Dear Mr. Hewitt:
The Salem Planning Board voted on Thursday, November 17, 1994, to approve the
proposed subdivision plan entitled "Definitive Subdivision Plan - Calumet Street, Salem, MA,"
sheets 1-5, dated August 9, 1993, revised through November 21, 1994, subject to the following
conditions:
1. CONFORMANCE WITH PLAN
Work shall conform to plan entitled "Definitive Subdivision Plan - Calumet Street, Salem,
MA, Sheets 1-5, dated August 9, 1993, revised through November 21, 1994.
2. UTILITIES
a. Utility installation shall be reviewed and approved by the City-Engineer.
b. A site inspection shall be conducted by the Engineering Department and the applicant
to review the drainage system.
c. Documentation shall be provided to the Engineering Department and the Planning
Board stating that the installed drainage system is functioning properly prior to the
issuance of a Certificate of Occupancy.
d. The City Engineer shall determine when construction commences whether a
perforated pipe is necessary to pick up subsurface water within the swale
area adjacent to lots A & B.
3. BOARD OF HEALTH
Board of Health requirements set forth in a letter dated January 14, 1994 shall be strictly
adhered to.
4. CONSERVATION COMMISSION
The Conservation Commission's Order of Conditions - DEP File # 64-225 dated
November 10, 1994 shall be adhered to.
5. CLERK OF THE WORKS
A Clerk of the Works shall be provided at the expense of the developer as is deemed
necessary by the City Planner.
6. COVENANT
A Covenant shall be filed with the Planning Board prior to the release of the plan to
secure any lot before such lot may be built upon or conveyed, other than by mortgage
deed.
7. DEED RESTRICTION
The developer shall include in each deed a clause which states that the proposed
swale will be the responsibility of each property owner to keep open and clear of
obstruction.
8. LANDSCAPING
a. Trees shall be a minimum of 3 1/2" caliper, planted 30 feet on center.
b. Grass strips shall be five (5) feet in width.
c. Trees shall be the responsibility of the developer, his successors or assigns in
accordance with the City of Salem Subdivision Regulations Right of Way
Improvement Policy.
9. STREET LIGHTING
Street lighting installation shall be reviewed and approved by the City Electrician and
Massachusetts Electric. The street lighting shall be the responsibility of the developer
until such time as the City accepts the street.
10. CONSTRUCTION PRACTICES
All construction shall be carried out in accordance with the following conditions:
a. No work shall commence before 8:00 a.m. on weekdays and Saturdays. No work
shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or
holidays. Inside work of a quiet nature may be permitted at other times.
b. All reasonable action shall be taken to minimize the negative effects of
construction on abutters. Advance notice shall be provided to all abutters in
writing at least 72 hours prior to commencement of construction.
c. Drilling and blasting shall be limited to Monday-Friday between 8:00 a.m. and
5:00 p.m. There shall be no drilling or blasting on Saturdays, Sundays or
holidays.
d. All construction vehicles shall be cleaned prior to leaving the site so that they
do not leave dirt and/or debris on roadways as they leave the site.
e. All construction shall be carried out in accordance with Rules and Regulations of the
Planning Board.
11. AS-BUILT PLANS
As-built plans, stamped by a Registered Professional Engineer or Land Surveyor,
shall be submitted to the Planning Department and Engineering Department prior
to issuance of a Certificate of Occupancy.
12. VIOLATIONS
Violations of any conditions shall result in revocation of this permit by the
Planning Board.
This endorsement shall not take effect until a copy of the decision bearing certification of
the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such
appeal has been filed and it has been dismissed or denied, is recorded in the Essex County
Registry of Deeds and is indexed in the grantor index under the name of the owner of record or
is recorded and noted ont he owner's certificate of title. The fee for recording or registering
shall be paid by owner or applicant.
I hereby certify that a copy of this decision and plans are on file with the City Clerk and
a copy is on file with the Planning Board.
