If at all possible, they want to use the larger standard one because the current menuboards do not afford us the necessary configuration needed for the new cohesive menuboard inserts that allow for ease of navigation of menu items and nutritional information. The deviation from our existing menuboard is minimal (when considering the square footage of graphical representation inside the menuboard inserts). We are proposing that the square footage of the inserts remain equal with what we currently have in our menuboards, however, rather than the existing menuboard that has 4 extension panels, the new design would maintain a fully integrated menuboard. I also included a photo of the current menuboard. Let me know what you can do to help us expedite this. As is indicated upon the Subdivision Plan, the existing curb cut serving Lot I and the existing curb cut serving Lot 2 each shall be eliminated, and Partnership may, not exercise any right to utilize said curb cut upon Lot 1 without the express written consent of Trust. Trust agrees, however, that subject to applicable law, if Trust shall open a cuto cut upon the portion of Highland Avenue upon which Lot 2 or Lot 3 fronts, then Partnership shall have for the benefit of Lot 1 a non-exclusive and permanent easement for ingress and agrees to and from Lot l through said curb cut(w) and the driveways connecting thereto, as said driveways may be relocated by Trust from time to time. Trust agrees that until the twentieth (20th) anniversary of the date of this instrument, no portion of the Entire Premises located within two hundred (200) feet of the boundary of said Lot 1 shall be sold or leased for use or occupancy for the operation of a so-called "fast food" restaurant the primary menu item of which shall be hamburgers. Nothing herein contained, however, shall be deemed to prohibit said portion of the Entire Premises from being used as driveways and/or parking areas serving such a restaurant. C. Trust agrees that no building shall be built upon the area designated on the Easement Plan as "Parking Easement". Trust further agrees that if any building shall be erected upon Lot 2, the same shall be set back not less than forty (40) feet from the present boundary between Lot 2 and Highland Avenue and that any such building shall not contain more than one (I) story. Partnership agrees that any building erected upon Lot 1 shall nor contain more than one (1) story. U. Partnership may erect curbs, landscaping or bumper stops upon Lot 1 in order co define the boundaries of Lot 1.
