50 St. Peter Street (Bit Bar Salem): Discussion and vote on proposed installation of
signage
SRA Decision
At its meeting on May 11, 2016 the SRA voted unanimously(5-0)to approve the
proposed installation of signage at 50 St. Peter Street(Bit Bar Salem) as
recommended by the Design Review Board and subject to the applicant
receiving the required relief by the City's Zoning Board of Appeals for the height
of the proposed signage.
Recommendation
At its meeting on May 10, 2016 the Design Review Board voted unanimously (6-0) to
recommend approval of the installation of signage at 50 St. Peter Street, conditional
upon signs 1 and 2 (as shown in the materials dated May 9, 2016) being lowered
slightly, so that the bottom of each sign be in-line or just above the sills of the second
floor windows, and conditional upon proper relief being granted by the City's Zoning
Board of Appeals.
Staff Comments for May 11, 2016 SRA Meeting
The DRB, during its deliberations, asked that the applicant work with Board Member
Glenn Kennedy on verifying appropriate sizes for signage, as well as potential design
revisions. With respect to size, Board Members felt as though some or all of the signs
were fairly large in scale; with respect to design, the Members expressed concern with
readability.
The enclosed materials are part of the applicant's original packet and are intended to
provide the SRA with an idea of what is being requested. I expect that I will have a new
packet of updated materials to provide the SRA prior to or at its meeting on May 11`h, as
well as a formal recommendation from the DRB; this project is being presented to the
DRB again at its special meeting a night before the SRA regular meeting (on May 10th)
Lastly, the applicant will be before the ZBA on May 18th to seek a variance for relief of
how high on the building's fagade signage may be placed. I recommend that any
approval by the SRA be conditional upon granting of a ZBA variance for height(please
see additional details on this issue in the below "staff comments" section for the DRB
meeting.

The applicant proposes a series of four (4) signs placed at varying locations, to include:
• two (2) blade signs (one that will be mounted perpendicular to Bridge Street;
close to the entrance; and the other in a vertical format along the St. Peter Street
walking path)
• a surface sign facing Bridge Street; and
• a bronze plaque directional sign mounted to a pillar along St. Peter Street
The two blade signs and the surface sign will be made of metal with raised stamped
metal letters that will be halo-lit from behind.
More details on the proposal are enclosed for your review.
Staff Comments for April 27, 2016 DRB Meeting
I inquired with the applicant as to whether an existing sign post that was installed as
part of the "Great Escape" restaurant project along Bridge Street would be used. He
indicated that there are no plans to use the sign post. That being the case, the Board
may want to consider conditioning, or at least encouraging, the removal of the sign post.
The proposal generally meets the City's Sign Ordinance and Design Guidelines, in
terms of square footage allowance, lighting, materials, etc. That said, the following is
language from the City's Sign Ordinance, which raises issues with what is being
proposed (my comments continue after the reference):
Sec. 4-51. - On-premises signs in nonresidential districts.
(a) The following on-premises signs in nonresidential districts are permitted:
A wall sign attached parallel to a building which projects no more than 15 inches from
the building surface, provided that the top of such sign is no higher than whichever of
the following is lowest:
a. Twenty-five feet above sidewalk or finish grade;
b. The top of the sills of the first level of windows above the first story; or
c. The height of the building at the building line.
A sign attached at right angles to a building, provided that such sign has no more
than two faces and.-

nd:a. There is no more than one such sign for each entrance door to a business
establishment,
b. It projects no more than five feet from the building;
c. The sign advertises a use which occupies at least 18 feet of sign frontage;

d. The bottom of the sign is at least ten feet from grade and its top is no higher than
whichever of the following is lowest:
1. Twenty-five feet above sidewalk or finish grade;
2. The top of the sills of the first level of windows above the first story; or
3. The height of the building at the building line;
e. The area of the sign shall not exceed 24 square feet on either side, except that an
additional ten square feet on each face is allowed for a sign which incorporates a public
service message device such as a time and temperature sign; and
f. There are no exposed guy wires or turnbuckles.
My concerns are the following:
1.) That both the blade signs and the surface sign are higher than what the code
allows for.
That being said, both the Great Escape and A&B restaurant establishments, which
previously occupied this location, had signage proposals that exceeded these
standards. You'll note that the applicant provides a "previous signs" page toward the
back of the package you have received that shows signage that is above the tops of
second floor window sills and in the case of the Great Escape, more than one blade
sign.
I will determine whether this proposal also requires a variance from the Zoning Board of
Appeals. I recommend that the Board, in its motion, condition any approval of the
project as shown, upon also seeking and receiving any variances, if necessary.

Nonresidential Districts of the Salem Code of Ordinances, to allow the petitioner to install signs that
are above the top of the sills of the first level of windows above the fust story at the property of 50 ST.
PETER STREET (Map 35 Lot 179)(B-5 Zoning District).
A public hearing on the above Petition was opened on May 18, 2016 pursuant to M.G.L Ch. 40A, § 11. The
hearing was closed on that date with the following Salem Board of Appeals members present: Peter A.
Copelas (Vice-Chair),Jimmy Tsitsinos, Mike Duffy,Tom Watkins,Paul Viccica (alternate).
The Petitioner seeks a Variance of the provisions of Sec. 4-5.1 On- Premises Signs in Nonresidential Districts
of the Salem Code of Ordinances to allow the petitioner to install signs that are above the top of the sills of
the fust level of windows above the first story.
Statements of fact:

1. In the petition date-stamped April 26, 2016, the Petitioner requested a Variance of the provisions of
Sec. 4-5.1 On- Premises Signs in Nonresidential Districts of the Salem Code of Ordinances to allow
the petitioner to install signs that are above the top of the sills of the first level of windows above the
first story.

2. Steven Hall and Gideon Coltof,of Bit Bar,presents the petition.
3. Bit Bar is located on the first floor of the Old Salem Jail. The petitioners are proposing to install
signage above the maximum height allowed. Specifically, the Sign Ordinance of Sec 4-5.1 a.4 and d.2
state that the signs may not be higher than the top of the sills of the first level of windows above the
fust story.
4. The proposed signage calls for the highest point of the tallest sign to align with bottom sills of the
second story.
5. The petitioners testify that the restaurant location, building scale, and mass of the Old Jail are
significantly greater than other buildings in the area that contain retailers. Further the building is
physically set back about 150 feet from fast moving traffic on Bridge Street and Church Street.
6. The Sign Ordinance states that "the bottom of the sign is at least ten (10) feet from grade and its top
is no higher than whichever of the following is lowest: ...the top of the sills of the fust level of
windows above the first story..." If the literal enforcement of the sign ordinance were applied, it
would only allow the petitioner to have signs that are two (2) feet tall.

7. The petitioners testify that two (2) feet tall signs are not sufficient in relation to the location, building
scale,building mass and location.
8. There are a total of three (3) signs proposed for this location including two (2) blade signs and one (1)
wall mounted sign.
9. The signage has been reviewed and approved by the Design Review Board and Salem Redevelopment
Authority.
10. The requested relief,if granted,would allow the petitioner to install signs that are above the top of the
sills of the first level of windows above the fust story signage for this business located at the rear of
the property.
11. At the public bearing,no members of the public spoke in favor or opposition to the petition.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the petition, including the application narrative and plans, makes the following
findings:
Findings Sign Variance:
1. Special conditions and circumstances that especially affect the land, building, or structure involved is
that the building scale, and mass of the Old Jail are significantly greater than other buildings in the
area that contain retailers. Further the building is physically set back about 150 feet from fast moving
traffic on Bridge Street and Church Street.
2. Literal enforcement of the provisions of the Ordinance would create a substantial hardship to the
applicant as the Ordinance the literal enforcement of the sign ordinance were applied, it would only
allow the petitioner to have signs that are two (2) feet tall on a large building setback from the street.
3. The desired relief may not be granted without nullifying or substantially derogating from the intent of
the district or purpose of the City of Salem Zoning Ordinance.
On the basis of the above statements of facts and findings,the Salem Board of Appeals voted five (5)in favor
(Peter A.Copelas (Vice-Chair),Jimmy Tsitsinos,Mike Duffy,Tom Watkins, Paul Viccica (alternate) and none
(0) opposed, to approve the requested Variance to allow signage at the property subject to the following eight
(8) standard terms, conditions and safeguards:
Standard:
1. Petitioner shall comply with all city and state statues,ordinances,codes and regulations.
2. All construction shall be done as per the plans and dimensions submitted to and approved by the
Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly
adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finished of the new construction shall be in harmony with the existing structure.
6. A Certificate of Occupancy is to be obtained.
7. A Certificate of Inspection is to be obtained.

I reviewed the attached sign proposal with Steve this AM—Approved. Just to be completely clear,this is approval for
the signage. We are still waiting for the shop drawings to detail the attachments to the granite—so please make sure
nothing is installed until we have the shop drawings and have given you and agreement to attach to the granite.

Sec. 4-51. - On-premises signs in nonresidential districts.
(a) The following on-premises signs in nonresidential districts are permitted:
(1) All signs allowed in residential districts.
(2) A wall sign attached parallel to a building which projects no more than 15 inches from the
building surface, provided that the top of such sign is no higher than whichever of the following
is lowest:
a. Twenty-five feet above sidewalk or finish grade;
b. The top of the sills of the first level of windows above the first story; or
c. The height of the building at the building line.
(3) A permanent nonilluminated sign on the inside of the glass of a window, provided that the total
area of the sign does not exceed 30 percent of the total glass area of windows appurtenant to
the use to which the sign is accessory, and provided that signs on ground floor windows be
included in calculating the total area of signs on a sign frontage.
(4) A sign attached at right angles to a building, provided that such sign has no more than two faces
and:
a. There is no more than one such sign for each entrance door to a business establishment;
b. It projects no more than five feet from the building;
c. The sign advertises a use which occupies at least 18 feet of sign frontage;
d. The bottom of the sign is at least ten feet from grade and its top is no higher than whichever
of the following is lowest:
1. Twenty-five feet above sidewalk or finish grade;
2. The top of the sills of the first level of windows above the first story; or
3. The height of the building at the building line;
e. The area of the sign shall not exceed 24 square feet on either side, except that an additional
ten square feet on each face is allowed for a sign which incorporates a public service
message device such as a time and temperature sign; and
f. There are no exposed guy wires or turnbuckles.
(5) A freestanding sign, provided that such sign has no more than two faces and:
a. If there are one or two uses, as defined by section 5 of the zoning ordinance, as amended on
August 27, 1965, September 2, 1969 and August 1, 1972, on the lot, the area of each face
does not exceed 65 square feet and the top of such sign is no higher than 25 feet above
sidewalk or finish grade; or
b. If there are three or more such uses on the lot, the area of each face does not exceed 125
square feet and the top of such sign does not exceed 30 feet above grade.
A lot with a front lot line of 200 or more feet may have two freestanding signs.
(6) Temporary signs pertaining to special sales or events lasting no more than 15 days affixed to
windows, provided that their total area does not exceed 30 percent of the window. No permit is
required for such temporary sign.
(7) Directional signs necessary for public safety and convenience which do not exceed 12 square
feet per face and which bear no advertising. Such signs are not counted in computing total sign
area allowed by this section.
(8) A sign painted on or attached to the face of, but not extending above, a canopy or marquee or a
sign attached to the underside of a canopy or marquee.
(9) A sign painted on or attached to an awning.
(b) A sign may bear lettering to indicate the street number; the name and kind of business, service or

However, a use with less than 25 feet of sign frontage may have a maximum of 50 square feet of
permanent signs.
(g) The distance of a sign on or under a canopy, marquee or awning from the centerline of an abutting
street shall be construed to be the same as if such sign were attached to the building to which the
canopy, marquee or awning is attached.
(h) If the first floor of a building is substantially above street grade and the basement is only partially
below street grade, separate occupants of each level may each have one-half the square feet of
signage to which a use would be entitled if it were a single ground floor use.
(i) If a building fronts on two or more streets, the sign area for each street frontage shall be computed
separately.
