DECISION ON THE PETITION OF MARYANNE PANTELAKIS, TR. FOR VARIANCES AT
27 NORTH STREET (R-2)
A hearing on this petition was held November 16, 1989 with the following
Board Members present: James Fleming, Chairman; Messrs. , Febonio, Luzinski,
Nutting and Associate Member Dore. Notice of the hearing was sent to abutters
and others and notices of the hearing were properly published in the Salem
Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner is requesting Variances from use and parking to allow first floor
of 27 North Street to be used as a professional office. (R-2)
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other lands, buildings and structures in the same district; .
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
C. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at
the hearing, and after viewing the plans, makes the following findings of fact:
1. No opposition was present.
2. This variance would enhance the use of the property.
3. The use of the first floor as a professional office would not affect the
parking in that area.
On the basis of the above findings of fact, and on the evidence presented,
the Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject property
but not the district generally;
2. Literal enforcement of the providions of the Zoning Ordinance would
work a substantial hardship on the petitioner;
3. The relief requested can be granted without substantial detriment to
the public good and without nullifying or substantially derogating from
the intent of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0 to grant the
Variances from use and parking to allow first floor of 27 North Street to
be used as a professional office subject to the following conditions:
1. All requirements of the Salem Fire Department be strictly adhered to.
2. A Certificate of Appropriateness be obtained from the Historical
Commission.
3. Only the first floor to be used for professional offices, the other
four units are to be kept as residential area (2-3 floor) .
4. That four legal parking permits be maintained.
5. Post a "NO PARKING" sign prohibiting your clients from parking at
85 Federal Street (Murphy's Funeral Home) .

Gentlemen:
It has been brought to my attention that a petition has
been submitted by Maryanne Pantelakis for—yar-i-ances from use
and parking to allow the first floor of 27 North-St. , (R2 ) to
be used for a professional office. IV.
I do not oppose said variance on the condition that the
variance be subject to the following conditions:
1. The owners or Trustees of 27 North St. use their best
efforts that no clients, residents, employees or
others with interest in 27 North St. utilize the
parking facilities located at 85 Federal Street which
abuts 27 North St.
2 . The owners or Trustees of 27 North St. post a sign on
the entrance of 27 North St. which clearly expresses
that parking is not alowed in the facilities located
at 85 Federal St.
Maryanne Pantelakis has done a good job with a difficult
piece of real estate. She has improved the quality of the
structure and has paid careful attention to her tennants thus
improving the quality of the immediate neig r ood.

Please be advised that 27 North Street is located within the McIntire
Historic District. It has come to the attention of the Salem Historical
Commission that work has been conducted at the property without the receipt
of necessary approvals of the Commission. Therefore, the owner is in
violation of the Historic District Act. (See attached letter. )
The Salem Historical Commission believes that new City approvals should
not be obtained for a property while there are outstanding violations for
non—conformance of other City regulations. Therefore, the Commission
respectfully requests that no action be taken by the Board of Appeals on
the owner' s petition for variance until the owner resolves the existing
violation issues and receives necessary approvals for both the work already
performed and any work proposed to accomodate the change in use.

the building. As far as parking,I feel that there would be no appreciable
additions to the area.
