The ensuing communication shall serve as our follow-up to our December 2012 site meeting; the
purpose of the investigation was to discuss the secondary means of egress required from the
living unit designated as#3. Let it be noted that violation stated in this correspondence is solely
a matter that is governed by this office and the Massachusetts State Building Code 780 CMR,;
therefore, under the authority of the Mass State building code 780 C.M.R, you are directed to
address the following:
1- 33 Summit Avenue, Unit#3—Exit and Exit Access Doorways, Section 1015 & Number of
Exits and Continuity, Section 1021- Unit presently has only one means of egress out of the
unit in violation of the aforementioned 780 CMR. The situation heeds to be addresses
immediately, and the Building Department notified of the solution.
It is pertinent that an immediate solution be determined and plans and application be applied for
at our Department for the 33 Summit Avenue, Unit #3 secondary egress violation. As discussed
at the December 2012 meeting and subsequent phone calls a spiral stair, not requiring a variance
from the Board of Building Regulations and Standard (BBRS), was the solution that was agreed
upon to correct the violation.
You are hereby ordered to contact this office immediately upon of receipt of this notice to inform this office of
your course of action. Failure to do so may result in further actions being brought against you, up to and
including the filing of criminal complaints at District Court.
