Due to a complaint from the Neighborhood Improvement Task Force, I conducted an
inspection of the exterior of your property and found the following violations;
1. The garden shed needs to be repaired or replaced. Also, there was no building
permit taken out for the installation.
2. The rear porch is not adequate and does not meet code.
3. Pool area needs to be fenced in.
Please contact this office within ten (10) days upon receipt of this letter to inform us as to
your course of action regarding these violations. Failure to do so will result in legal
action being taken against you in Salem District Court.

The current exemption of "homeowners" was extended to include owner-occupied
dwellings of six units or less and to allow such homeowners to engage an in-
dividual for hire who does not possess a license, rovthat the owner
acts as supervisor. (State Building Code Section 109. 1 . 1ided
DEFINITION OF HOMEOWNER:
Person(s) who owns a parcel of land on which he/she resides or intends to re-
side, on which there is, or is intended to be, a one to six family dwelling,
attached or detached structures accessory to such use and/or farm structures.
A person who constructs more than one home in a two-year period shall not be
considered a homeowner. Such "homeowner" shall submit to the Building Official,
on a form acceptable to the Building Official , that he/she shall be responsible
for all such work performed under the building permit. Section 109. .qT

Building code and other applicable codes, by-laws, rules and regulations.

HOME OWNER 'S EXEMPTION
The Code states that: "Any Home Owner performing work for which a building
permit is required shall be exempt from the provisions of this section
(Section 109.1 .1 - Licensing of Construction Supervisors) ; provided that is
a Home Owner engages a persons) for hire to do such work, that such Home
Owner shall act as supervisor."
Many Home Owners who use this exemption are unaware that they are assuming
the responsibilities of a supervisor (see Appendix Q, Rules and Regulations-
for Licensing Construction Supervisors, Section 2.15) . This lack of aware-;
ness often results in serious problems, particularly when the Home Owner
hires unlicensed persons. In this case your Board cannot proceed against .'
the unlicensed person as it would with licensed Supervisor. The Home Owner s -
acting as supervisor is ultimately responsible. _
To ensure that the Home Owner is fully aware of his/her responsibilities,
many communities require, as part of the permit application, that the Home
Owner certify that he/she understands the responsibilities of a supervisor.
On the last page of this issue is a form currently used by several towns.
You may care to amend and adopt such a form/certification for use in your
community.

PRIVATE POOLS - CONDITIONS
PRIVATE POOL - DEFINITION
Any pool intended to be used primarily by occupants of a one or two family dwelling. Any such
pool more than 24 inches deep or having a surface area greater than 250 square feet ( 18 foot
diameter) requires a building permit before installation, enlargement or alteration.
PERMITS
Applications for a permit shall be accompanied by a certificate plot plan (scale not less than
I" = 20' ) fully dimensional, showing pool location on property, relation of adjacent structure
on property, location of all fences and gate, and owner's name of abutting properties. (See
Sample)
POOL LOCATIONS
No side of any pool shall be closer than 6 feet to side or rear property Lines, no closer to fro
yard lines than the zoning setback requirements. Variances from these requirements shall be
permitted only by Special Permit from teh Board of Appeal.
SAFETY REQUIREMENTS
Pools will be surrrounded by a fence at least four feet high and no further than 25 feet from th
sides of the pool. Rail fences will not be permitted. ONE 3 foot wide gate with closing and lock
devices will be permitted. Pools shall comply with all applicable codes .
CERTIFICATE OF COMPLIANCE
Before a wiring permit can be obtained a Certificate of Compliance must be issued. Said certific,
will be issued only after a new certified plot plan (bearing the stamp of a registered
surveyor) showing that the pool is properly sited has been filed with the Building Inspector,
OR A REQUEST FOR AN ON-SITE INSPECTION HAS BEEN HONORED BY THE BUILDING INSPECTOR. If in the
opinion of the Inspector.:a site plan is warranted, a certified plan shall be furnished before th
Certificate of Compliance is issued.
