Dear Mr. Paquin:
In response to our telephone conversation of 3/6/86 concerning the use of
mechanical lifting devices, I am sending this letter with the enclosed
specification sheet of our incorporation of the lift into the facility we
are planning at 38 Swampscott Road in your community.
The lift incorporates a series of mechanical/electrical interlocking
devices which will prevent it's operation unless the following safety
features are followed:
1. There is an infared heat sensor which does not allow people to ride
the lift up and down.
2. There is a devise which senses whether the roll up doors are in the
closed position.
3. The third sensor detects whether the gates are closed.
Unless these safety features are all incorporated, the lift will not
operate.
The lift, as well as the surrounding stairs, are enclosed with a two hr.
separation wall which separates it from any portion of the lower level ;
your path of travel is from outside directly to the second hall .

Relative to your communication to Mr . Bill Racik of Klipp Associates
concerning the requirements of Chapter 148, Section 25E, Massachusetts
General Laws, I cannot concur with the interpretation rendered by Mr ..
Munroe concerning the insertion of 3-hour walls in lieu of the
installation of a sprinkler system .
The law states clearly that "the gross square feet of a building or
addition shall include the sum total of the floor areas for all floor
levels, basements, and sub-basements, measured from outside walls,
irrespective of the existence of interior fire resistive walls, floors and
ceilings ."
In view of the provisions of this section, these buildings shall be
required to be protected throughout with an adequate system of automatic
sprinklers in accordance with the provisions of the Massachusetts State
Building Code.

Sprinkler Requirements
We reviewed the Salem Fi-re Marshal 's request, dated 9 July, 1985, for
submission of plans for a sprinkler .system, required under Chapter 148,
Section 26G of the Massachusetts General Law.
Discussion with Fire Marshal turner revealed that this law, adopted
recently by the Salem City Council , requires sprinklers for any non-
residential .building greater than 7,500 gross sq. ft. He recommended
I speak.with the Town Building Inspector, William Monroe, to clarify
the definition of gross building area.
On 26 August, during a phone conversation, Mr. .Monroe stated that a
3-hr. full-height wall , with pressure treated plywood .roof .sheathing

would be sufficient to meet the requirements of Chapter 148, Section 26G.

CSECTION 26E. Local Option for Smoke Detectors in
Private Dwellings.
In any city or town which accepts this section, buildings or struc-
tures occupied in whole or in part for residential purposes, and not
regulated by sections twenty-six A, twenty-six B, or twenty-six C shall,
within one year of the date of such acceptance, be e uipped with an
approved monitored battery power smoke detector" or n oved primary
power smoke detector. For buildings or structures chole or
in part for residential purposes and containing a maxi Q well-
ing units, either an approved monitored battery power smo e e or
an approved primary power smoke detector shall be installed on e h
level of habitation and on the basement level; provided, however, that
the head of the fire department shall allow the installation of approved
monitored battery power smoke detectors. Such approved monitored battery
power smoke detector or approved primary power smoke detector shall be
installed in the following manner: an approved monitored battery power
smoke detector or an approved primary power smoke detector shall be
installed on the ceiling of each stairway leading to the floor above,
near the base of, but not within each stairway and an approved monitored
battery power smoke detector or an approved primary power smoke detector
shall be installed outside of each separate sleeping area. For build-
ings or structures occupied in whole or in part for residential purposes
and containing not less than three nor more than five dwelling units,
either an approved monitored battery power smoke detector or an approved
primary power smoke detector shall be installed in each dwelling unit
outside each separate sleeping area; provided, however, rthat the head of
the fire department shall allow the installation of approved monitored
battery power smoke detectors; and provided, further, that in all common
hallways of said residential buildings or structures a series of inter-
connected approved primary power smoke detectors shall be installed. The
head of the fire department shall enforce the provisions of this sec-
tion. The provisions of section thirty shall not apply to this section.
SECTION 26F. Sellers to Install Smoke Detectors; Enforcement.
All buildings or structures occupied in whole or in part for resi-
dential purposes and not regulated by sections twenty-six A. twenty-six
B or twenty-six C shall, upon the sale or transfer of such building or
structure, be equipped by the seller with approved smoke detectors as
provided in section twenty-six E.
The head of the fire department shall enforce the provisions of
this section. The provisions of section thirty shall not apply to this
section.
Section 26G. Installation of Automatic Sprinkler Systems; Enforce-
ment.
In any city or town which accepts the provisions of this section,
every building or addition of more than seven thousand five hundred
gross square feet in floor area shall be protected throughout with an
% adequate system of automatic sprinklers in accordance with the provi-
sions of the state building code. No such sprinkler system shall be
required unless sufficient water and water pressure exists . For purposes
of this section, the gross square feet of a building or addition shall
include the sum total of the floor ' reas for all floor levels, basements
and sub-basements, measured from o }de walls, irrespective of the
existence of interior fire resistive wills, floors and ceilings.

ENVIRONMENTAL EXEMPTIONS
In general, an application to MIFA will not subject a project to the
state's Environmental Policy Act. However, certain exceptionally large
projects or projects located in certain coastal areas or other areas
designated by the Secretary of Environmental Affairs.will .be subject to
the state's environmental review. These special projects and critical
locations are summarized as follows:
1. Certain Projects
50 Acres or More 1. Any new non-residential construction
project (other than utility lines)
entailing direct alteration of more
than 50 acres of land.
Wetlands 2. Any project requiring alteration of
ten or more acres of land subject to
c. 131 sec.40 (the Massachusetts Wet-
lands Protection Act) .
Streams 3. Stream channelization or channel re-
location of 2000 feet or more.
