H© BURY d0 84 Moffatt Road Salem,MA 01970 December 26, 1997 Planning Board City of Salem 1 Salem Green Salem, MA 01970 Dear Mr. Powers: I am writing to formalize my complaints and concerns about the construction on Station Road by Mr. DiBiase particularly as it pertains to the section abutting my property at 84 Moffatt Road. Mr. DiBiase, in dumping boulders near the wetlands, has made an eyesore in the rear of my property. This has a serious negative impact on the value of my property. In reviewing the approved plans and checking my property against the rip-rap wall, there appears to be a clear violation. The plans call for the rip-rap wall to have a maximum height of 35 meters and to extend to about a third of the length of the back of my property before tapering off. The rip-rap is several meters higher than the approved amount, and it extends the entire length of my backyard as well as in back of the property at 86 Moffatt Road. I have other concerns: • Changing the contour of the land will have an impact on drainage. • The boulders pose an extreme danger to small children who live in the immediate area. • The cavities between the boulders will become a breeding ground for rats. • The boulders encroach on the wetlands. The Clerk of the Works, Will Beaulieu, has agreed the boulders are unsightly; and Mr. DiBiase has promised to do something to make the area more attractive in the spring. Mr. Beaulieu has also said that if he knew what Mr. DiBiase was going to do he would not have allowed it. This is little consolation to me when my property has been devalued. Mr. Beaulieu did not address the fact that there is a blatant violation of the approved plans. I fail to understand why this problem cannot be corrected immediately, and I fear that as the construction continues that this problem will be harder to correct. I think the city of Salem needs to take a stand and be responsible for Mr. DiBiase's actions. On May 15, 1997, the Planning Board closed the public hearing and by a vote of eight(8) in favor, none opposed, voted to approve the subdivision plan subject to the following conditions: 1. Conformance with Plan Work shall conform to set of plans containing sheets 1 through 4, entitled, "Definitive Subdivision Plan, Station Road Extension, Salem, MA", prepared by Parsons and Faia, Inc., 60 Lewis Street, Lynn, MA, dated March 11, 1996, revised March 5, 1997, revised May 2, 1997, and a plan entitled, "Drainage Plan, Salem, MA", prepared by Parsons and Faia, dated October 30, 1996. 2. Utilities A. Utility installation shall be reviewed and approved by the City Engineer. B. All utilities shall be installed underground. C. The treatment of the inlet at the Conservation area shall be reviewed and approved by the City Engineer. 3. Board of Health All requirements of the Board of Health approval stated in a letter dated March 20, 1997 shall be strictly adhered to. 4. Conservation Commission All requirements of the Order of Conditions issued by the Salem Conservation Commission shall be strictly adhered to. 5. Fire Department The Applicant shall comply with all requirements of the Salem Fire Department. 6. Building Ildi lgInspector The Applicant shall comply with all requirements of the City of Salem Building Inspector. 7. tr t .fight_hting Street lighting installation shall be reviewed and approved by the City Electrician and Massachusetts Electric. The street lighting shall be the responsibility of the Applicant until such time as the City accepts the street. 8. Landscaping A. Deciduous trees shall be a minimum of 31/2" caliper, planted 50 feet on center in planting strips. The City's Landscape Architect shall determine the appropriate type of trees to be planted and shall approve the Applicant's selection of trees prior to planting. B.The Applicant shall install sloped granite curbing,planting strips and sidewalks, as shown on the approved plans. C.The Applicant shall guarantee the deciduous trees for a period of one year from installation. D. The Applicant shall install permanent fencing along top of ledge cut behind lots 5, 6 and 7, for a length of approximately 250 l.f. The fencing shall include galvanized posts. A detail of the proposed fencing shall be submitted to the City Planner for his review and approval. 9. Security The Applicant shall file a Bond, Covenant,TriParty Agreement or Pass Book with the Planning Board as the means to secure the completion of the roadway and associated improvements. The Board will not release the plans until such time that the Board receives the method of security. 10. Construction Practices All construction shall be carried out in accordance with the following conditions: A. No work shall commence before 8:00 A.M. on weekdays and Saturdays. No work shall continue beyond 5:00 P.M. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. B. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. C. Drilling and blasting shall be limited to Monday-Friday between 8:00 A.M. and 5:00 P.M. There shall be no drilling or blasting on Saturday, Sundays or holidays. D. All construction shall be carried out in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. E. The Applicant shall conduct street sweeping on Station Road, as deemed necessary by the City Planner. 11. As-Built Plans As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and Engineering Department. 12 Clerk of Works The City's Clerk of Works shall be on site during construction, as deemed necessary by the City Planner. The cost for this service shall be borne by the Applicant, his successors or assigns. 13. Violations Violation of any condition contained within this Decision may result in revocation of this permit by the Planning Board. This endorsement shall not take effect until a copy of the decision bearing certification of the City Clerk that twenty(20) days have elapsed and no appeal has been filed or that is such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record or is recorded on the owner's Certificate of Title. The fee for recording or registering shall be paid by the owner or applicant.
