DECISION ON THE PETITION OF ENDICOTT REALTY TRUST FOR VARIANCES
FOR 203-209 ESSEX ST.
A hearing on this petition was held July 29, 1987 with the following Board
Members present: Janes Hacker, Chairman; Messrs. , Bencal, Fleming, Luzinksi and
Associate Member LaBrecaue. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property.. is requesting Variances from density, setbacks
and parking to allow two stories to be added' to the existing building known as
the Newmark Building. Said building to be used for a mixed commercial and
residential use in this B-5 district.
The Board of Appeal, after hearing evydence, and at the renuest of the petitioners
Counsel, Attorney Roger Soderberg, voted unanimously, 5-0, to allow petitioner
Leave to Withdraw Without" Prejudice.

Re : Renovation of the Newmark Building
Dear Sirs :
I have reviewed with Steve Ingemi, his proposed plans for
the renovation of the Newmark Building on Essex Street, which
will include the addition of 2 floors to the existing building,
containing 14 condominium units . I believe that the planned
improvements to the Newmark Building is an exciting addition to
downtown Salem and will greatly contribute to the
revitalization of the City. I urge the Board to grant Mr.
Ingemi the variances he has requested in his Petition to you .

Dear Mr. Hacker,
We, the undersigned Trustees of Central Plaza Condominium of 20 Central
St. , Salem, direct abbutters to the building located at 203-209 Essex St. ,
Salem, wish to record strong opposition to the granting of variance from
density, setbacks and parking to Endicott Realty Trust for the construction
of two story addition to 203-209 Essex Street for the following reasons:
1. The area is presently very congested with little open space - there is
approximately 16 feet between the building in question and Central Plaza.
The added height of the proposed two story addition would reduce the
natural light and the openness of the entry to our building from Derby
Square. The added height may also have adverse effect on wind currents
especially during northeast storms.
The additional traffic that would be generated by the proposed addition
would add to the congestion of the area. Delivery and service vehicles
servicing the building have no place to park and would likely block Essex
Street and Derby Square creating nuisance, inconvenience and danger to
pedestrians and to residents of Central Plaza. We are also fearful that
rubbish removal operations may occur during early hours and would create
a nuisance to the residents fo Central Plaza.
2. Because of the congestion and the lack of space around the building, the
construction of the proposed addition would create undue hardship and danger
to the residents of Central Plaza. Construction operations would also
result in damage to our property.
3. The proposed addition would create a financial hardship on the owners of
Central Plaza: The value of the property would be adversely affected and
the condominiums would be virtually unmarketable during the expected long
construction period.
4. Lack of parking for the project will add to the already parking problems
in the downtown area.

5. We believe that denial of requested variances ces would not create a hardship
to the owners of the building. The building is currently of sufficient
size to be financially viable if properly cleaned up and updated.
The granting of requested variances would not benefit the City of Salem in
any way, it would only create problems for the downtown area and its
residents. We therefore urge the Board of Appeals to deny the application
for variance.

Hearing date: July 29, 1987
The property located at #203-209 Essex Street has no current compliance
with the provisions of Chapter 148, Section 26E, Massachusetts General
Laws, relative to the installation of automatic smoke detectors.
The Salem Fire Department has no objection to the granting of Variances
to allow the addition of two stories to this property to allow for mixed
commercial and residential use subject to the following conditions:
1. Plans for the proposed construction are presented to the Fire
Prevention Bureau for approval prior to the issuance of a
building permit.
2. The proposed construction shall conform to all applicable
provisions of the Massachusetts State Building Code, 527 Code of
Maaaachusetts Regulations, the Salem Fire Prevention Code, the
Salem City Ordinances, and Massachusetts General Laws, relative
to fire safety.
3. The applicant shall arrange for an inspection by the Fire
Prevention Bureau upon completion of the work.
