. The City of Salem and The Fafard Companies, Inc. and its successors and assigns shall enter into an agreement which guarantees maintenance of the proposed control structures and forward such agreement to the Salem Conservation Commission and DEQE. 10. Any work requiring Conservation Commission review and/or approval shall be completed to the satisfaction of the Salem Conservation Commission prior to commencement of work in a subsequent phase unless prior consent from the Salem Conservation Commission is obtained. This consent shall not be unreasonably withheld. 11 . The Fafard Companies, Inc. , and the City of Salem shall enter into an agreement for an independent Clerk of The Works who can act as the designated agent of the Salem Conservation Commission. 12. Any changes made or intended to be made in the plans shall require the applicant to inquire of the Conservation Commission in writing whether the changes require Salem Conservation Commission comments or approval. 13. Future phases within the "Business Park Development" site shall be reviewed and acted upon by the Salem Conservation Commission, both independently and as they impact the total -development. . 5-7 14. The Fafard Companies, Inc. , and its successors and assigns shall be required to submit all plans for above and below ground chemical storage to the Conservation Commission and DEQE for their approval prior to their construction. Should the Fafard Companies, Inc. , and its successors and assigns require a change in the use, or addition to, said storage tanks, the Conservation Commission shall be notified in writing two (2) weeks prior to any change. 15. The adequacy of the 36" and 24" culverts on Swampscott Road immediately downstream of the "Business Park development" shall be ' analyzed by the developer in conjunction with the City Engineering Department. An engineering report detailing the findings shall be submitted to the Engineering Department and Conservation Commission for its approval. If deemed necessary by the Engineering Department and Conservation Commission, upgrading of the culvert(s) shall be undertaker by the developer and at the cost of the developer. A plan detailing the upgrade procedure shall be submitted to the Conservation Commission for its approval prior to construction. 16. Notwithstanding the approval of plans, calculations and supporting documents referenced as part of this Order of Conditions, the respective discharge flows from the stream paralleling the south eastern border of the "Business Development Park" and the stream paralleling Swampscott Road shall not be increased beyond their present levels. 17. The Fafard Companies, Inc. will immediately submit their engineer' s findings regarding waste material within the "Business Park Development" to the DEQE. If DEQE determines the stockpiled material to be non—hazardous, The Fafard Companies, Inc. will remove the material from the Business Park Development to another location owned by the Fafard Companies and disposed of in a manner approved by the Conservation , Commission. Fill material which DEQE determines to be hazardous shall be removed from the site within four weeks from the date of the positive finding. The hazardous material shall be removed to an approved facility and copies of delivery slips shall be supplied to the Conservation Commission. Until such material is removed, the stockpiled material shall be covered and surrounded by hay bales. The Fafard ,Co. shall promptly provide the Conservation Commission with copies of all correspondence to and from DEQE. •• 18. Banks bordering vegetated wetlands shall be disturbed as little as possible. Those bank areas requiring alteration will be regraded at a maximum slope of 1k:1 , loamed and re—established with indigenous vegetation. At the top of said slope, a 6' level pervious landscaped zone shall be maintained. In locations where the Fafard Companies,' Inc. are unable to maintain the banks as defined above, detailed plans for those specific conditions will be submitted for Conservation Commission approval prior to construction. 5-8 19. The Fafard Companies, Inc. , and its successors and assigns shall be responsible for ensuring that salt as a deicing agent shall not be used on the roadways. This prohibition of salt as a deicing agent shall become a condition of all leasing or ownership of those properties for sale or lease within the "Business Park Development". 20. The above conditions designated by * shall remain in effect beyond a Certificate of Compliance issued for this phase of construction. 1 21 . Jim Merloni, .I an engineer, presented a drainage plan to the Board and noted that his calculations indicate the need for a retention basin to compensate for the two small culverts presently existing on Swampscott Road. His calculations indicate the use of this retention basin will decrease runoff by 50% during peak storm periods . Philip Moran asked what the dimensions of the building would be and Howard Fafard replied that it would be 163 ,000 sq. ft. , (500, x 1601 ) . Mr. Moran asked about the impact of increased runoff on neighboring properties and Mr. Mer3oni replied they will retain the majority of the increased runoff . - Page 2 - Glenn Yale asked if the water level and retention design of the Ebershoff project was considered fn calculating this design and Mr. Merloni replied in the affirmative. Glenn Tale asked what preconstruction runoff coefficients were and Mr. Merloni replied 57 cubic feet per second. Mr. Yale asked what would be done about the existing reinforced culverts and Staff Advisor Dale Yale replied that the City would have to address this. Mr. Merloni added that the proposed retention area would somewhat improve that situation. Dale Yale asked what type of control structure would be installed and Mr. Merloni answered they probably would use an open pipe which would be the easiest type of structure to maintain. Glenn Yale asked what elevation the top of the retention pond would be and Mr. Merloni calcuia:ed that elevation to be approximately 90. Glenn Yale noted the slope of the berm on the retention pond could encroach on neighboring property . Glenn Yale further aues,ticned how the slope would be stabilized and Mr. Fafard stated they would likely rip-rap the slope. Further, the slope is proposed to be at 1 : 1�. Philip Moran inquired as to how many employees Maynard Plastics has in their employ how many parking spaces were available to them and where parking was available on the site. Mr. Fafard, answered that there iare approximately 250 employees , 125 parking spaces, and that parking will nE available on both sides of the entrance td the building . I { WETLANDS VIOLATION'S UPDATE I Regarding Mr. Mackey' s property on Legg' s Hill , Staff Advisor Dale Yale had received a request from Mr. Mackey' s attorney to remove more gravel from the site. It was agreed the Commission had acted in good faith by allowing Mr. 'Mackey to remove in the agreed upon area. Therefore, he will be notified that no further removal can take place until a formal filing with the Commission is made . �rt • . Petitioner Groom Construction Company through its principals Thomas and David Groom seeks a special permit to sublet space for a nonconforming use in a building known as Salem Commerce Park, located at 96 Swampscott Rd, in a BPD District. 2. For several years the property housed a nonconforming use by Atlantic Extrusions, a manufacturer of plastic extrusion material. The nonconforming use was discontinued some 5 years ago,and the property was vacant and unused prior to the current ownership. 3. Through their Attorney Scott Grover Esq.,Groom stated it has agreed to lease 31, 370 square feet of area in the building for its business operations as a construction management firm. Of that area, Groom wishes to sublet 3,300 square feet of space to Deane School of Dance to operate a dance studio and offer dance classes. 4. Deane School has operated for 75 years in Salem and is currently seeking new space for its classes. Shauna Tremors,granddaughter of the school's founder and a co owner of the Deane School,stated that about 30 classes are offered each week,with in all between 100 to 175 students. 5. According to Ms. Tremora,the proposed location is convenient to students from Lynn and Swampscott as well as Salem. Parents dropping off students would use a turnaround in the parking lot,and those wishing to park could use the 45 spaces leased to Groom in the parking lot. Due to the limitation of space,no performances would be held there. Both Ms. Tremora and the Groom's attorney stated that the uses were compatible with each other. 6. City Councillor President and Ward 3 Councillor Jean Pelletier spoke in support of the petition,citing the benefits to the City of accommodating to family businesses.The petition also received support from members of the public whose children were enrolled in the Deane School and form people in attendance. At the April 17, 2013 regular meeting, the petitioner provided supplementary noise and trucking documentation for consideration. 3. The petitioner is requesting the allow the vertical expansion of two existing storage Bins and the development of two new storage tanks closer than ten feet to the principle building and that exceed eighteen feet in height. The petitioner's proposed dimensional requirements include: - Extend two (2) existing flout storage bins to 38'-6" - Construct one (1) CO2 storage tank to 38'-9" - Construct all tanks 1' from an existing structure 4. At the first hearing for this petition numerous members of the public in attendance spoke in opposition to the petition due to noise and truck delivery concerns. At the April 17, 2013 meeting, numerous Councilor Siegel spoke in favor of the petition and the steps taken by the applicant to address the noise and delivery concerns. No written comments were submitted in opposition or support of the petition prior to the hearings. The proposed wind turbine is 41 feet in height when the blades of the turbine are in their highest position. 5. The petitioner was represented by Susan St. Pierre. Building Commissioner Thomas St. Pierre made a disclosure that he was a cousin to Ms. St. Pierre. r 6. Ms. Stein read a letter into the record from Robert DeRosier, in support of the proposed wind turbine. 7. Steve Berson, 45 Britania Circle, inquired whether a noise study has been conducted for the proposed wind turbine and whether the wind turbine will operate 24 hours a day. 8. The petitioner provided written information from the product manufacturer regarding noise and indicated that when standing on the ground next to the turbine it sounds like a commercial air conditioning unit. On the basis of the above findings of fact, including all evidence presented at the public hearing, including, but not limited to the petition, the Zoning Board of Appeals concludes as follows: I. The petitioner's request for a variance does not constitute substantial detriment to the public good as wind turbines are a new "green" energy saving technology. Nor does the relief nullify or substantially derogate from the intent or purpose of the zoning ordinance, as the proposed wind turbine is 9 feet lower than the allowable height of buildings in the Business Park Development Zoning District. 2. A literal enforcement of the zoning ordinance would create a substantial hardship to the petitioner, which hardship is due to the maximum zoning height of 18 feet for accessory structures. There are no wind turbines in commercial production that could comply with the 18 foot requirement. 3. In permitting such change, the Zoning Board of Appeals requires certain appropriate conditions and safeguards as noted below. In consideration of the above, four (4) members (Stein, Debski, Dionne and Pinto) of the Salem Zoning Board of Appeals voted to grant the petitioner's request for a variance, and zero (0) members voted to deny the petitioner's request for a variance, subject to the following terms, conditions, and safeguards: 1.
