Joseph Correnti P Serafini, Serafini, Darling, and Correnti, LLP. 63 Federal Street Salem, MA 01970 RE: Peabody Essex Museum Expansion, East India Square (Essex Street and Charter Street) Site Plan Review On Thursday, July 6, 2000, the Planning Board of the City of Salem opened a Public Hearing regarding the application of the Peabody Essex Museum under site plan review for the construction of an approximately 100,000 square foot addition to the main Museum building, as well as a new public park and pedestrian esplanade. The addition will house exhibition galleries with the existing Museum building. In addition, the plan also includes a 19a' century Chinese House to be reconstructed on site and linked to new galleries. The plan shows the demolition of the Empire Building and the acquisition of Liberty Street and the Empire Parking lot owned by the City. The proposed construction is located at East India Square (Essex Street and Charter Street). The Public Hearing was continued to July 20, 2000; August 3, 2000; September 7, 2000; September 21, 2000; October 5, 2000; October 19, 2000 and closed on October 19, 2000. At a regularly scheduled meeting of the Planning Board held on October 19, 2000,the Board, based upon its review of the Memorandum of Understanding between the City of Salem and the applicant, as well as the plans submitted and evidence presented at the public hearings, voted by a vote of seven (7) in favor, none (0) opposed,to approve the application as complying with the requirements of the site plan review, subject to the following conditions: 1. Conformance with the Plan Work shall conform with the set of plans entitled, "Site Plan—Peabody Essex Museum, Salem, Massachusetts", sheets X10.00, C10.00—C10.04, L10.00—L10.18, prepared by CID Associates, Inc, dated March 24, 2000 and revised May 12, 2000 and October 12, 2000. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Street trees shall be a minimum of 3 '/2" caliper. c. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. d. After such landscaping is completed, the developer will add further landscaping if such is requested by the Planning Board or the City Planner. 4. Signage a. Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 5. Lighting a. Lighting shall be installed as shown on the approved plan. b. No light shall cast a glare onto adjacent parcels or adjacent rights of way. c. A final lighting plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. e. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of a Certificate of Occupancy. 6. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 8:00 AM on weekdays and Saturdays. No work shall continue beyond 5:00 PM. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f. All construction shall take place in accordance with the construction management plan titled, "Traffic Management Plan, Peabody Essex Museum Expansion Project, Salem, Massachusetts" and dated August 11, 2000. 7. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 8. Board of Health All Board of Health requirements shall be strictly adhered to. 9. Fire Department All work shall comply with the requirements of the Salem Fire Department. 10. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 11. Salem Redevelopment Authority All requirements as set forth by both the Salem Redevelopment Authority and its Committee, the Design Review Board, shall be strictly adhered to. 12. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two-(2)year period. d. The applicant shall provide the City, when needed, with the type of bricks proposed to be utilized on Essex Street and Charter Street for maintenance purposes. 13. Traffic a. The applicant shall be responsible for preparing design plans and all construction costs associated with the implementation of the new design for implementing a two way street pattern on Essex Street between its intersections of Hawthorne Boulevard and Liberty Street as shown on the Essex Street two way plan dated August 30, 2000. The improvements associated with creating two way traffic on Essex Street include providing a minimum of two eleven foot wide travel lanes, limited on street parking on the south side of the street, and a functional traffic signal at the intersection of Hawthorne Boulevard and Essex Street. The applicant shall fully support the City in its application to the City Council for approval of a two way traffic flow on Essex Street between its intersections of Hawthorne Boulevard and Liberty Street. 14. Signage Program The applicant shall fully financially support,with the utilization of their consultant, the development of a comprehensive downtown signage program. The applicant's consultant shall develop the sign program under the direction of the City Planner. The sign program shall include recommendations as to location and type of signage to be provided in the downtown area to direct visitors to the City's downtown, waterfront, parking, and attractions. Prior to implementation, the sign program shall be approved by the City Planner. The City will be responsible for the construction and erection of the signage. 15. Pedestrian Access a. The applicant shall provide a public garden with continuous and open pedestrian access between Essex Street and Charter Street, as shown on the plans submitted herewith, as a condition of this decision. The pedestrian access shall be open to the public 24 hours a day, 7 days a week, 365 days a year. The applicant shall maintain the walkways and keep them free from debris and the access shall be adequately lighted at all times by the Museum. The applicant shall not substantially change, alter, restrict or amend the pedestrian access as shown on the plans unless and until such changes, alterations, restrictions or amendments are first approved by a two thirds majority of the Planning Board members after public notice and meeting. Any such proposed changes must demonstrate that unrestricted pedestrian access shall be maintained. b. Upon the completion of construction, the applicant shall maintain free, interior pedestrian access between Essex Street and Charter Street through the main entrance of the Museum during Museum open hours until December 30, 2008. 16. 135 Essex Street The applicant shall provide free and clear access at all times as shown on the approved plans to the parcel located at 135 Essex Street. The access way shall be maintained by the applicant and shall run with the property, not the owner. 17. Parking The applicant shall, as stated in the request for proposals dated January 8, 1998, shall contribute funds to the City of Salem toward the construction of a new Church Street parking structure or other equivalent downtown improvement. 18. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title. Here at ENHC,new sign designs and materials planning are well under way, and I anticipate that I may be able to consider a few additional sign ideas belatedly over the next few weeks, (e.g. historic churches and cemeteries), depending on the availability of any remaining funds. Many people have already submitted information to be used for their individual sign designs. When reviewing your text and graphics, I will apply ENHC's selection criteria to determine if a sign will be funded and notify you if there is a problem. Where any of the proposed sign ideas fit into our early settlements, maritime or industrial tourism themes, they will be given priority, as long as they meet the other selection criteria for each individual sign proposals. The process of developing the various individual sign Projects has now been completed, and strong proposals have been submitted from across the region,including the following: • MBTA station welcoming signs with downtown maps and basic visitor information; • Entering Historic Districts with maps and basic info; (Some towns have requested as an alternative a similar sign with Entering or Welcome to Historic... with maps and basic info.) • Historic buildings; • Historic parks, gardens, commons, forts and armories; • Scenic vistas, waterfronts,river walks,walking trails, watersheds, and other significant natural resources; • Farms and barns; • Secondary road directional signs to mark turnoffs for significant historic or natural sites; and • Archive repositories—historic records sites. Individual sign proposals submitted within each of the above sign projects must provide exactly the information wanted on each sign. To keep pace with the Designer's timetable, funding is being approved for completed sign proposals on a first come first serve basis. I continue to encourage those still intending to propose signs to provide me with text and graphics as soon as possible, or funding will go to other completed sign proposals or new ones being submitted daily. Additionally, approval of your proposal for a sign remains subject to ENHC's criteria—all signs funded must be for significant historic or natural resources. Therefore,while you should provide me with any proposals, including test and graphics, as you complete each one, please note that the final deadline for signs proposals is June 15, 2001.—If you have a problem with this deadline, please contact me immediately at the phone numbers listed below to discuss the possibility of funds remaining after that date for your sign ideas. WHAT FOLLOWS IS A SUMMARY OF YOUR OVERALL RESPONSIBILITIES (OR FOR THOSE WORKING WITH YOUI FOR EACH SIGN REQUESTED. Your Si¢u Planning Responsibilities: • Text–Thoroughly planned and edited text for each type of sign you want(call me if you have questions about sign types)must be supplied by you immediately, if not done so already, or funding will be used for other pending or new signs requests. You must provide exactly the wording you want to appear on the sign(s), as there is no time allotted in the Designer's contract for any re-designing. I recommend that you have several people review any texts to help flush out what might be left out. Often people planning signs fail to consider the effectiveness of the wording in educating, directing or informing the public. • Visuals–Original or high quality copies of any graphics, such as pictures, logos, art,maps, etc.,must be submitted by you immediately, if not done so already, or funding will be used for other pending or new sign requests. Please note that lesser quality small graphics become distorted or loose clarity when enlarged by the Designer. • Location–Your description of where the sign most likely should be located must also be supplied and will be reviewed by the Designer. A photograph of the site with the spot marked on the photo is most useful,but a clear verbal description may be acceptable. I will be arranging Section 106 reviews where necessary, so you need not worry about that issue. • Permission–To legally use quotes,text or pictures, logos, art, maps, etc., written permission must be obtained by you and submitted to me before funds for a sign are allocated by ENHC. • Authenticity–Documentation to verify the authenticity of 1) the site to receive a sign, and 2) the historical facts to be included in your sign(s)will be needed eventually. Copies of any information that will help authenticate the significance of the historic or natural resource to receive a sign, as well as the facts to be included on the sign(s) are required. • Final Editin¢–As soon as the design of a sign is drafted in the next few weeks, I will give it to you for your editing to correct errors. No other changes can be made at that time, as the contract schedule will not allow re-designing. This is why it is important for you to plan carefully now, before submitting anything to the Designer, providing me with exactly what you want your signs to include so that they are meaningful to the public. • Permit Process–While I am happy to provide advice on the permitting process in general, you will be responsible for obtaining a permit for installing the sign(s). As soon as you receive a copy of the final sign design from me,you will use it to apply for and obtain any permits necessary to place signs, (except the signs on MBTA property, for which I have already made arrangements). As we do not anticipate the manufacture and installation of the signs until approximately next winter, ENHC's deadline for obtaining permits will be assigned after the design work is complete. • Cost–It is necessary first to designing the signs to determine the cost. As explained, ENHC will pay 75% of the costs of each sign, and the remaining 25% eventually will be paid by those receiving signs.—However,matching funds are not necessary at this time. You will be given ample time to seek and obtain any funds needed for the manufacture and installation of the sign, which probably will not begin late this year or early next year. We have now contracted with an architectural firm and negotiated a timetable, which means that I will need a response as soon as possible so that I can set aside funds for individual sign projects. While we will pay 75% of the costs of any signs, the remaining 25% will be paid by the those wanting signs—however, no matching funds are necessary at this time, as we will move forward with the designing now, come up with a price, and then set a deadline,probably next winter or spring, for paying your share before we install the signs. As soon as you receive a copy of the final sign design from me,you will use it to apply for and obtain any permits necessary to place signs,(except the sips on MBTA property, for which I have already made arrangements). As we do not anticipate the manufacture and installation of the signs until approximately next winter.ENHC's deadline for obtaining pel:mits will be assigned after the design work is complete. Cts –it is necessary first to designing the signs to determine the cost. As explained, ENHG will pay 75%of the costs of each sign,and the remaining 25"o eventually will be paid by those receiving signs. —However,matching funds are not necessary at.this time. You will be given ample time to seek and obtain any funds needed for the manufactttre and installation of the sign, which probably will not begin late this year or early next year.
