This office has no legal rights to ask to have the barbed wire removed, but is making a request for its concerned citizen and abutters that the wire no longer serves a purpose and would enhance the esthetics in the area if nothing else. Sir: As a result of a conference held this date at the Construction Site, 50 St. Peter Street, Salem, Mass. ; the following items were discussed and should be resolved as noted. 1. Application for plan approval (Form #81) should be submitted by the County Engineer as the initiater of the project. The $5. 00 fee will be waived if submitted by a County representative. 2. The site plan was reviewed and the access for emergency vehicles was discussed. It appears that the first two parking spaces will have to be eliminated to provide sufficient access to the premises for emergency vehicles. Sherriff Reardon and Diaster Warren Buthane will handle this item as an in-house matter. It should however be noted that parking spaces should be painted out, to assure this area is available 'or access purposes. . 3. It .was discussed that certain detection units for fire alarm have proven to be a source of needless alarms. These units listed as follows should be adjusted as noted : a. Smoke detector located on second level Chapel Area, on 'the ceiling, and available to vandalism action from the stairrail should. be moved to a wall location away from the stair rail. This is to keep persons from initiating the detector by blowing smoke into the unit from the stair area. b. The smoke detector situated in the stairway, just off the kitchen, (which leads to the domestic area) , will require an approved stairway door, with self closing device attached ; to prevent the steam and other odors from, the kitchen reaching the device and initiating the alarm. This stairway should have and appears to be provided for in the plans, an approved fire door at the top, of the stairs. 4. As a result of the inspection conducted with Fire Chief James F. Brennan, and discussed this date, the standpipe system should be provided with eight new gate valves; (one at each level and on each standpipe riser) , to comply with the regulation that not over one hundred feet of hose will be needed to reach any area served by said standpipe system. It has been agreed upon by Acting Chief Robert Crowley and myself that the following conditions, in reference to the standpipe system will be acceptable, so as not to create a hardship on the County at this time. a. Only the valves situated outside the second levels, on bothends, will be required to have fire hose permanantly attachede and properly racked. b. No increase in riser size will be required at this date. c. All valves shall be provided with 1.1" iron pipe thread, which will accept Salem Fire Department 12" fire hose. d. Flow switch will be required on the fire standpipe supply valve which is connected to the fire alarm system. 6. The proposed alterations to the kitchen hood and duct system should be brought up to code compliance at this time, however it will remain the jurisdiction of the Building Inspector to determine the - need for compliance with the intent of the code at this time. owever, plans for the Fixed fire extinguis er system, an the testing of same shall be mandatory, under provisions of 527CMR10. 02( 1)4 and Salem Fire Prevention Regulation # 29B. Plans should be submitted with Form #81 by the Fixed Fire Extinguishing Technician. 7. The welder on the project has obtained a permit and his operations appear to meet the code requirements, subject to inspections by this office. 8. With reference to the flammable storave our records indicate the followings a. Apparently no permits have ever been issued for the two fuel oil burners, now in the boiler room. These units also are in an advanced state of fatigue. b. Without a permit the existing storage of fuel oil is actually illegal. You should have your oil burner technician take out permits for these units and the storage of fuel oil. c. The proposed installation of a new 1, 000 gallon tank, if for fuel oil would also require a permit, with plan submitted for approval. I understand that you have a code requirement for this assembly of STC-45. I have not verified this with the state or local codes. Dining Room I understand that this ceiling system,as installed,consists of steel framing suspended by wire from the joists with a two layers of 5/8"GWB (blueboard) installed,separated from each other by a two-legged furring channel. A skim coat of plaster is applied to the bottom layer. The plenum contains fiberglass insulation. The original installation left exposed structure around the perimeter in order not to obscure the windows. I understand that since my site visit,a ceiling system has been installed around the perimeter,consisting of a wire-hung frame with two layers of 5/8" GWB. These layers are laminated together without any furring. The wires in this section include Mason WHR isolators. The furring in the original assembly was substituted for RC-1 resilient channel. The specified GWB-RC-GWB sandwich is a poor application of resilient channel,and actually provides a lower level of isolation than two layers of GWB directly laminated together. The perimeter was well sealed with caulking. For the purpose of estimating the ceiling sound transmission class (STC),I have assumed only one layer of 5/8"GWB,as the combination of the airspace and second layer is generally considered to negate the value of the second layer's mass. The National Research Council Canada tested an assembly similar to these,which achieved STC-54 (NRCC Test ID: TLF-96-089a). The isolated perimeter section likely exceeds STC-55`Combined,I expect that this assembly would achieve a similar level of isolation. The only potential compromise in this assembly is that the vertical faces bridging the two ceiling heights are supported by rigid steel framing that attaches to the joists above. While I expect that the assembly installed meets the code requirement,field testing would be required to verify this. Kitchen I understand that the majority of the kitchen ceiling assembly is identical to that used in the dining room. However,the area above and behind the exhaust hoods has been treated differently. I understand that,at the suggestion of the building's architect,the underside of the deck and joists in this area were painted with 2-hour fire paint,the cavity filled with fiberglass batts,and the plenum sealed as well as possible with 2 layers of 5/8" GWB. Given the complexity of this ceiling and the rigid attachment of both the drywall and ductwork to the structure,the only way to evaluate the sound transmission would be field-testing. The developer shall employ a licensed pesticide applicator to exterminate the area prior to construction, demolition, and/or blasting and shall send a copy of the exterminator's invoice to the Health Agent. h. The Owner shall maintain the area free from rodents throughout construction. i. The developer shall submit to the Health Agent a written plan for dust control and street sweeping which will occur during construction. j. The developer shall inspect these lines to make sure they are in good working order, have no lead components, and can provide sufficient pressure and flow for the development, and shall submit to the City Engineer a report verifying the above, in writing, prior to the issuance of a Building Permit. e. The proposed water line for both domestic and fire protection for buildings B, C, & D is a 6 inch diameter line coming from the City's 10 inch diameter pipe in St. Peter's Street. Based on the importance of this pipe to the development, the developer shall install a 10" x 6" x 10" tee with a three gate valve system rather than the tap and sleeve with one gate valve that is proposed. Revised plans showing this amendment shall be submitted to the City Engineer for review and approval prior to the issuance of a Building Permit. f The applicant shall submit drainage calculations to the City Engineer for review and approval prior to the issuance of a Building Permit. g. The applicant shall submit details of the intersection of the north entrance to the site and the proposed connector driveway that Mass Highway will be constructing from Bridge Street to the site, and how the utilities and drainage at this location shall connect with the driveway, prior to the issuance of a Building Permit. It is understood that the applicant will make every effort feasible to complete these improvements prior to MassHighway's work beginning at this location. 11. Department of Public Services The applicant, his successors or assigns shall comply with all requirements of the Department of Public Services 12. Affordable Housing Unit/Artist Live/Work Space a. As agreed by the developer, the Artist Live/Work dwelling is designated as an affordable housing unit. b. The Applicant shall adopt and incorporate an Affordable Housing Restriction in the form of a deed rider registered with the Essex South Registry of Deeds, as approved by the City of Salem Department of Planning and Community Development and in accordance with the eligibility criteria for the Commonwealth Department of Housing and Community Development's Subsidized Housing Inventory, and will ensure that this one (1) dwelling unit of the project will be restricted as affordable housing for households whose annual incomes are eighty percent (80%) or less of median income for the Area ("Low Income Households") with a sales price affordable to Low Income Households for ninety(90) years from the date of the original conveyance of this unit. c. Still no application for approval has been filed. Knowing this project was to begin, Chief James F. Brennan and myself, did make a survey of the premisesoon Monday May 19, 1980; where it was found that several items will be required to permit this office to approve the project. We were never invited to any meetings by the architect, nor the County Engineers office; to establish a repore with them, nor to stipulate the needs for code compliance as of this date. As you are aware of, the Salem Fire Department has the duty to approve items listed in Article 12 of the Mass. State Building Code, prior to issuance of a Building permit. Several items, such as additional standpipe connections with gate valves, relocation of some fire alarm devices, better access for firefighting apparatus and some othe minor items;. are lacking at this occupancy. Under provisions of Section 113 . 5 of the Mass. Following are some of my thoughts on the buildings . I agree with your assessment that the seriously damaged shop and the two additions on the front of the barn should be removed . Although the kitchen addition could be salvaged , other .considera- tions could dictate its removal, at no serious detriment to the jail complex as a whole . As you stated , the second floor joists of the barn are unsafe for use at this time ; you observed that their unsafe condition is not due to the fire , but that you would have considered them unsafe before the fire because of their size . This condition could be remedied quickly and cheaply by the installation of small beams at the midspan of the joists . This , along with the securing of the building with plywood sheathing and temporary patching of the roof would eliminate the unsafe conditions and protect the building until it could be repaired. Mr. Wolfson said he would be checking with the Massachusetts Historical Commission in an effort to determine if matching funds are available for this emergency work. Although it would be slightly more expensive to demolish the damaged structures and retain the barn than to demolish all the buildings including the barn, that slight extra cost is small in comparison to the replacement cost of the barn, especially con- sidering the fact that the barn could be repaired for a fraction of its replacement cost. The kitchen addition could be sacrificed to accomodate the demolition of the old shop in the rear, if necessary. Besides costs , reusing the existing barn would eliminate zoning Page 2 Sheriff's House September 17. 1980 problems that would be encountered with new construction. For instance , new construction would have to be located at least 30 feet from the rear line , unless a variance were obtained. Pre- sently, the building is on the line . The historical significance of the barn, or carriage house , was best expressed by Essex County Planner Thomas J. O'Leary, Jr. who stated the following in a memorandum written shortly after the fire : "It should be noted that in the opinion of Bryant Tolles , Director of the Essex Institute . . .that the historical and architectural value is not in any one of the three buildings at the Salem Jail Complex ( jail, jailkeeper's house , and carriage house ) ; the significance comes out in the fact that it is a rare surviving example of an early 'penal in- stitution with related buildings ' . There is nothing com- parable in NA ssachusetts and because of its rarity is significant at the national scale. " Mr. O'Leary goes on to say that national historians of penal in- stitutions place high value on this complex. In summary, the consensus of the Historical Commission was that the barn was important and should be reused. The present method of transmitting an alarm of fire should be replaced with an automatic type of fire alarm system. The use of internal manual pull stations connected to a master fire alarm box or private protection service should be installed. Said internal manual stations should be limited to areas where inmates will not have direct access to same. The number and location of same should be approved by this office as per our current regulations. One or two stations should prove sufficient for this occupancy. 2. It was found that the one hundred feet of hose from the stand- pipe used for the fire on this date was short for reaching the entire third floor area. - It was found that the threads used on the standpipe hose are not computable with our threads used in the Salem Fire Dept, It is therefore recommended that the standpipe riser be extended to a point at the third floor level with a gate valve placed thele for the standpipe hose. It is further recommended that all present gate valves and stand- pipe hose be changed to iron pipe thread used by the Salem Fire Dept. to enable our furthur extension of said lines and the use of the system with our double jacketed fire department hose. The hose purchased to use with the standpipe system should also be equipped with plastic shut off nozzles to enable the operator to control the amount of water used, at the fire scene. It is furthur recommended that an exterior fire department connection be placed in an approved accessible point for fire department use. It was reported that the pressure on the hose used was extremely weak. . It is furthur recommended that an extra fifty feet of 1j" hose be placed at each standpipe outlet to enable the hose to reach all areas to be protected. This will make a total of 150' at each hose rack. y Report of Salem House of Correction, Feb. 10, 19959 Continued. It is further recommended that an additional 2�" fire department standpipe gate valve be made available for use of heavy duty 2j" fire department hose in the event it becomes necessary to use same. This valve should be located at the first floor level and must be supplied with proper sized supply piping, and also fed by the above mentioned fire department exterior connection. 3. It is further recommended that all storage areas be completely en- closed rooms, with a fire rated wall and ceiling and a self closing locked door. 4. It is further recommended that a fire drill plan be established and all institution personnel be drilled in same at frequent internals. 5• A drill by pass switch may be advisable for use in the above drills. The cooperation of all personnel during this emergency has been ex- cellent. It appears from investigation that two seperate fires were started, in two seperate cells. These cells were used for storage of items of inmate clothing and mattresses. The third floor area is set up for the detention of female prisoners. Seven female occupants and one Matron were on the floor at the time of the fire. Matron on duty at time was Ms. Marjorie Rankin. It appears that one or more female prisoners used the incident to stir up problems for the matron, as the Matron was apparently pushed around and pushed into a room in an attempt to lock her in. All prisoners and the matron were eventually evacuated by other guards. Engine Co. #1 upon arrival stretched the standpipe hose available on the second level, into the third floor cell area. Ladder Co. #2 raised the aerial ladder to the exterior third floor windows for ventilation purposes and Engine Co. #6 booster line was advanced to the top and used from the aerial. As you may be aware, we have had some problems with individuals breaking into the property, and members of the Salem Police Department have been called out to investigate the incidents. I spoke with Captain Blake of the Salem Police Department yesterday and Mayor Harrington this morning, and they agreed that the removal of the fence would not be in the best interest of safety at this time. A new locking system and new toilet facilities are being installed. There is an illegal visiting area which is not accessible to the handicapped., The Board recommended that a wheelchair lift could be installed to provide access to it, however '• the petitioners were hesi- tant about installing one in case of future alterations . The Board noted that it can be easily moved and would be no problem. The petitioners stated that the problem with a lift would be the amount of money involved. Estimated cost of work is $918 ,000, which the Board assumes is 25% of the equalized assessed value . of the building. New stairways are being built on each side of the building so that prisoners can be moved quickly in case of fire. Electronic door locks are going to be installed so that all doors can be unlocked at the same time. No renovation work is being done to the bathrooms, .but a handicapped bathroom is being built. The contents are not to be misconstrued to mean other than the original intent. Its purpose is simply to allow for the safe, orderly, and secure evacuation of the staff, civilians and inmates from the facility. At any time it becomes necessary to deviate from this procedure a full written report will be filed by the officer in charge,with the Sheriff as soon after the incident has been closed, as soon as possible but no later than the end of the shift. After each incident a debriefing will be held for the purpose of evaluating the procedure. :. Every ,six months from the date. of implication this procedure will be reviewed for the purpose of update. Any and all changes are subject to the approval.-of Sheriff Charles Reardon. r DECISION TO EVACUATE The decision to evacuate will be governed by any situation that has become or is likely to become life threatening. The decision to evacuate will be made by the highest ranking member of the department in the facility at the time of the incident. The ranking will be determined by the facilities chain of command as shown below: A: Sheriff B: Deputy Superintendent C: Assistant Deputy Superintendent D: Senior Correctional Officer E: Correctional Officer All decisions and orders will come from this ranking staff member who will confer with the ranking members of the Salem Police and Fire Department. *In the event that there is no ranking staff member present and an officer has not been designated as in charge, the rank of authority will be determined P by seniority. If the fire is discovered by visual contact"the officer making the discovery is to notify control . Control will trip the call box or notify Salem Fire by phone. (744-1234) Please note that there are pull boxes located on the guardroom floor, at the front door, and in the control room. When the Simplex System is activated it will set off the systems siren. This siren indicates only that the system is: signaling a fire not an evacuation decision. ' The decision to evacuate will be announced over the Simplex's public address system. If it has been decided to evacuate, the 'Salem Police Department will be notified by the facilities Bapren hookup. A cruiser will be requested to cover the Bridge Street and St. Peter Street y sides of the facility. NOTE: It is the responsibility of the officer in charge to make the necessary arrangements for resetting the Simplex System when it has been activated on his shift. ` EVACUATION PROCEDURE . Cell Blocks: Each tier will evacuate through the marked exits for their section. . It is important to note that it may not be necessary to evacuate the entire facility. The determination of which section is to be evacuated will depend on the situation- considering the location of the problem and the intensity of the smoke. (Remember smoke is the major concern in a fire situation. ) The evacuation routes will be determined for each section by the location of the incident. Example: It may be necessary to evacuate one half a tier out the new r egress and the other half out through the passage way to the other side of the facility. If at all possible after each section has been evacuated an officer will be assigned to do a cell by cell check to make sure the section has been cleared. In intense smoke scott air paks will be used. When doing so they will be used in pairs only. EVACUATION PROCEDURE-CONTINUED Each tier will evacuate through the marked exits as directed by. the officer in charge. This will be done in a single file fashion. The new section will be used as follows: 3rd tier: Each side down the right side of stairs. 2nd tier: Each side down the center of stairs. lst tier: Each side down the left side of stairs. Flats: Each side will follow the 1st tier out on the left side. NOTE: 3rd tier is designated as that only, not P.C. or trustee section. NOTE: During fire drills P.C. inmates will evacuate into the cage area. During the entire process, officers will position themselves so as to 'provide a safe, secure, orderly evacuation. Radios are to be used during this entire procedure by all officers involved for the purpose of keeping control informed of the situation. DINING ROOM: Should it be necessary to evacuate while inmates are in the dining room they will do so by the 2nd tier fire exit door. If that route can not be used exits will be through the play yard gate. LIBRARY AND CAGE: Inmates in this area must evacuate by entering into the cell block through the nearest gate and proceed to the nearest exit. KITCHEN, LAUNDRY & MACHINE SHOP: Evacuation from these areas will be through the kitchen gate to the delivery area. 'The officer supervising this evacuation will also open the Bridge Street gate to allow the fire department to enter. GUARD ROOM: This will. be the last area to evacuate. It will remain manned as long as Wpossible by a minimum number of officers who will have in their possession the front door keys. &sex (oo-'-"Z�o J/een-'O ��ee 's EVACUATION PROCEDURE - CONTINUED Niw If evacuation is necessary it will be through the front door. If smoke becomes intense place smoke ejectors in appropriate position. CONTROL ROOM: This area will remain manned as long as possible by only, as many men as needed. Should smoke become intense a smoke ejector can be placed in the air conditioner hole. DEFEND IN PLACE: As soon as a fire has been detected all available fire fighting equipment will be put into use by as many people as can be freed from the evacuation process. Inmates who volunteer to assist will be allowed to. ENTRANCE OF FIRE DEPARTMENT: Officers will be assigned to necessary doors to > allow fire department to enter. Front and back gates will be opened. HEAD COUNTS: When the emergency has ended officers will be ordered to take standing head counts and compare them with control room boards. When inmates are returned to the facility I.D. will be made by picture comparison, and inmates placed in their assigned cells. When all inmates are back in their cells a regular cell to cell count will be made. EMERGENCY & TEMPORARY SECURITY: If it is determined that inmates can not be returned to the facility they will be secured with plastic cuffs, arms interlocked in strings of 20. When this has been completed Michaud Bus Lines of Salem (phone# 745-1000) will be notified to provide buses to either use or hold inmate. EVACUATION PROCEDURE-CONTINUED EMERGENCY & TEMPORARY SECURITY:-continued If they are to be moved the location has been set at the Correctional Alternative Center. The proper authorities must be notified, and transportation security arranged. t KEY CONTROL: All exit keys (doors & plug )will be carried by an officer at all times. If they must leave their post they will turn their keys over to an officer. Back up exit keys will be located in the safe. If there are locks that have keys that can not be easily located use the bolt cutters in the safe. CALL BACK OF OFF DUTY OFFICERS: All off duty personnel will be called back to assist to duty as soon as possible. They must report in uniform to the front driveway of St. Peter Street for assignment. The Dog Officer will also be contacted and requested to report. These officers will notify the officer in charge that they are here and await assignments. OUTSIDE EMERGENCY EXITS: All outside doors used for emergency exits will be checked monthly during summer months and daily during winter months to insure safe operation. During adverse weather they will be checked as often as needed and kept clear of any substances that may retard their operation. COMMUNICATIONS: Control center will be kept informed by line staff of all situations via radio. At least one officer in each area of the facility will be equipped with a radio. The amendment encompasses minor modifications to the original proposal, including a slight expansion of the new building, called The Alexander, as well as a restructuring of the internal layout of the Jail Building, called The Bryant. Design Modifications NBV is proposing a slight expansion of the footprint of The Alexander by designing a wing to complement the original design. The proposed wing would front along St. Peter Street, forming an "L" shaped structure. The new building configuration will create five additional units in this building and, most importantly, allow the units to be reconfigured as "flats" as opposed to the original design of duplex over duplex. This modification is in direct response to market demand. The front facade design of The Alexander will not change from the originally approved scheme. Specifically, the fenestration, roof line and cornice will all remain the same as will all design details and materials. The proposed wing along St. Peter Street will also conform in design and materials to the original approved design. In particular, the roof dormer configuration and the unique chimney-like lanterns will be continued along the St. Peter Street wing to unify the design. The proposed wing will create a strong facade along St. Peter Street similar to many of the historic structures in Salem. The parking will be modified so that vehicles entering and parking will pass through an archway which will be part of the new facade. Parking will exist at a 1:1 parking to unit ratio. The proposed wing will serve to shield the parking from view along St. Peter, which is generally considered an improvement over the previously approved layout. Additionally, NBV proposes to reconfigure the space within The Bryant to create two additional units by combining the upper floors of four two-bedroom duplex units into two stand alone units. This change will not require that an addition be constructed onto The Bryant. Rather, NBV is simply reducing the size of four larger two-bedroom units and creating two additional units within the existing space. Overall, the development will expand from 29 to 36 units including: 22 units in The Bryant, three units in The McIntire, one unit in The Carriage House, and 13 units in The Alexander. k Historic Tax Credits NBV intends to apply for Federal and State historic tax credits. Federal and State historic tax credits each yield up to 20% of the development costs on the qualifying historic buildings on site. The two buildings that qualify are The Bryant and the Jailkeeper's House, The McIntire. The Alexander and The Carriage House do not qualify for historic tax credits as they will both be newly constructed. Under this scenario, NBV must rent the units in the buildings for which it receives historic tax credits for five years. NBV would begin marketing the 14 units in the new buildings for sale as condominiums immediately upon commencement of construction. NBV would hold and rent 22 units (19 in The Bryant and 3 in The McIntire) for a period of 5 years. At the end of 5 years, NBV would renovate and sell the 22 rental units as condominiums. Summary NBV respectfully requests that the Salem Planning Board approve the proposed modifications to the redevelopment of the Old Salem Jail as described above. NBV feels strongly that the modifications as outlined above will permit the redevelopment of the Old Salem Jail to move forward expeditiously and thanks the Salem Planning Board for its consideration. L CITY OF SALEM PLANNING BOARD Site Plan Review/Planned Unit Development Decision 50 St. Peter Street December 12, 2006 Old Salem .fail Ventures, LLC C/o Joseph Correnti, Esq. 63 Federal Street Salem, MA 01970 RE: 50 St. Peter Street/Old Salem Jail Site Site Plan Review/Planned Unit Development On Thursday, September 21, 2006, the Planning Board of the City of Salem opened a Public Hearing under Sections 7-15 and 7-18 of the City of Salem Zoning Ordinance, Planned Unit. Development Special Permit and Site Plan Review, at the request of Old Salem Jail Ventures, LLC, for the property located at 50 St. Peter Street. The proposed project includes renovation of the former jail,jail-keeper's house and barn, and new construction of a residential building. There will be a total of twenty-nine (29) new condominium units with an approximately 3,200 sq. ft. restaurant. There will be 35 on-site parking spaces. The proposed four-building development will feature a mixture of housing, a jail exhibit, a live/work artist space, and a restaurant. The Public Hearing was continued to October 19, 2006, November 2, 2006, November 16, 2006 and December 7, 2006 and closed on December 7, 2006. The Planning Board hereby finds that the proposed project meets the provisions of the City of Salem Zoning Ordinance, sec. 7-15 (g), as follows: 1) The proposed planned unit development is in harmony with the purpose and intent of this ordinance and the master plan of the City of Salem and it will promote the purpose of this section by adding vitality to the downtown, converting vacant structures to housing and commercial uses thereby generating tax revenue, and by meeting the historic preservation goals of the city. 2) The mixture of uses in the planned unit development is determined to be sufficiently advantageous to render it appropriate to depart from the normal requirements of the district. At a regularly scheduled meeting of the Planning Board held on December 7, 2006, the Planning Board voted by a vote of nine (9) in favor (Power, Moustakis, Collins, Kavanagh, Hanscom, Puleo, Lombardini, Sullivan, Ready), and none (0) opposed to approve the Site Plan Review and Planned Unit Development Special Permits subject to the following conditions: L Conformance with the Plan Work shall conform to the plans entitled, "Additions and Adaptive Reuse of the Historic Salem Jail Complex Planned Unit Development, Salem, Massachusetts" Sheets Cl-C4, L-1, A1.01, 2.01-2.09, and E0.5, prepared by Finegold, Alexander & Associates, 77 North Washington Street, Boston, MA 02114, dated August 15, 2006. Revised Plans reflecting all conditions and incorporating by reference this decision must be submitted and approved by the City Planner prior to the issuance of a building permit. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Exterior construction work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. Any interior work conducted during these times will not involve heavy machinery which could generate disturbing noises. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. 2 e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. F. All construction vehicles left ovemight at the site, must be located completely on the site. g. A Construction Management Plan and Construction Schedule shall be submitted by the applicant prior to the issuance of a building permit. Included in this plan, but not limited to, shall be information regarding how the construction equipment will be stored, a description of the construction staging area and its location in relation to the site, and where the construction employees will park their vehicles. The plan and schedule shall be submitted and approved by the City Planner prior to the issuance of a Building Permit. h. All sidewalks, roadways, utilities, landscaping, etc. damaged during construction shall be replaced or repaired to their pre-construction condition, or better. 4. Clerk of the Works A Clerk of the Works shall be provided by the City, at the expense of the applicant, his successors or assigns, as is deemed necessary by the City Planner. 5. Salem Redevelopment Authority a. All work shall comply with the requirements of the Salem Redevelopment Authority. 6. Timetable for Construction All work shall follow the timeline approved by the SRA in accordance with the Land Disposition Agreement as described on the attachment "Project Timetable- Permitting/Construction", unless the SRA agrees to extend the time period for project completion. 7. Fire Department a. All work shall comply with the requirements of the Salem Fire Department. The locations of all fire hydrants shall be approved by the Fire Department prior to the issuance of a Building Permit b. The developer shall revise the parking plan to show the new location of spaces on the south side of the site in accordance with the requirements of the Salem Fire Department. The revised plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. S. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 9. Board of Health 3 All work shall comply with the Board of Health decision and conditions dated November 14, 2006: a. The individual presenting the plan to the Board of Health must notify the Health Agent of the name, Address, and telephone number of the project (site) manager who will be on the site and directly responsible for the construction of the project. b. If a DEP tracking number is issued for this site under the Massachusetts Contingency Plan, no structure shall be constructed until the Licensed Site Professional responsible for the site meets the DEP standards for the proposed use. c. A radon test is conducted in the basements of the Jail Building and the Jail Keeper's Building while they are in a closed condition. d. The developer will give the Health Agent a copy of the 21 E report if one is generated. e. A lead and asbestos inspection is conducted prior to any demolition or construction. If lead or asbestos is found it is removed by contractors licensed for such removal. f The developer shall adhere to a drainage plan as approved by the City Engineer. g. The developer shall employ a licensed pesticide applicator to exterminate the area prior to construction, demolition, and/or blasting and shall send a copy of the exterminator's invoice to the Health Agent. h. The Owner shall maintain the area free from rodents throughout construction. i. The developer shall submit to the Health Agent a written plan for dust control and street sweeping which will occur during construction. j. The developer shall submit to the Health Agent a written plan for containment and removal of debris, vegetative waste, and unacceptable excavation material generated during demolition and/or construction. k. The Fire Department must approve the plan regarding access for fire fighting. I. Noise levels from the resultant establishment(s) generated by operations, including but not limited to refrigeration and heating, shall not increase the broadband sound level by more than 10 dB(A) above the ambient levels measured at the property line. in. The developer shall disclose in writing to the Health Agent the origin of any fill material needed for the project. n. The resultant establishment shall dispose of all waste materials resulting from its operation in an environmentally sound manner as described to the Board of Health. 4 o. The drainage system for this project must be reviewed and approved by the Northeast Mosquito Control and Wetlands Management District. p. The plans for a food establishment are approved by the Health Agent prior to construction. q. The developer shall notify the Health Agent when the project is complete for final inspection and confirmation that above conditions have been met. 10. Utilities a. Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. The applicant shall have an engineer certify the utility plans for review by the City Engineer, prior to the issuance of a Building Permit. b. All electrical utilities for the site shall be underground. c. The applicant shall clean and inspect by CCTV the existing sewer line(s) and provide the city with an assessment and video record of the inspection, prior to the issuance of a Building Permit. The applicant shall verify that the existing sewer pipe(s) have sufficient capacity to handle the proposed development. d. The applicant has proposed to use the existing domestic and fire protection lines for Building A. The developer shall inspect these lines to make sure they are in good working order, have no lead components, and can provide sufficient pressure and flow for the development, and shall submit to the City Engineer a report verifying the above, in writing, prior to the issuance of a Building Permit. e. The proposed water line for both domestic and fire protection for buildings B, C, & D is a 6 inch diameter line coming from the City's 10 inch diameter pipe in St. Peter's Street. Based on the importance of this pipe to the development, the developer shall install a 10" x 6" x 10" tee with a three gate valve system rather than the tap and sleeve with one gate valve that is proposed. Revised plans showing this amendment shall be submitted to the City Engineer for review and approval prior to the issuance of a Building Permit. f. The applicant shall submit drainage calculations to the City Engineer for review and approval prior to the issuance of a Building Permit. g. The applicant shall submit details of the intersection of the north entrance to the site and the proposed connector driveway that Mass Highway will be constructing from Bridge Street to the site, and how the utilities and drainage at this location shall connect with the driveway, prior to the issuance of a Building Permit. The applicant shall certify, in writing, that these connection(s) shall operate satisfactorily and shall submit this documentation to the City Engineer prior to the issuance of a Building Permit. h. The applicant shall make necessary improvements to correct any deficiencies found in the existing utilities connecting the city's utilities to the site on the Bridge Street side of the 5 project, subject to any required approvals of the City and MassHighway. It is understood that the applicant will make every effort feasible to complete these improvements prior to MassHighway's work beginning at this location. 11. Department of Public Services The applicant, his successors or assigns shall comply with all requirements of the Department of Public Services 12. Affordable Housing Unit/Artist Live/Work Space a. As agreed by the developer, the Artist Live/Work dwelling is designated as an affordable housing unit. b. The Applicant shall adopt and incorporate an Affordable Housing Restriction in the form of a deed rider registered with the Essex South Registry of Deeds, as approved by the City of Salem Department of Planning and Community Development and in accordance with the eligibility criteria for the Commonwealth Department of Housing and Community Development's Subsidized Housing Inventory, and will ensure that this one (1) dwelling unit of the project will be restricted as affordable housing for households whose annual incomes are eighty percent(80%) or less of median income for the Area("Low income Households") with a sales price affordable to Low Income Households for ninety (90) years from the date of the original conveyance of this unit. c. The developer shall prepare a buyer selection plan, for approval by the City Planner, to ensure compliance with affordable housing requirements. The developer is to be responsible for any marketing costs and income verification. 13. Lighting a. No light shall cast a glare onto adjacent parcels or adjacent rights of way. b. A final lighting plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. c. After installation, lighting shall be reviewed and approved by the City Planner, prior to the issuance of a Certificate of Occupancy. 14. HVAC If an HVAC unit is located on the roof or site, it shall be visually screened. The method for screening the unit shall be submitted to the City Planner for review and approval prior to installation. 15. Noise HVAC units shall be sufficiently buffered and the applicant shall take steps to further mitigate noise emanating from the HVAC units(s) if the Board of Health receives any complaints. 6 16. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Trees shall be a minimum diameter of 3 %" dbh (diameter breast height). c. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. d. Any street trees removed as a result of construction shall be replaced. The location of the trees shall be approved by the City Planner prior to replanting. e. Final completed landscaping shall be subject to approval by the City Planner prior to the issuance of a Certificate of Occupancy. f The applicant shall install a four (4) foot black vinyl fence along the property line with the cemetery adjacent to the site to screen the residential patio units along this property line. 17. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. The developer, his successors or assigns shall be responsible for the maintenance and snowplowing of the entrance drive connecting to Bridge Street on the north side of the property, from Bridge Street to the site. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2) year period. 18. As-built Plans As-built Plans, stamped by a Registered Professional Engineer, shall be submitted to the Department of Planning and Community Development and Department of Public Services prior to the issuance of Certificates of Occupancy. The As-Built plans shall be submitted to the City Engineer in electronic file format suitable ..for the City's use and approved by the City Engineer, prior to the issuance of Certificates of Occupancy. A completed tie card, a blank copy (available at the Engineering Department) and a certification signed and stamped by the design engineer, stating that the work was completed in substantial compliance with the design drawing must be submitted to the City Engineer prior to the issuance of Certificates of Occupancy; as well as, any subsequent requirements by the City Engineer. 7 19. Violations Violations of any condition contained herein shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
