A hearing on this petition was held on July 27, 1983 wroth�, he--.following Board
Members present: James Hacker, Chairman; Messrs. , Hopper, Luzinski, and Associate
Member Bencal. Notice of the hearing was sent to abutters and others and notices
of the hearing were published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioners are requesting a Special Permit to convert to a seven unit condominium
and a Variance from minimum parking requirements in this R-2 district_ : The property
also house three businesses.
This proposed condominium conversion is covered by the terms of the City's
Condominium Conversion Ordinance. The Special Permit that has been requested may
therefore be granted only upon a finding by the Board of Appeal that (1 ) the grant
of the Special Permit will not adversely impact upon the City's existing stock of
rental units for low and moderate income families and elderly people on fixed
income, (2) that the grant of the Special Permit is not contrary to the City's
Master Plan, and (3) the grant of the Special Permit will not have an adverse
effect on the neighborhood.
The Board of Appeal, after consideration of the evidence presented at the public
hearing and after viewing plans of the property, makes the following findings of
fact:
1 . No opposition to petitioner's plan was raised by neighbors;
2. Notice requirments of Section V-B (12) (6) have been met;
3. Petitioners plan will not have any negative impact on the existing
rental units in the City for families of low and moderate income
or for elderly people on fixed income;
4. Petitioners plan will not have a negative impact on the neighborhood;
5. No significant hardship to existing tenants in the building will be
caused by petitioner's plan;
6. Petitioners plan is not in conflict with the Master Plan of the city..
With respect to the petitioner's request for a Variance, the Board of Appeal
finds as follows:
1 . The desired relief can be granted without substantial detriment to
the public good.
On the basis of the above findings of fact, and the evidence presented at the
public hearing, the Board concludes as follows:

1 . The proposed conversion of the property to condominium units will not
be substantially more detrimental to the neighborhood than the existing
use of the property.
Therefore, the Board of Zoning Appeal voted unanimously in favor of granting the
Special Permit and Variance. The Board granted the Special Permit and Variance
under the following terms and conditions:
1 . Petitioner may convert the premises to a seven unit condominium ownership
and the use of the three businesses on the premises may be continued;
2. The six months waiting period for occupancy shall be waived;
3. The minimum parking requirements shall be waived;
4. A Certificate of Occupancy and Use shall be obtained for each unit
prior to the occupancy of any unit.
