We, being the owners of the land known as 38 Shore
Avenue, Salem, Massachusetts , pursuant to Massachusetts
General Laws Chapter 40A, Sections 8 and 14 , being aggrieved
by the action of the Building Inspector by a decision dated
September 30 , 1988 , wherein the Building Inspector declared
invalid Building Permit #494-88 , with regard to the construc-
tion of a garage at 38 Shore Avenue, Salem, Massachusetts ,
(a copy of said letter is attached hereto as Exhibit "A" ) do
hereby appeal said decision of the Building Inspector specifically:
The construction of the garage at 38 Shore Avenue,

DECISION ON THE PETITION OF DORILLA MORENCY
REQUESTING VARIANCES FOR 38 SHORE AVE.
A hearing on this Petition was held on April 28, 1982 with the following
Board Members present: Douglas Hopper, Chairman, Messrs. Piemonte, Hacker,
Feeherry, and Associate Member Luzinski. Notices of the hearing were sent
to abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
The Petitioner has requested variances for the property identified as
38 Shore Ave. which now consists of two non-conforming lots designated as
Lots A and B on a plan submitted to the Board. Variances are required because
a prior division of the property caused both of the current lots to be
Z. requested va-riances, if granted, will conform the lots
to current zoning standards.
The Board of Appeal, after conu;Lderation of the evidence presented at
the public hearing and after viewing the property makes the following findings
of: fact:
1) The property in question currently is divided into two lots. A
two-family house is on Lot. A; a sLngle-family house is on Lot B.
Both Houses have been at the site for over fifty years.

3) Petitioner's request involves no change of use nor any other changes
at the property. Petitioner seeks only to establish that each
lot is a legally proper one under current zoning.

1) The property in question is .unique because of its peculiar frontage
problems and other access problems and because of the fact that
the structures on the site were there for many years prior to
any zoning statute.
2) The conditions described above especially affect the land in
question but do not generally affect the zoning district in
which the property is located.

3) The conditions described above which affect the land in question,
but not the zoning district generally cause the following special
hardship: unless the requested variances are given, it will be
virtually impossible to sell either lot.
4) the desired variance may be granted without substantial detriment
to the public good because the requested variances, if granted,
will change nothing on the site.
Therefore, the Board of Zoning Appeal unanimously voted in favor of
granting the requested relief. The Board grants a variance to the
Petitioner on the following terms and conditions:
1) Variances from frontage, front yard, side yard, rear yard, lot
area and density requirements and any other variance necessary to
cause the two lots at the site tt conform to current zoning

Please be advised that this office represents Robert B.
Morency of 36 Shore Avenue, Salem, Massachusetts , abutting
landowner to the property located at 38 Shore Avenue, Salem,
Massachusetts . In accordance with Chapter 40A of the Massa-
chusetts General Laws and relevant sections of the City of
Salem Zoning Ordinance, demand is hereby made that you
enforce the Zoning Ordinance for the City of Salem by
revoking forthwith the building permit previously issued by
your department to the owners of 38 Shore Avenue for purposes
of constructing a two-car garage on the site thereof .
I am in receipt of a letter opinion from Michal E. O ' Brien ,
City Solicitor, dated April 28 , 1988 wherein he offers the
opinion to you that the front yard of 38 Shore Avenue is the
area within the westerly boundary line of the lot . Attached
hereto as Exhibit A is a copy of said correspondence .
I am in receipt of a request for a Determination of Applic-
ability, Massachusetts Wetlands Protection Act previously
submitted to the City of Salem relative to 38 Shore Avenue .
Attached to said Request is a copy of ' Proposed Construction
Plot Plan ' prepared by Carter and Towers Engineering Corp . ,
which indicates thereon the approximate location of the
proposed garage. Attached hereto as Exhibit B is a copy of
said Plot Plan .
Without waiving any other potential objections to the
Issuance of the building permit as aforesaid or the proposed
construction of a two-car garage at 38 Shore Avenue , Salem,
Massachusetts , it is our contention that the proposed garage
is to be located within the front yard of 38 Shore Avenue, in
direct violation of Section VII(H) ( 1 ) of the City of Salem
Zoning Ordinance which provides in pertinent part "Accessory
buildings and structures , such as garages , . . . shall be
subject to the following regulations :
1 . No accessory building or structure shall be located
within any required front yard or within any side yard of
a corner lot . . . . "
Additionally, it appears that the proposed location of the
garage may violate Sections VII(H) ( 2 ) , ( 3 ) of the Zoning
Ordinance . However, the attempt to locate this garage within
the required front yard is a clear violation of the Zoning
Ordinance.
In accordance with the provisions of Chapter 40A of the
Massachusetts General Laws and the relevant Sections of the
City of Salem Zoning Ordinance , we expect that you shall
provide this office with timely notice of your decision with
respect to this demand . I am causing the original of this
notice to be served upon you by constable . I am causing a
copy of this letter to be served upon the owners of 38 Shore
Avenue, and I am forwarding a copy of this demand to the City
Solicitor.

Please be advised that this office represents Robert B.
Morency of 36 Shore Avenue, Salem, Massachusetts , abutting
landowner to the property located at 38 Shore Avenue, Salem,
Massachusetts . In accordance with Chapter 40A of the Massa-
chusetts General Laws and relevant sections of the City of
Salem Zoning Ordinance, demand is hereby made that you
enforce the Zoning Ordinance for the City of Salem by
revoking forthwith the building permit previously issued by
your department to the owners of 38 Shore Avenue for purposes
of constructing a two-car garage on the site thereof.
I am in receipt of a letter opinion from Michal E. O' Brien,
City Solicitor, dated April 28, 1988 wherein he offers the
opinion to you that the front yard of 38 Shore Avenue is the
area within the westerly boundary line of the lot . Attached
hereto as Exhibit A is a copy of said correspondence .
I am in receipt of a request for a Determination of Applic-
ability, Massachusetts Wetlands Protection Act previously
submitted to the City of Salem relative to 38 Shore Avenue.
Attached to said Request is a copy of 'Proposed Construction
Plot Plan' prepared by Carter and Towers Engineering Corp . ,
which indicates thereon the approximate location of the
proposed garage. Attached hereto as Exhibit B is a copy of
said Plot Plan.
Without waiving any other potential objections to the
issuance of the building permit as aforesaid or the proposed
construction of a two-car garage at 38 Shore Avenue, Salem,
Massachusetts , it is our contention that the proposed garage
is to be located within the front yard of 38 Shore Avenue, in
direct violation of Section VII(H) ( 1) of the City of Salem
Zoning Ordinance which provides in pertinent part "Accessory
buildings and structures, such as garages , . . . shall be
subject to the following regulations :
1 . No accessory building or structure shall be located
within any required front yard or within any side yard of
a corner lot . . . . "
Additionally, it appears that the proposed location of the,
garage may violate Sections VII(H) (2) , (3) of the Zoning
Ordinance. However, the attempt to locate this garage within
the required front yard is a clear violation of the Zoning
Ordinance.
In accordance with the provisions of Chapter 40A of the
Massachusetts General Laws and the relevant Sections of the
City of Salem Zoning Ordinance, we expect that you shall
provide this office with timely notice of your decision with
respect to this demand . I am causing the original of this
notice to be served upon you by constable . I am causing a
copy of this letter to be served upon the owners of 38 Shore
Avenue, and I am forwarding a copy of this demand to the City
Solicitor.

In response to a complaint filed by Attorney Robert Peck, Jr. Ur, behalf
of 36 Shore. Ave. regarding the location of the proposed garage to be Constructed
under permit 0494-88, 1 have again reviewed location with tire. City Solicitor.
As you are aware, due to the uniqueness of this property (i.e. , accessible only
by a right of way) , both this office and Mr. O'Brien have had a difficult time
determining t•r,e setback requirements relating to front, rear and side of property.
Following Attorney Peck's complaint, both the City Solicitor and 1 visited
the site and we are .in agreement that to locate the garage as ahown on the sub-
mitted site plan would be in violation of Section VII, H 1 of the City of Salem
Zoning. Ordiance which prohibits a garage being located in a front yard.
1n view of the above, I must advise you that I am, this
day, September 30,
1988, declaring Permit 1494-88 invalid and am refunding your permit fee. In

DECISION ON THE PETITION OF DORILLA MORENCY
REQUESTING VARIANCES FOR 38 SHORE AVE.
A hearing on this Petition was held on April 28, 1982 with the following
Board Members present: Douglas Hopper, Chairman, Messrs. Piemonte, Hacker,
. Feeherry, and Associate Member Luzinski: Notices of the hearing were sent
to abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
The Petitioner has requested variances for the property identified as
38 Shore Ave. which now consists of two non-conforming lots designated as
Lots A and B on a plan submitted to the Board. Variances are required because
a prior division of the property caused both of the current lots to be
non-c_foxing. The requested variances, if granted, will conform the lots
to current zoning standards.
The Board of Appeal, after consideration of the evidence presented at
the public hearing and after viewing; the property makes the following findings
of fact:
1) The property in question currently is divided into two lots. A
two-family house is on Lot: A; a single-family house is on Lot B.
Both houses have been at the site for over fifty years.
2) By virtue of a prior division of the property, by deed, into two
lots, neither lot now confor-_s to current zoning.
3) Petitioner's request involves no change of use nor any other changes
at the property. Petitioner seeks only to establish that each
lot is a legally proper one under current zoning.
On the basis of the above findings of fact, and the evidence presented
at the public hearing, the Board of Appeal concludes as follows:
1) The property in question is unique because of its peculiar frontage
problems and other access problems and because of the fact that
the structures on the site were there for many years prior to
any zoning statute.
2) The conditions described above especially affect the land in
question but do not generally affect the zoning district in
which the property is located..

3) The conditions described above which affect the land in question,
but not the zoning district generally cause the following special
hardship: unless the requested variances are given, it will be
virtually impossible to sell either lot.
4) the desired variance may be granted without substantial detriment
to the public good because the requested variances, if granted,
- will change nothing on the site.
Therefore, the Board of Zoning Appeal unanimously voted in favor of
granting the requested relief. The Board grants a variance to the
Petitioner on the following terms and conditions:
1) Variances from frontage, front yard, side yard, rear yard, lot
area and density requirements and any other variance necessary to
cause the two lots at the site to conform to current zoning
are hereby granted.
