It is my understanding that the area in question is currently within a Business Park Development Zone. Business Park Development Zones were first created by a zoning ordinance change adopted on March 18 , 1985. This zoning ordinance change was subsequently challenged in the court (Essex Superior #85-903 ) for technical reasons and declared invalid by a Judgment entered July 15, 1985 . It is my recollection of the matter that the City anticipated an adverse decision and readopted the ordinance to correct techincal errors . The first advertisement of the public hearing on the resubmitted ordinance was April 29, 1985 and the ordinance was properly adopted on June 17 , 1985. I have examined the records of the Planning Board and the owners of the property in question by letter dated April 12 , 1985 and received by the Planning Board on April 12 , 1985 submitted' a proposal to develop a small tenant business park at the above location. At the time of this submission, the owners submitted their plans pursuant to the requirements of the Business Park Development Ordinance which, as I related above, was subsequently held to be invalid. - 2 - As the land in question had previously been zoned Industrial, it is my opinion that by submission of their development plans prior to the first advertisement of the resubmitted ordinance on April 29 , 1985, the use is governed by permitted uses of industrial land at the time of submission of the plans. As Industrial Districts provide for general business uses, such as eating establishments, it is my opinion that the use of the premises for a pizza delivery/take out store or other similar business use is permitted. Such uses might include eating facilities, athletic centers, and recreational facilities. On Swampscott Road, there is currently being developed a business park. Construction is near completion, and the project is being tenanted. An athletic facility, Rocky's Gym, would like to locate there. The intent of the ordinance, as drafted by the Planning Board, was that such uses should and would be allowed as an appropriate ancillary use. In addition, I should note that the Special Permit for this development was requested and a hearing was held prior to passage of this new zoning. As a result, the prior zoning, which I believe allows this use, may prevail. It is my understanding that the area in question is currently within a . Business Park Development Zone . Business Park Development Zones were first created by a zoning ordinance change adopted on March 18 , 1985 . This zoning ordinance change was subsequently challenged in the court (Essex Superior #85-903 ) for technical reasons and declared invalid by a Judgment entered July 15 , 1985 . It is my recollection of the matter that the City anticipated an adverse decision and readopted the ordinance to correct technical errors . The first advertisement of the public hearing on . the resubmitted ordinance was April 29 , 1985 and the ordinance was properly adopted on June 17 , 1985 . I have examined the records of the Planning Board and the owners of the property in question by letter dated April 12 , . 1985 and received by the Planning Board on April 23 , 1985 submitted a proposal to develop a small tenant business park at the above location. At the time of this submission, the owners submitted their plans pursuant to the requirements ' of the Business Park Development ordinance which, as I related above , was subsequently held to be invalid . a As the land in question has previously been zoned Industrial, it is my opinion that by submission of their development plans prior to the first advertisement of the resubmitted ordinance on April 29; 1985 , their use is governed by permitted uses of industrial land at the time of submission of the plans . As Industrial Districts provide for general business uses, it is my opinion that the use of land for an athletic facility or other business use is permitted . Having reached this opinion, I need not address the matter of the intent of the Planning Board relative to uses not specifically enumerated in the Business Park Development Zone . If there may be confusion in the future relative to other land in such zone=s after the effective date of the properly adopted ordinance, I. will address the same if needed.
