Dear Councillor O'Leary:
As per our conversation and your letter of October 6, 1987,
I have investigated the filling of land located at 6 Seemore Street
and the City Ordinances that pertain"to this matter.
As you are aware, the property owner is working with the Con-
servation Commission, the Planning Board and the Engineering Dept.
with regards to obtaining the necessary drainage alteration permit
required under Artical VI Section 26-170 of the Salem Code of Ordinances.
In addition to Section 26-170, I have reviewed Section. VII, Sub
Section F, Removal of Earth Products. The second paragraph of the Section
states a "Special Permit" is not necessary when the quarrying is in-
cidental to contruction involving a permanent change in the use of the
land as is the case with both properties involved in this matter.
I have enclosed copies of both ordinance sections for your
review.
