Notice of the hearing was sent to abutters and others and notices of the hearing were published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner is requesting and Administrative Appeal of the Salem Zoning Officers opinion for the property located at 5 Skerry Street Court R-2. The Board of Appeal, after careful consideration of the evidence and after reviewing the plans at the hearing,makes the following findings of fact: 1. The petitioner was represented by Attorney John Keilty of 40 Lowell Street in Peabody. 2. Neighbors and abutters spoke of building materials and debris left on the lot. The abutters were all in opposition to this petition. 3. The Board concurs with Acting Building Commissioner Thomas St. Pierre that this is not a Special Permit use listed in Section 5-3 of the Salem Zoning Ordinance. Therefore, base on the fact and on evidence presented,the Board make a motion to uphold the Building Commissioners opinion with regards to 5 Skerry Street Court with a vote of 5-0 to deny the petitioners appeal. The Health Department currently has you in violation for debris left on the property. The most recent complaints are the storage of two boats and a plow at the property. The storage of a personal boat or plow would be considered an ancillary use to a residential home. The property in question does not have a house on it. Therefore, the storage is the primary use. Storage is not allowed in residential district. You are directed to cease and desist the use of the property for storage of any kind within 30 days. Failure to comply with this order will result in a complaint being filed in Salem District Court. If you wish to appeal this order your appeal is to the Zoning Board of Appeal hearing. Notice of the hearing was sent to abutters and other and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting Variances from lot size, frontage, density, front, rear and side setbacks to construct a single family dwelling for the property located at 5 Skerry Street Court located in an R-2 zone. The Variance which has been requested may be granted upon a finding of the Board that: a. Special conditions and circumstances exit which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or structures in the same district. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing and after viewing the plans, makes the following findings of fact: 1. Attorney Stephen Lovely of 14 Story Street in Salem represented the petitioner, Mark Petit. 2. Mr. Petit had been granted a request by the Historic Commission to tear down an existing garage that was in deplorable condition 3. Mr. Petit purchased an additional 300+/-sq ft piece of land that would increase his total square frontage to 2600 sq ft and also create an additional parking space for the property. 4. Mr. Petit had previously appeared before the Zoning Board of Appeal with this same request for a variance. He was denied. 5. Speaking in opposition to this petition was Mike O'Brien, 4 Skerry St. Court, Pat Cahill, 1 Skerry St.Court, Ray Hodge, 6 Skerry St. Court, Cameron Clark, 4 Skerry St. Court and Laura Jones, 4 Skerry St. Court. w DECISION ON THE PETITION OF MARK PETIT REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 5 SKERRY STREET COURT R2 T ._ page two 6. Neighbors opposition included parking, drainage, snow removal and the facfthe> there would be no room for a fire truck to enter close enough to the proposed structure. On the basis of the above findings of fact, and on the evidence presented at the hearing, e� the Board of Appeal concludes as follows: 1. Special conditions do not exist which especially affect the subject property and not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would not result in unnecessary hardship to the petitioner. 3. The relief requested cannot be granted without substantial detriment to the public good or without nullifying and substantially hardship derogating from the intent of the district or purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted 0 in favor and 5 in opposition to grant the requested variances. Having failed to garner the four affirmative votes required to pass, the motion is defeated and the petition is denied. In this case your Board cannot proceed against the unlicensed person as it would with licensed Supervisor. The Home Owner acting as supervisor is ultimately responsible. To ensure that the Home Owner is fully aware of his/her responsibilities, many communities require, as part of the permit application, that the Home Owner certify that he/she understands the responsibilities of a supervisor. Grealish, Chairman; George Ahmed, Stephen Touchette and Stephen O'Grady. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting a Variance from lot size, frontage, side and rear setbacks, front yard depth and lot coverage to allow construction of a single family dwelling. The property is located in a Residential Two Family District. The Variance which has been requested may be granted upon a finding by this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1 . The petitioners proposal will improve the neighborhood. 7. The proposed single family dwelling will be compatible with the other residential uses in the neighborhood. 8. The proposed single family dwelling is not detrimental to the R-2 zoning while the pre-existing commercial use was. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property but not the district in general. 2. Before hearing the merits of this petition, the Board of Appeal had to consider if there is substantial and material change from an application for a single family dwelling that was denied by this Board on March 20, 1991 . The Board of Appeal, after hearing the evidence presented, and after receiving Consent from the Salem Planning Board, voted unanimously, 5-0, that there was a substantial change, said change being the acquisition by the petitioner of an additional.310 square feet of land from the abutter which would increase the size of this under- sized lot and allow petitioner to meet the parking requirements as set forth in the City of Salem Zoning Ordinance, they would hear the petition. A single family dwelling is not detrimental to the R-2 zoning district while the pre-existing commercial use was. 7. Many neighbors and abutters spoke in favor of this petition while none spoke in opposition. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1 . As a result,the legal street number for your property has been changed from 2 Skerry Street Court to 3 Skerry Street Court. Please note that addresses in the city typically have odd numbers on the left side of the street from the low number end and even numbers on the right side. In your case,even though you are on the left side, your current address is an even number. Without such consistency in numbering, confusion could arise in determining the correct house when public safety personnel are responding to an emergency. The lot is at the end of Skerry Street Court, a dead end street which also abuts the new Carlton School. For over a year, an older stockade fence has been on the ground of this small lot, rotting away. Animals have been hiding under it an summer according to my tenants. Additionally, the lawn has not been cut in over two years, leaving growth of weeds exceeding six feet. The owner of this property tried unsuccessfully to be granted a variance to build a single family house(the lot is 2500 sq.ft). Once he was turned down (2 years ago), he then illegally parked his boats and snowplows there. This spring, he was before the Board of Appeals again and they told him to move his boats and plows and take care of the property. ' Mr. Petite removed the boats and plows, left the rotted fence on the ground and has never attempted to clean the lot, mow the grass, etc. My tenants and neighbors have told me they frequently see mice, rats, skunks, etc., near or under the fence lying on the ground.
