Luzinski. Notice of the hearing was sent to abutters and others and notices of
the hearing were properly published in the Salem EvFRYr*News .igka &��dance with
Massachusetts General Law Chapter 40A.
Petitioner is requesting a Variance to convert a mixed residential/store building
into six residential units and a Variance from minimum parking in this R-2 zone.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship, financial or otherwise, to petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after hearing the evidence presented at the hearing and after
viewing the plans, makes the following findings of fact:
1 . The plan as submitted will be more in harmony with the area
than the present use;
2. Support for the plan was voiced by interested and concerned
residents and others;
3. The building was vacant when petitioner purchased the property.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . The property in question is unique to the area;
2. The desired variances may be granted without substantial
detriment to the public good;
3. A hardship does exist not only to the petitioner but to the
neighborhood in general.

Therefore, the Zoning Board of Appeal voted unanimously, 4-0, in favor of granting
the Variance to convert a mixed residential/store building into six residential
units subject to the following conditions:
1 . That five (5) units be two bedrooms and the unit, described
as being the store front be converted to a one bedroom unit;
2. A Certificate of Occupancy be obtained.
The Board of Appeal also voted unanimously, 4-0, to grant the Variance from
minimum parking subject to the following conditions:
1 . A minimum of five (5) unobstructed parking spaces must be
be maintained and the spaces must be delineated and set aside
as such.

Hearing
ERVICfi.Hearing on this petition was held on May 25, 1976. Present were Chairman John M.
Gray, Sr. , Donald Eames, Arthur LaBrecque, William Abbott and Jane Lundregan.
Notices were duly mailed to abutters and others in accordance with Massachusetts
General Laws, Chapter 808.
Mr. Palardy, one of the petitioners, represented the petitioners before the Board.
The building in the past has been used as a variety store. The petitioners wish
to change said non-conforming use from a variety store to a catering service. The
petitioners have leased the store and obtained a catering license nct knowing that
the location was not zoned for business. The petitioner stated that they will be
operating strictly as a catering of sandwiches operation. There will be no retail
sales and no cooking on the premises. He said there will be a minimal number of
deliveries and they will all be scheduled on the same day of the week and will be
made in the driveway in the rear of the store. The petitioners further stated
that they do not have to cook on the premises, and they do not have insurance to
cover such an operation.
Mr. Stanley Backoritis who has owned property at 3 Mt. Vernon St. since the 1940's
appeared in opposition. He stated Summer Street is one-way and this business
will increase the traffic. He was also concerned with odors.
The Board voted unanimously to grant the petition with the following conditions:
That there be no cooking on the premises, and
There shall be no retail sales from the premises
The petition is granted limiting the operation to a catering business only.

As a result of an inspection this date of the premises , structure ,
open land area or vehicle owned, occupied or otherwise under your
control , the following recommendations are submitted and shall serve
as a notice of violation of fire laws . These recommendations are
made in the interest of fire prevention and to correct conditions
that are or may become dangerous as a fire hazard or are in violation
of law.
You are hereby notified to remedy said violations named below within
Seven Days of above date.
Such further action will be taken as the law requires , for failure
to comply with the above requirements within the stipulated time.
(Reference: General Laws of Commonwealth of Massachusetts , Chapter 148 ,
Section 30 ; and the Salem Fire Code ;Article 1 . )
1. Construction work in the rear stairway, has been left open,
creating a flue for potential fire conditions.
2. Electrical wiring has apparently been water damaged, and an
electrician shall be required to inspect all wiring and report
to the Salem City Electrician the conditions found therein.
3. Excessive combustible materials piled within the rear stairway,
blocking the means of egress. All stirways shall be maintained
free and clear at all times.
4. All apartments shall be provided with an approved primary and
secondary means of egress.. A Certificate of Occupancy shall be
obtained from the Salem Building Inspector.
5. The Ceramic studio which occupies the first floor, appears to
be without approval of the Salem Building Inspector. No commercial
venture is permitted without a Certificate of Occupancy from the
Salem Building Inspector.
6. The basement area shall be cleaned and all combustible materials
removed from this area.
7. Several electrical fixtures need attention and shall be corrected
by a licensed electrician.
8. Approved smoke detectors shall be installed and a Certificate of
Compliance requested. A. C. Electrical Smoke Detectors shall be
required in common stairways and the basement. Battery type units
may be used in apartments, adjacent to each separate sleeping area.
