An application for variance was filed with the Board by Jason Silva, Executive (Applicant) on July 3, 2013 The applicant has requested variances from the following sections of the 2006 Rules and Regulations of the Board: Section: Description: 14.4.1 Petitioner seeks variance for the lack of accessible seating locations at the proposed balcony. 20.1 Petitioner seeks a variance for the lack of an accessible route/vertical access (521 CMR 28.1) to the proposed balcony. On August 11, 2013 Michael Voosen Fields of Winter Street Architects, wrote to the Board requesting that a vote be taken on the balcony variance request only, and agreed to submit an amendment package no later than September 30, 2013 for any additional variance requests that are needed, due to the triggering of 521 CMR Section 3.3.2. 2. The submittal was reviewed by the Board on Monday, ' August 12, 2013 3. After reviewing all materials submitted to the Board, the Board voted as follows: On August 12,2013 the Board reviewed one variance request regarding access to the balcony. The balcony will provide an additional 49 seats to the 200 movable seat located on the main floor. The Board voted to GRANT the variances to Sections 14.4.1, 20.1 (28.1) as proposed in the application submitted, for the reason that impracticability (see definitions of impracticability in Section 5 of 521 CMR) has been proven in this case. The Board also notes that both the Commission on Disability supports the variance request as well as the Independent Living Center of the North Shore and Cape Ann. The Board voted to maintain its previous order that all additional variance amendments be submitted no later than September 30, 2013, due to the fact that the spending on the project is over 30% of the assessed value of the building and that full compliance has been triggered. Any person aggrieved by the above decision may request an adjudicatory.hearing before the Board within 30 days of receipt of this decision by filing the attached request for an adjudicatory hearing. If after 30 days, a request for an adjudicatory hearing is not received, the above decision becomes a final decision and the appeal process is through Superior Court. NOTE: If the work being' performed is reconstruction, renovation, addition, or alteration, compliance with this decision must be achieved by completion of the project and prior to final approval by the building department. The original variance request was submitted seeking a variance for the lack of accessible seating and an accessible route to the proposed balcony. The Board reviewed the variance request during an administrative discussion at their July 29, 2013 meeting and voted to continue the discussion regarding this matter to have the Petitioners submit a full review of the applicability of 521 CMR and any additional variance requests by September 30, 2013. On August 12, 2013, the Board voted on the matter of access to the proposed balcony and voted to grant the variances requested for the lack of access to the balcony (521 CMR 14.1 and 20.1). However, the Board maintained their previous motion to require that the Petitioners submit a full review of the applicability of 521 CMR, with any additional variance requests, by September 30, 2013. On September 30, 2013 the Board received a variance application, seeking additional variances to the following sections of 521 CMR: 25.1, regarding the lack of access to existing entrances; 26.6, regarding the lack of maneuvering clearance at existing doors; and 27.4, regarding the lack of compliant handrails at existing stairways. In accordance with M.G.L. c. 30A, §§ 10 and 11; 801 CMR 1.02 et. seq.; and 521 CMR 4.00,the Board convened a hearing on December 16, 2013 where all interested parties were provided with an opportunity to testify and present evidence to the Board. Jason Silva, Executive Director of the Salem YMCA, and Michel Fields of Winter Street Architects, both appeared on behalf of the Salem YMCA. Both were sworn in by the Chairman. Applicable Laws The Board established jurisdiction pursuant to 521 CMR 3,.3.2, which states that, "[i]f the work performed, including the exempted work, amounts to 30% or more of the fidl and fair cash value (see 521 CMR 5.00) of the building the entire building is required to comply with 521 CMR." I Sewall St.,Salem(V13-198).doc Pursuant to the requirements of Section 14.1 of 521 CMR, "[p]laces of assembly shall comply with all parts of 521 CMR, except as specified or modified in 521 CMR 14.00. Places of assembly shall include but not be limited to theaters,auditoriums, armories, lecture halls, arenas, stadiums, banquet rooms and conference rooms. Associated, support, or related areas, including but not limited to press boxes, lobbies, ticket offices, seating, stages, backstage areas, dressing rooms, toilet rooms, showers and green rooms, shall also be accessible." Section 20.1 of 521 CMR states, "[a]n accessible route shall provide a continuous unobstructed path connecting accessible spaces and elements inside and outside a facility. Accessible routes may include but are not limited to walks, halls, corridors, aisles, skywalks, and tunnels. Accessible routes may not include stairs, steps, or escalators, even if the stairs and steps are required to be accessible under 521 CMR." Pursuant to the requirements of 521 CMR 25.1, "[a]ll public entrance(s) of a building or tenancy in a building shall be accessible. Public entrances are any entrances that are not solely service entrances, loading entrances, or entrances restricted to employee use only." Section 26.6 of 521 CMR states that, "[a] minimum clear floor area shall be provided on both sides of all doors and gates. Exception: Doors equipped with automatic opening devices are exempt from 521 CMR 26.6.3, 26.6.4 and 26.8. 26.6.3 Pull side clearance shall comply with the following: a. A minimum of 18 inches (18" =457mm) of clear floor space shall be provided on the latch, pull side of the door when the clear .floor space in front of the door is a minimum of 60 inches (60" = 1524mm).see Fig. 26d. b. A minimum of 42 inches (42" = 10667mm) of clear floor space shall be provided on the latch, pull side of the door when the clear floor space in front of the door is more than 54 inches (54" = 1372mm) but less than 60 inches (60" = 1524mm) see Fig. 26g. c. A minimum of 24 inches(24" = 610mm) of clear floor space shall be provided on the latch, pull side of the door when the clear floor space in front of the door is a minimum of 54 inches (54"= 1372mm)and the door has a closer. see Fig. 26d. Pull side clearance shall comply with Fig. 26d." 521 CMR 27.4 states that, "[h]andrails shall have the following features: 27.4.1, Location: Stairways shall have continuous handrails at both sides of all stairs. The inside handrail on switchback or dogleg stairs shall always be continuous. See Fig. 27c.... 27.4.2, Height: Top of handrail gripping surface shall be mounted between 34 inches(34" = 864mm) and 38 inches (38" =965mm)above stair nosings. Handrails shall be measured vertically from the top of the gripping surface of the handrails to the stair nosing.... 27.4.3, Extensions: Where handrails terminate at the top and bottom of a stair run, they shall have extensions that comply with the following:' a. At the top, extend at least 12 inches(12" =305mm) beyond the top riser and parallel with the floor or ground surface. See Fig. 27d. b. At the bottom, extend at least 12 inches (12" = 305mm)plus the width of one tread beyond the bottom riser. The handrail shall continue to slope for a distance of the width of one tread from the bottom riser; the remainder of the extension shall be horizontal. See Fig. 27d. c. Handrail extensions need not extend if it would cause a safety hazard or if space does not permit. Extensions shall comply with 521 CMR 20.6, Protruding Objects.... 27.4.4, Size: Handrails shall have a circular cross section with an outside diameter of 1'/a inches (32mm) minimum and two inches (51 mm) maximum.... 27.4.5, Shape: The handgrip portion of the handrail shall be round or oval in cross-section. The building is three stories plus a basement. The structure is a two unit condominium with mixed use occupancy, with Units 1 and 3 occupied by the YMCA. Unit 2 is occupied by the Salem Housing Authority. The two units are contiguous, but separate with separate entrances, egress, systems, ownership and management. (Exhibit 1). 2) The Petitioners are seeking a time variance for the secondary pool at the back of the facility that is currently 28 inches below the main level. Swimmers can be accommodated in the newer large pool; however,the plan for the small pool it to empty it and build a raised floor over it that would be level with the first floor to be used as a new fitness area. Fields stated that the other pool is a large Olympic size pool which is accessible via a pool lift. There is also direct access into the locker rooms adjacent to the pool. Silva noted that the smaller pool is primarily used for physical therapy and smaller children's swim lessons. He added that swim lessons and physical therapy can be accommodated by scheduling time at the larger pool. Silva stated that the proposal is to do the work to cover the pool and create the new fitness area within five (5) years, but that the YMCA is hopeful that the work will be completed sooner than that. He added that they are still working to raise the funds to complete this portion of the project. Silva stated that this portion of the proposed project will cost approximately $250,000.00. (Exhibit 1 and 2, and Testimony of Silva and Fields). 3) The basement level, kids locker rooms and basketball court were all previously connected by a now discontinued inclined platform lift, which has fallen out of service. Fields stated that due to the age of the lift, the repairs that have been made have been unsuccessful and the parts needed to completely fix the lift will cost almost as much as the installation of a new limited-use-limited-application(LULA) elevator. The Petitioners propose to install a LULA to connect these three levels of the Y to the lobby. Currently the lower level is used for after school care. Silva explained that there are three off-site locations at City public Schools that are fully accessible for alternate location for after school care, or the Marblehead YMCA, which has an accessible basketball court. Silva stated that the installation of the LULA is also proposed within the next five(5) years. The LULA is estimated to cost approximately $80,000.00. (Exhibit 1 and 2, and Testimony of Silva and Fields). 4) The lowered activity room in the basement level is the main activity room and is located 5 inches below I the level of the rest of the basement. The Petitioners propose to create a 5 foot ramp once the LULA is installed to create full access to this portion of the Y. (Exhibit 2 and Testimony of Silva and Fields). 5) There is currently not a compliant handrail extension at the bottom of one of the stairs to the basement. The Petitioners propose to complete this work once access is created to the basement level. (Exhibit 1 and 2, and Testimony of Silva and Fields). 6) There are two existing stairwells, primarily used as convenience stairs, do not have graspable handrails. The Petitioners propose to install compliant handrails at both sides of these existing stairs once funding is in place for similar work. (Exhibit 1 and 2 and Testimony of Silva and Fields). 7) Silva noted that the Salem YMCA is the smallest of the North Shore YMCAs, operating at a loss every year. He added that a large portion of the membership for this Y receives some sort of financial assistance to utilize the available services and amenities of the Salem YMCA. (Testimony of Silva). 8) There is a 14 inch raised platform in one of the small activity rooms that can be used as a play stage. The stage is approximately 7-8 feet deep and 15 feet across. The Petitioners noted that the room is too small to support a compliant ramp and it is not anticipated that access to the elevated area would limit participation in any activity. Alternatively, the Petitioners could remove the stage; however, Fields noted that they are unsure as to if there are any mechanical services or structures located under the stage. Fields stated that these activity rooms were not currently accessible based on the lack of vertical access to this level of the YMCA. (Exhibit 1 and 2 and Testimony of Silva and Fields). 9) The Essex Street entrance to the building is a historic entrance which has been reopened for theater use and connects Essex Street to the theater, located 14 feet above the street, at the top of a grand marble staircase. The Petitioners noted that due to the location of Salem Housing Authority's offices, they are unable to install an elevator or lift at this location. Fields noted that they are proposing to use the main YMCA entrance at Sewall Street(adjacent to the accessible parking), with signage directing people approaching the theater entrance to the accessible entrance along Sewall Street. Silva noted that staff will also be at the Essex Street entrance during performances to direct people to the accessible Sewall Street entrance. Fields stated that the distance between the two entrances was approximately 100 feet. (Exhibit 1 and 2, and Testimony of Silva and Fields). 10)The preschool entrance is located 15 feet from the main lobby entrance with the threshold to the entrance being 6 inches above grade and located directly on the sidewalk. The Petitioners propose to provide access into the preschool daycare area via the main accessible entrance. Silva noted that the main reason that the preschool entrance was separate from the main entrance was due to the adjancent teen drop-in center located in the same area. He added that although the teen drop-in area is located in the basement, it will eventually be accessible. (Exhibit 1 and 2, and Testimony of Silva and Fields). 11)There is a 6 inch threshold at the existing saunas in the men's and women's locker rooms, with doors only 20 inches wide. The saunas are only 6 feet by 8 feet and cannot be retrofitted to have the appropriate clearances within the room. There is an accessible steam room in each locker room, but not enough space to make new accessible saunas. Fields noted that the saunas are at least 37 years old. He added that an accessible sauna would take up a larger footprint and would create an issue with the paths of travel within the locker rooms. (Exhibit 1 and 2, and Testimony of Silva and Fields). 12)There three(3) existing doors with inadequate maneuvering clearances provided. The office area door to the preschool has 4 inches of push side clearance, but is generally propped open. Silva noted that this door was used to control the flow of teens going from the drop-in center to member-only areas of the YMCA,but was rarely closed. There is an egress only door located next to the large pool that does not have the required push side clearance to exit out to grade. There is also an egress only door that does not have the required pull side clearance from inside the egress stair, since it would be again the egress direction. (Exhibit 1 and 2, and Testimony of Silva and Fields). 13)The Zumba level is not currently accessible. Fields noted that the Zumba level is 54 inches below the major exercise room, adding that a ramp down to this level would take up a quarter of the room. Silva stated that all of group exercise classes currently happen in this location, but that once the small pool is covered, three (3) additional exercise studio spaces will be created.. Currently there are no alternate accessible studio spaces for group fitness classes. (Exhibit 1 and 2, and Testimony of Silva and Fields). I Analysis The Board established jurisdiction pursuant to 521 CMR 3.3.2, which states that, "[i]f the work performed, including the exempted work, amounts to 30%or more of the full and fair cash value (see 521 CMR 5.00)of the building the entire building is required to comply with 521 CMR." The Petitioners state in their"summary"document on AAB 10 that the cost of the work of the Ames Hall Theater balcony has gone over 30%of the full and fair cash value of the building; therefore, the building is required to be brought into full compliance with all applicable sections of 521 CMR. Upon reviewing the submitted documentation and testimony, the Board voted to grant a five (5) year time variance to allow until December 31, 2018 for the following items to be brought into compliance: small pool level access; basement/kids' locker room/ basketball court level access; access to the lower level activity room at basement; handrail extensions at the bottom of the basement stairs; and compliant handrails at the two existing convenience stairwells. A written accommodation policy for any area of the YMCA that will not be accessible and how people seeking services provided at those locations will be accommodated shall be submitted to the Board within 60 days receipt of this decision of the Board. The Petitioners shall also submit status reports every six (6) months, with the first to be received by the Board no later than June 1, 2014. The Board also requires that once received, reviewed and approved by the Board, the accommodation policy shall be included in the parent handbook, as proposed by the Petitioners. The stage is approximately 7-8 feet deep and 15 feet across. The Petitioners noted that the room is too small to support a compliant ramp and it is not anticipated that access to the elevated area would limit participation in any activity. Alternatively, the Petitioners could remove the stage; however, Fields noted that they are unsure as to if there are any mechanical services or structures located under the stage. Silva noted that the stage is part of the existing afterschool space. Fields stated that these activity rooms were not currently accessible based on the lack of vertical access to this level of the YMCA. Upon reviewing the submitted documentation and testimony, the Board voted to deny the variance requested for the lack of access onto the stage. Therefore, the Petitioners are required to either remove the stage or submit a plan for an alternate accessible stage within the afterschool area of the basement level, with the submittal of said information to be part of the first status report, due to the Board on June 1, 2014. The Essex Street entrance to the building is a historic entrance which has been reopened for theater use and connects Essex Street to the theater, located 14 feet above the street, at the top of a grand marble staircase. The Petitioners noted that due to the location of Salem Housing Authority's offices, they.are unable to install an elevator or lift at this location. Fields noted that they are proposing to use the main YMCA entrance at Sewall Street(adjacent to the accessible parking), with signage directing people approaching the theater entrance to the accessible entrance along Sewall Street. Silva noted that staff will also be at the Essex Street entrance during performances to direct people to the accessible Sewall Street entrance. Fields stated that the distance between the two entrances was approximately 100 feet. Upon reviewing the submitted documentation and testimony, the Board voted to grant the variance for the existing Essex Street entrance, on the condition that signage is provided directing people to the accessible entrance, and that staff is available during theater events for added directional support. The variance is only applicable as long as the YMCA does not have control of the adjacent property (now owned/occupied by the Salem Housing Authority). The preschool entrance is located 15 feet from the main lobby entrance with the threshold to the entrance being 6 inches above grade and located directly on the sidewalk. The Petitioners propose to provide access into the preschool/daycare area via the main accessible entrance. Silva noted that the main reason that the preschool entrance was separate from the main entrance was due to the adjacent teen drop-in center located in the same area. He added that although the teen drop-in area is located in the basement, it will eventually be accessible. Upon hearing the submitted testimony and reviewing the submitted documentation, the Board voted to I grant the variance regarding the lack of access to the preschool entrance, based on the testimony that the preschool is accessible from the main accessible entrance as well. The Board also voted to require that the Petitioners submit more information regarding where a teen unable to access the existing lower level drop-in area will be accommodated, with said information to be submitted with the first required status report, to be received by the Board no later than June 1, 2014. There is a 6 inch threshold at the existing saunas in the men's and women's locker rooms, with doors only 20 inches wide. The saunas are only 6 feet by 8 feet and cannot be retrofitted to have the appropriate clearances within the room. There is an accessible steam room in each locker room, but not enough space to make new accessible saunas. Fields noted that the saunas are at least 37 years old. He added that an accessible sauna would take up a larger footprint and would create an issue with the paths of travel within the locker rooms. There three (3) existing doors with inadequate maneuvering clearances provided. The office area door to the preschool has 4 inches of push side clearance, but is generally propped open. Silva noted that this door was used to control the flow of teens going from the drop-in center to member-only areas of the YMCA, but was rarely closed. There is an egress only door located next to the large pool that does not have the required push side clearance to exit out to grade. There is also an egress only door that does not have the required pull side clearance from inside the egress stair, since it would be again the egress direction. Upon reviewing the submitted documentation and testimony, the Board voted to grant the variances requested for the lack of maneuvering clearances at the three (3)doors in question (office area to preschool, egress door at large pool, and egress door at fitness level stair). The Zumba level is not currently accessible. Fields noted that the Zumba level is 54 inches below the major exercise room adding that a ramp down to this level would take up a quarter of the room. Silva stated that all of group exercise classes currently happen in this location, but that once the small pool is covered, three (3) additional exercise studio spaces will be created. Currently there are no alternate accessible studio spaces for group fitness classes. Upon reviewing the submitted testimony and documentation, the Board voted to grant the variance requested for the lack of access to the Zumba room level, on the condition that a policy is in place regarding an alternate accessible location for group exercise classes, and that said policy is submitted to the Board within 60 days receipt of the decision of the Board. Conclusion After reviewing the matter,the Board voted as follows: - GRANT a five(5) year time variance to allow until December 31, 2018 for the following items to be brought into compliance: small pool level access; basement/kids' locker room /basketball court level access; access to the lower level activity room at basement; handrail extensions at the bottom of the basement stairs; and compliant handrails at the two existing convenience stairwells. A written accommodation policy for any area of the YMCA that will not be accessible and how people seeking services provided at those locations will be accommodated shall be submitted to the Board within 60 days receipt of this decision of the Board. The Petitioners shall also submit status reports every six (6) months, with the first to be received by the Board no later than June 1, 2014. The Board also requires that once received, reviewed and approved by the Board, the accommodation policy shall be included in the parent handbook, as proposed by the Petitioners. - DENY the variance requested for the lack of access onto the stage. Therefore, the Petitioners are required to either remove the stage or submit a plan for an alternate accessible stage within the afterschool area of the basement level, with the submittal of said information to be part of the first status report, due to the Board on June 1, 2014. - GRANT the variance for the existing Essex Street entrance, on the condition that signage is provided directing people to the accessible entrance, and that staff is available during theater events for added directional support. That there is overwhelming community support for this petition and that eight (8) people spoke in favor of the petition, including representatives from the Salem Chamber of Commerce and the Salem Partnership Association. 8. There is an auditorium on the second floor . There is a weight-lifting room in the basement . The swimming pool is in an addition, about six steps down from the first floor. There are approximately four steps up from the first floor to the gym. An elevator would not be able to service the pool . The locker rooms for the pool are on another level . Women ' s locker rooms are approximately 10 steps down from the first floor. The first floor is one step up from grade. The first floor will be accessible when the primary entrance is ramped . The pool area would have to be made accessible. Locker rooms would have to be made accessible . The petitioner noted that Salem State College is approximately 5 minutes away from the Y.M.C.A. and has recreational facilities which are probably accessible. The Board advised the petitioner that this building should be made as fully accessible as possible, including the primary entrance, elevators, toilets, etc . A. , in reference to the reinstallation of y4 the Sauna unit at this location. The Sauna unit caused a fire on Feb. 2, 1979 by igniting the beam and floor joists situated directly under the unit. The unit was in place for approximately 12 years, before the heat transmission to the wooden beam reached the stage where fire occurred. As a result of a verbal conversation by our Salem Building Inspector with your office, it was stated that sauna units apparently do not come under any definition for a heating unit currently within the Mass. State Building Code. This is the reason for issuing the notice enclosed for reinstalling the unit, after agreement with the Salem Building Inspector. If You will issue me a written statement that the sauna unit would ' be more appropriatly considered a part of the contents of the structure, I will initiate as Secretary of the Massachusetts Fire Prevention Association] a request for a Fire Prevention Regulation to be made covering this type of installation. As you may have heard , just two days later the Woburn Fire Dept. had a two alarm fire in the Ramada Inn, caused by a Sauna installation. Emergency lighting must be provided within the room as well as along both means of egress to grade, (The ornamental stairway cannot be considered a means of egress.) 2. "EXIT" signs must be provided along the path of egress, too clearly show the egress discharge. These signs must be red on white or white on red with six (6) inch letters. 9. A door closer must be provided on the door at the top of the stairway leading from the desk to the second floor hell. 4. All chemical extinguishers must be wall hung and their location clearly marked. Please contact Inspector William Munroe of this Department for a r*oinspection AM corrections have been made.
