A site visit, with you, on Tuesday January 7, 2013 confirmed that a chain-link enclosure with a framed wooden roof, measuring approximately 10'wide X 20' long X 5'High, has been erected on your property in violation of both the Commonwealth of Mass Building Code and the City of Salem Zoning Ordinance. The Building Department has determined that this `dog kennel' is an Accessory Structure, and that it is located less than five feet from the property line. O A permit is required to erect any Accessory Structure with a floor area that exceeds 120 square feet. [2009 IBC Section 105] ... There was no permit applied for or issued for the structure in question. O An Accessory Structure must be located at least 5'-0" from any Lot Line.
