Mr. & Ms.Konis,
Our office received a complaint regarding your property located at 5 Station Road. A
preliminary investigation on Tuesday, December 10, 2013 indicates that your property may be
in violation of both the Building Department and the City of Salem Zoning Ordinance.
1. This Department has no record of a required building permit for the shed located at the
back of your property.
2. The shed also appears to be in conflict with City of Salem zoning setbacks.
You are directed by this letter to file the appropriate applications for permit in our office at 120
Washington Street, 3 d Floor at the earliest possible time.
Failure to secure any and all permits and approvals shall result in Municipal Code tickets and
further enforcement actions.

Mr. Gentry,
Our office received a complaint regarding a"shed" on your property located at 5 Station Road.
A site visit, with you, on Tuesday January 7, 2013 confirmed that a chain-link enclosure with a
framed wooden roof, measuring approximately 10'wide X 20' long X 5'High, has been erected
on your property in violation of both the Commonwealth of Mass Building Code and the City of
Salem Zoning Ordinance.
The Building Department has determined that this `dog kennel' is an Accessory Structure, and
that it is located less than five feet from the property line.
O A permit is required to erect any Accessory Structure with a floor area that exceeds
120 square feet. [2009 IBC Section 105] ... There was no permit applied for or issued
for the structure in question.
O An Accessory Structure must be located at least 5'-0" from any Lot Line.
[City of Salem Zoning Ordinance Section 3.2.4.3.1 ... The structure in question is
located closer than S'from a property line.
O An Accessory Structure must not exceed 120 Square Feet of floor area, or 1% of the
total lot area, whichever is greater. [City of Salem Zoning Ordinance Section 3.2.4.3.]
... The structure in question is greater than 120 square feet in floor area and greater
than I%of the total lot area.
O Additionally, an Accessory Structure must be located at least 10"-0" from any other
building. [City of Salem Zoning Ordinance Section 3.2.4.3.]
