parking in the front yard immediately.
Failure to comply with these orders will result in Municipal Code Tickets and a

Dear Mr. and Mrs. Boga:
Over the past several months, we have been observing the construction activities taking
place at your residence and have made comments as to the adequacy of the work, and
suggestions as to how to tike care of isolated problems, having been retained by you to do
so. We were to specifically address concerns expressed to you by the Salem Building
Department and which you related to us verbally.
We to provide you with a letter of completion of completion after you satisfactorily finished
your work that you would submit to the building department for an occupancy permit.
During the work, we made several comments that you incorporated and provided you with
calculations for the various members of the primary framing system. Please note that we
did not, however, review every single connection and minor framing member, as this was
beyond the negotiated scope of our work and hourly budget. Also, during this period, we
repeatedly requested a meeting with the Salem Building Department and you stated that
you would not pay us for such a meeting and that we should simply proceed without their .
input.
Having been the second structural engineering firm on the project (the first one having
been fired), it was imperative that we talked with the building department in order to
understand the nature of their concerns, and to understand the history of the project (i.e.
what was done, what was not). This was necessary for us to effectively do our job, and
we stated to you as much.
Sometime in February, we did contact the building department and were made aware of
several of their concerns regarding nailed cleats on beams and the foundation work. After
relating these to you, you also fired us., On the following day you re-hired us and asked
us to complete our work.
In the beginning of this month we performed another inspection and noted several items

that needed correction, all of which were described to you verbally. One of these was the
need for additional blocking and/or nailing on the nailers on each side of the main beam
at the basement level. We were concerned that cross-grain tension would cause these to
split down the middle as they were nailed to the main beam at the top and to the joist
hangers at the bottom. You then stated that there would be a structural bearing wall built
below this beam but only along part of its length.
I then discussed the project with the building inspector and stated that the work was
nearing completion and that within one week's time all of the work should likely be done.
Based upon this conversation, the building inspector visited the site and issued a certificate
of completion for the framing, having felt assured that this subsequent work would be
completed.
We then contacted you to appraise ourselves of the status of this final item, and you stated
that since you had received the certificate of completion from the building department, you
did not have to do any more work. When we insisted upon its importance, you became
belligerently angry and fired us for the second timet_ You also stated that you had another
engineer that would "take care of" you.
Please be advised that in our opinion, additional support still needs to be provided at the
first floor level. This can be in the form of added full height plywood cleats or gussets
nailed to reinforce the nailers between the joist ends as discussed, or a bearing wall with
an accompanying footing beneath each of the nailers.
We will be sending you an invoice for work provided until our point of termination under a
separate cover.

School Street, Salem, Massachusetts, and the owner has ignored our recommendations, we
hereby withdraw from said project.
Please be advised that this firm - due to the owner's disregard for our design - is no longer
providing the following services:
• Structural engineering design of beams, framing, and foundation
Due to the fact that the owner has indicated that he will not cooperate with our requirements,
we can not continue in a position of responsibility for the conformance to the State Building
Code and proper construction practice.
If you require additional information, please advise.

I CHECKED OUR ORDINANCES, CITY MANUALS,AND DISCUSSED THE SITUATION
WITH TIM FLYNN AND MIKE COLLINS AND FOUND THESE ANSWERS:
ORDINANCES
• A PLUMBING PERMIT TO REPLACE A WATER PIPE IS REQUIRED AT A COST OF$20.00.
• A STREET OPENING PERMIT IS REQUIRED TO DIG UP THE CURB STOP-$100.00 PLUS A
$100 DEPOSIT AND A$5000 BOND.
• A BONDED DRAINLAYER OR MASTER PLUMBER IS REQUIRED TO PULL THE PERMIST
AND TO DO THE CONNECTION AT THE CURB STOP.
TIMFLYNN:
WHEN THERE IS A COMPLAINT OF LOW PRESSURE AND THERE IS NO SUSPECTED
SYSTEMIC CAUSE IT IS DEPARTMENT POLICY TO REQUIRE THE HOMEOWNER TO
REPLACE HIS WATER SERVICE AS A FIRST STEP. IF THERE IS INADEQUATE PRESSURE
THEN THE CITY WILL REPLACE THE SERVICE FROM THE MAIN TO THE CURB STOP
INCLUDING THE CURB STOP IF NECESSARY.
STAN SPOKE TO ANTONIO YESTERDAY AND TOLD HIM THIS. TIM BELIEVES THAT
ANTONIO TRIED TO MAKE HIS OWN CONNECTION AND SCREWED IT UP.
