Mrs. Helen Croteau(former owner of 29 Station Road until September 1999 at which time the property was sold to Katz)emphatically asserts that you do not own the fence and that she had the present fence installed several years ago (long before you purchased 31-33 Station Road in 1999). 2. Mrs. Croteau also declares that after you purchased your property in mid-1999,you told her that the fence was on your property and that you moved the fence to its present location without showing her a survey. 3. In addition,the fenceposts that you claim to own are replacements for the posts that were broken by you when you moved the fence. 4. Mrs. Croteau never gave you the fence or the posts;rather,the fence and the posts were conveyed to Katz when Mrs. Croteau sold her home at 29 Station Road. In view of the foregoing, please note that the fence does not belong to you. I am going to have an instrument survey of my property at 29 Station Road in order to determine the exact location of the boundary between our respective properties. The instrument survey will determine whether the fence is in the correct location or whether it should be moved back to its original placement. Please note that you are welcome to confirm the foregoing with Mrs. Croteau and, further,that you are not to touch the existing fence as it does not belong to you. Please also note that you are certainly within your right to erect a fence along the boundary between our properties as long as said fence is on your property and is six inches away from the boundary line which will be determined by the instrument survey. The orange line that you arbitrarily spray-painted on the ground(and on the drain man-hole cover at the rear of our properties) does not constitute a proper marking of the boundary between our adjacent parcels. 2. In fact,the aforesaid boundary is unmarked. 3. I am going to have an instrument survey of my property at 29 Station Road in order to determine the exact location of the boundary between our respective properties. 4. Upon proper marking of the aforesaid boundary by a surveyor, you will certainly be within your right to erect a fence along the boundary between our properties as long as said fence is on your property and is six inches away from the boundary line which will be determined by the instrument survey. 5.
