I understand that Congressman Moulton is seeking the City's approval to hang an office sign over the public sidewalk in front his Salem district office located at 21 Front Street. Generally,the United States acts as a self-insurer with respect to its liability for the tortious acts of its employees when they are acting within the scope of their official duties. See Federal Tort Claims Act, 28 U.S.C. §§ 1346(b),2401(b),2671-80(2012). Thus, any injury to a third party or damage to property resulting from the tortious acts or omissions of Congressman Moulton or his employees in conducting official activities concerning this sign would be covered under the terms of the Federal Tort Claims Act.
