permit , in particular numbers one thru five on page two of your July 18, 1988
Letter to Mr. Fleming.

and shall be on permanent plates attached to the annunciator
with permanent screws or rivits which cannot be easily
removed. Back:-lighted designations and graphic annunciators
are acceptable.
E. A Square D # 9001KEIIK.' silence alarm key operated switch is
required, and shall be located at the annunciator or at the
fire alarm panel . A remote trouble buzzer is required at
the annunciator to indicate that the system has been
silenced by means of the silence alarm switch.
4. A master fire alarm box , where required, shell be installed on
the exterior of the building, or as directed by the City
Electrician. A blank: door may be specified, and the code
designation shall be provided by the City Electrician.
5. All electrical wiring shall be subject to the approval of the
City Electrician.
o. Final Approval and Inspection:
A. Upon completion of the installation, the licensed
electrician/installer shall request an appointment for a
final test and inspection.
B. Appointments for the testing shall be made at least 72 hours
in advance with the Fire Prevention Bureau. The installer
shall have tested the entire installation prior to
inspection by the Bureau. All appointments are subject to
cancellation for fire department emergencies. The installer
shall provide an employee to reset the panel and system
during the test.
C. Upon completion of a satisfactory test, a Certificate of
Compliance will be issued by the Fire Prevention Bureau.
7. Maintenance:
A. A maintenance program shall be established by the owner of
the system.
B. A written maintenance report shall be filed with the Fire
Prevention Bureau on an annual basis. If such system is
connected to the municipal fire alarm system, the
maintenance inspector shall also file a report with the City
Electrician.
C. Failure to file reports on the condition of a system as
required shall constitute a violation of the Fire Code, and
such further action, as the law permits, shall be taken.

2. OPIU M '= and Permit:
A. An application shall be filed with the Fire Preventicn
Bureau, by a licensed electrician, prior to starting any
work on a fire alarm system.
B. A fee of ten dollars shall accompany each application.
C. Upon approval of the plans submitted, or the listing of the
items to be installed, a permit shall be issued for the
installation of fire alarm devices, subject to obtaining a
permit from the Salem Electrical Department.
D. Three sets of plans are required to be submitted with the
application, for stamped approval by the Fire Prevention
Bureau.
E. Two sets of stamped/approved plans will be returned to the
applicant together with the permit to start wort::. In the
event plans are not approved, a written report will be
forwarded to the applicant, stating the deficiencies, and
requesting a conference to correct any items which appear
unsatisfactory.
F. The Fire Prevention Bureau shall be allowed up to ten
working days to review plans, as per Section 11.=. 5 of the
Massachusetts State Building Code.
Levels cf Protection and Location of Devices:
A. All automatic fire alarm systems consisting of manual pull
stations, audible/visual devices, master fire alarm box
(where deemed necessary) , smoke detectors, heat detectors,
or other devices and/or equipment shall be installed as
directed by the head of the fire department, or his
designee, unless specifically set forth as to type of device
by the Massachusetts State Building Code.
B. Locations of all devices shall be subject to approval by the
head of the fire department or his designee.
C. Zoning _hall be required when, in the opinion of the head of
the fire department, or his designee, the area to be
protected is sufficient in size to require a breakdown of
area by floor or building. Sprinkler systems may require
additional zoning.
D. An annunciator panel shall be provided in the front entry of
all structures if zoning is required. Identification of
each :one shall be customized to apply to the area served,

SALEM FIRE PREVENTION REGULATION #15A
RULES AND GUIDELINES FOR THE INSTALLATION AND APPROVAL OF AUTOMATIC
FIRE ALARM DEVICES AND SYSTEMS, FOR OTHER THAN RESIDENTIAL
OCCUPANCIES, AND APPLICABLE WHEN STRUCTURES ARE SUBSTANTIALLY ALTERED,
FOR NEW CONSTRUCTION, AND WHEN A CHANGE OF USE GROUP CLASSIFICATION IS
PLANNED.
Under the authority granted by the General Laws of the Commonwealth of
Massachusetts, and in compliance with the provisions of Article 4 and
Article 12 of the Massachusetts State Building Code, the following
rules and guidelines are established to assist property owners,
contractors, and installers, with the installatioin and approval of
fire alarm devices and systems.
1 . Definition=_:
A. use Groups: As defined in the current edition of the
Massachusetts State Building Code.
B. Approved Smoke Detector: An approved device, which detects
C visible or invisible products of combustion. Approved smoke
detectors must be permanently wired and connected to a fire
alarm panel .
C. Aparoveo Heal Detogtore An approved device which detects
abnormally high temperatures or increased rate of
temperature rise, or a combination of both. Approved heat
detectors shall be permanently wired, connected to a fire
alarm panel , and shall activate an audible/visual alarm
device.
D. Common Hallways: A common corridor or space, separately
enclosed, which provides common access to or through the
required e:;itways of the structure.
E. Mechanical and Electrical Looms: Any space designated to
contain mechanical , electrical , transformer, telephone, or
elevator equipment.
F. Utility Room: Any common use area consisting of over one
hundred square feet, which by its use would contain

Dear Mr. McIntosh:
With regard to the proposed construction at #396 Highland Avenue by
Mr. Stasinos, the fallowing is noted:
1. A manual pull station must be added to the front door area of
each unit.
2. The location of the master fire alarm box is to be moved to
the front of the building at one of the "C" units (as indicated
on the plan).
3. The annunciator panel for the fire alarm system is to be located
in the front of the "C" unit as shown on the plan.
4. Exit signs are to be placed at the rear means of egress to
each unit.
5. The zoning configuration for the fire alarm system is to be
indicated on the plan.
6. A zone shall be provided as to indicate activation of the
sprinkler system.
7. The fire department connection to the sprinkler system, and the
alarm bell are to be relocated to the front of the building.
8. An "inspectors' test" with guage is to be located at the end
of the branch furthest from the sprinkler valve.
9. A key lock box shall be located on the front of the building
near the fire alarm box.
and shall be on permanent plates attached to the annunciator
with permanent Screws or r. vits which cannot be easily
removed. Back-lighted designations and graphic annunciators
are acceptable.
E. A Square D #?OVSKSiiF::.' silence alarm Frey operated switch is
required, and shall be located at the annunciator or at the
fire alarm panel . A remote trouble buzzer is rsquired at
the annunciator to indicate that the system has been
=_silenced by means of the silence alarm switch.
4. A master fire alarm box , where required, shall be installed on
the exterior of the building, cr as directed by the City
Electrician. A blank door may be specified, and the code
designation shall be provided by the City Electrician.
5. All electrical wiring shall be subject to the approval of the
City Electrician.
o. Final Approval and Inspection:
A. Upon completion of the installation, the licensed
electrician/installer shall request an appointment for a
final test and inspection.
B. Appointments for the testing shall be made at least 72 hours
in advance with the Fire Prevention Bureau. The installer
shall have tested the entire installation prior to
inspection by the Bureau. All appointments are subject to
cancellation for fire department emergencies. The installer
shall provide an employee to reset the panel and system
during the test.
C. Upon completion of a satisfactory test, a Certificate of
Compliance will be issued by the Fire Prevention Bureau.
7. Maintenance:
A. A maintenance program shall be established by the owner of
the system.
B. A written maintenance report shall be filed with the Fire
Prevention Bureau on an annual basis. If such system is
connected to the municipal fire alarm system, the
maintenance inspector shall also file a report with the City
Electrician.
C. Failure to file reports on the condition of a system as
required shall constitute a. violation of the Fire Code, and
such further action, as the law permits, shall be taken.
e. Certificate of Occupancy:
11. The parties agree that this Agreement to convey the premises to the
BUYER is personal to him and may not be transferred to any other party without
SELLER's written consent.
12. The BUYER acknowledges that any site or other work he may have
done on the premises at any time has been at his sole risk and expense. He agrees
to indemnify and hold harmless the SELLER from any liability and expense (including
reasonable attorney's fees) from any claim by any person on account of said work.
If BUYER fails to perform this Agreement, any structures and all improvements
made to or upon the premises shall become the property of the SELLER with no
obligation by SELLER to pay for same.
13. BUYER agrees to pay the reasonable attorney fees of SELLER'S
Counsel, up to a limit of $1100.00, connected with preparation and negotiation of
this purchase and sale agreement.
14. All covenants contained in this Addendum shall survive closing. If any
provisions of this Addendum conflict with any provisions of the Agreement, the
provisions of this Addendum shall control.
15. Seller has agreed to execute in triplicate a form entitled "Application
For Permit, The Commonwealth of Massachusetts, Department of Public Works, 100
Nashua Street, Boston Massachusetts, 02114 Mnt # 170" concerning certain
construction work for a commercial driveway to be undertaken by the
Commonwealth on the Seller's land. The parties agree that Seller shall bear no
responsibility for (and Buyer shall indemnify Seller for) any cost or expense arising
from his signing said form, which the parties agree has been done for the
convenience of the Buyer.

ADDENDUM TO
PURCHASE AND SALE WREEMENT (the, "Agreement")

MIKE STASINOS
1. BUYER shall by 5:00 p.m. E.S.T. on December 14, 1984, undertake a
review of all title matters regarding the premises (the "Review Period"). If BUYER
is dissatisfied for any reason whatsoever with the results of such examination,
BUYER shall have the option to terminate this Agreement at any time prior to the
expiration of said Review Period, by written notice of termination to SELLER,
whereupon this Agreement shall terminate, any Deposit (but not any interest), shall
be returned to BUYER, and all rights, obligations and liabilities of the parties
hereunder shall be released and discharged; provided, however, if BUYER fails to
give such notice within the Review Period, BUYER's right of termination under this
paragraph shall be deemed to have been waived and any Deposit and all interest
thereon shall become non-refundable and the property of SELLER.
Notwithstanding the foregoing, and except for title matters referred to in
Article 3 of this Addendum, SELLER shall be obligated to make reasonable efforts
to cure at or prior to Closing, any objections to title created by SELLER during his
period of ownership of the premises which BUYER gives SELLER written notice of
during the Review Period or which arise subsequent to the Review Period. If
SELLER is unable to so eliminate or cure all such objections to title, and provided
BUYER shall not thereafter waive such requirements, BUYER shall have the right to
cancel this Agreement and recover any Deposit and all interest earned thereon and
SELLER shall have no further liability on account of damages arising out of title
matters.
2. Unless BUYER cancels this Agreement pursuant to Article 1 of this
Addendum, the BUYER agrees to reimburse SELLER at closing for all real estate
taxes paid by SELLER in respect of the premises for any period subsequent to
January 1, 1984. BUYER shall additionally be responsible for paying all taxes
subsequent to Closing.
3. BUYER agrees to be responsible for performing any obligations (insofar as
in force and applicable) of SELLER which may have arisen under the deed recorded
in the Essex South District Registry of Deeds Book 5503, Page 121, or under an
instrument recorded in said Registry in Book 5503, Page 122 entitled "Covenant to
Construct a Way."
4. BUYER may enter the property for the purpose of construction of a
commercial building at his sole expense, and after obtaining appropriate permits
from all governmental agencies and complying with all provisions of law. If BUYER
fails to perform this Agreement, any structures and all improvements made to or
upon the premises shall become the property of the SELLER without any obligation
to pay for same. BUYER agrees to perform all work in a good and workmanlike
manner, free of all mechanics', materialmen's or similar liens. If any such liens are
asserted against the premises and not discharged or adequately bonded within five
(5) days after written notice from SELLER to BUYER, SELLER may cause any such
lien to be discharged or bonded for BUYER'S account and expense (including
reasonable attorney's fees incurred by SELLER in so discharging or bonding said
lien).
5. BUYER agrees to indemnify SELLER from all liability, cost and expense
(including reasonable attorney's fees in defending any claim) arising out of BUYER'S
activities on the premises which are the subject of this Agreement. BUYER further
agrees to obtain a public liability insurance policy naming SELLER as co-insured,
written on a responsible company qualified to write such insurance in :Massachusetts
with limits of not less than one million ($1,000,000.00) dollars per person, three
million ($3,000,000.00) dollars per occurrence for personal and bodily injury or death
and one hundred thousand ($100,000.00) dollars for property damage. BUYER shall
provide SELLER with reasonable evidence of said insurance before commencing any
work on the premises.
0. Prior to closing, the SELLER shall remove any existing stockpiles of fill
from the premises placed thereon by SELLER.
7. BUYER and SELLER mutually represent and warrant that they have dealt
with no broker or agent concerning this transaction, and each party agrees to
defend, indemnify and hold harmless the other party from and against all claims for
a brokerage commission arising out of this transaction by any broker who establishes
by court action a right to such a commission arising from his dealings with the
indemnifying party. Both parties shall have the right to participate in the defense
of any such action. The indemnifying party shall also pay reasonable attorney's fees
incurred by the other party in defense of any such claim.
8. The parties agree that SELLER may place any deposit in an interest
bearing account at a financial institution and that any interest earned on any
deposit held by SELLER shall belong to SELLER unless BUYER exercises his rights
to cancel the Agreement for, and only for, SELLER'S failure to eliminate or cure
any objections to title created by SELLER during his period of ownership of the
premises pursuant to paragraph 2 of Article 1 of this Addendum.
9. The balance of the purchase price payable at Closing shall be paid as
follows:
(a) shall be payable at
Closing in cash, bank or certified checks;
(b) shall be paid in the form
of BUYER'S promissory note with Mike Stasinos as maker or unconditional guarantor,
with interest only payable monthly at the rate of twelve percent (12.00%) per
annum on the unpaid principal balance, any unpaid interest or principal to be
payable on or before July 1, 1985; Said note shall be secured by a first mortgage on
the premises to SELLER or his nominee which shall be upon the Statutory Condition
and contain the Statutory Power of Sale and provide that transfer of the premises
by the Mortgagor without the consent of the Mortgagee shall be a default under the
mortgage.
10. The premises are conveyed without warranties of any kind and BUYER
acknowledges that BUYER has had an opportunity to inspect the premises.

AFFIDAVIT
Now comes William H . Munroe who deposes and states as
follows :
1 . I am the current Building Inspector for the City of Salem
and I am familiar with the incomplete strip mall located at
400 Highland Avenue, Salem, Massachusetts .
2 . Any and all building permits pertaining to said strip mall
have expired and said strip mall is unused, uninhabited ,
abandoned, open to the weather and in violation of the State
Building Code, 780 C.M.R. 123 . 0 .
3 . I have determined said strip mall to be a danger to public
safety and unsafe as defined in the State Building Code.
4 . Since it has come to my attention that adolescents are
congregating in and around said strip mall and thereby
endangered, the strip mall should be demolished pursuant to
the State Building Code , 780 C .M.R. 123 .
