The revised drawings show signs reduced to 14.58 SF each, but they remain internally illuminated. I believe that you are incorrect in your interpretation of the Salem Sign Ordinance. I have examined the Salem Sign Ordinance,the zoning amendment establishing the Entrance Corridor Overlay District, and the Commercial Design Guidelines for the City of Salem, and cannot find anything that backs up your interpretation. The ECOD zoning ordinance does allow you to reduce the 60 SF that is allowed in the underlying district to 30 SF and I have adjusted my application to comply with this regulation. But the ECOD ordinance allows you to review the application and then clearly states that "... the Sign Review Committee shall follow the Salem Sign Ordinance..."except for the 50%size limitation. The Salem Sign Ordinance Section 3-451 requires steady illumination, which these signs will have. Section 3-54 prohibits flashing light and simulations of traffic signals or emergency vehicles and requires spot light to be aimed so that are not seen from the public way. We comply with this. Section 3-55 C prohibits blinking,flashing, or fluttering lights or changing of intensity, We also comply here. I see nothing in the Salem Sign Ordinance that prohibits these signs from being internally illuminated. In our conversation, you told me that the Commercial Design Guidelines was the document that prohibited internal illumination, and sent me the link to the document. I actually have a hard copy in my files. On page 1,the CDG states, "Design guidelines are just that, guidelines. They are not regulations or requirements." I take a great deal of pride in understanding sign codes and working with my customers to comply. I have discussed the issues with my customer, and have been instructed to pursue the application with internal illumination intact. They could not understand why among dozens and dozens of internally illuminated signs all around them on Highland Ave, they are being singled out and denied. If I am wrong in how I read the ordinances, please state in writing exactly which sections of the City of Salem ordinances this sign would violate,so that I can forward that information to my customer. Otherwise I trust that you will approve the application as revised with internally illuminated signs. I will come by on Friday or Monday with hard copies of the revised drawing, and will be available to discuss the application if you like. MAXIMUM ALLOWED: 32.5 sq. ft for wall signs 323 sq. ft. for freestanding sign PROPOSED SIGNAGE: Four (4) proposed signs in total- Two (2) 30" x76" carved wooden signs with black background and gold leaf letters, logo, and border. In addition a (1) new double-faced intemally illuminated "DUNKIN DONUTS DRIVE THRU" sign panel to replace the old 30" x 104" QUIKAVA sign panel on the existing freestanding pylon sign at the entrance of the parcel. Lastly, a new drive-thru Menu Board Panel to replace the old QUIKAVA menu board panels. TOTAL AREA OF SIGN(S): 32 sq. ft of wall signs and 21.6 sq. ft. sign panel for freestanding pylon sign COMMENTS: The existing Dunkin Donuts establishment on Highland Ave (within the Entrance Corridor) has a wooden sign with gold leaf lettering. The Original submittal did not comply with the Entrance Corridor requirements. The applicant agreed to the terms of the Facade Improvement Grant and worked with the City to match the signage for this Dunkin Donuts establishment with the existing one on Highland Ave. RECOMMENDATION: The wooden wall signs and the panel sign for the freestanding sign is in compliance with the Entrance Corridor. I recommend approval as submitted. Please let me know if you would like any more information regarding this issue.
