SAMIA FOR VARIANCES FOR R51 CANAL .ST./4 FLORENCE ST. , SALEM A Public Hearing on this petition was held July 24, 19lttn teyVp g Board Members present: James Hacker, Chairman; Messrs. , Chatt3s, ' GaiTthler; Strout and Associate Member Bencal. Notice of the hearing was se ? abutters and others and notices of the hearing were properly published in the S^alleexm Evening News in ._ s•, su accordance with Massachusetts General Law Chapter 40A. , „..:. :1 ... . is^- Petitioner requests a Variance to allow the premises, which are partly in a B-4 district, to be used either for warehousing, wholesale merchandise brokerage and storage, carpentry, woodworking and printing shops, or retail uses related to those uses. Petitioner also requests a Variance from parking requirements so that only a minimum of fourteen (14) spaces be maintained on premises. The property is owned by Saul Tanzer Trust, Nathan M. Tanzer, Trustee and is located in a B-4/R-2 district. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would in- volve substantial hardship, financial or otherwise, to petitioner; and c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after hearing the evidence presented at the hearing, makes the following findings of fact: 1 . No opposition was presented to the plan; 2. The size and shape of this lot, and the position of the building relative to the lot lines, are unique to the district. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1 . Special conditions affect this lot which do not generally affect the district; 2. Literal enforcement of the Zoning Ordinance would work a substantial hardship upon the petitioner; 3. The variance requested can be granted without substantial detriment to the public good and without substantially derogating from the intent and purpose of the Ordinance. r ' r.11`. ._ _ .i ._G . .. ^1 ti 1 i / ._ __ _ _ s-_. -fig-- .jr r ,_ . °. yAr•r 4ti i "4:yy . i it F I a , 'tri• '' { $ _ F j'a• 1 y rA +i . ` ; ' .. ; , ,. •.t -1 ' .,0 A. 3 a .. N ... c` , } ' ,' ..q ; N 7. ` _ .r _ r.: .rl ," ; 1 , M1 -' ,u , } • 47 ' Td__l r_ _ QF e - - a , N _. 1 ' O , A *0 \. . The Building Permit to erect the structure was issued by this department on May 19, 1978 and the Certificate of Occupancy, signifying that construction was complete was issued in December of 1978. Under Massachusetts General Laws Chapter 40A, Section 7, the statute of limitations on the building permit expired after six (6) years and on any zoning violations after ten (10) years. Regarding the fifty percent (50%) rule, Section VIII, Article D, -.of the City of Salem Zoning Ordinance states that "should a structure be destroyed by any means to an extent of more than fifty percent of its floor area at the time of destruction, it shall not be reconstructed except in conformity with the provisions of this Ordinance."
