A hearing onthispetition was held on January 21 , 1987, with the following
Board Members present: James Hacker, Chairman; Messrs. Fleming, Luzinski and
Strout.
Notice of the hearing was sent to abutters and others, and notices of the hearing
were properly published in the Salem Evening News in accordance with the provisions
of Massachusetts General Laws, Chapter 40A.
The petitioner, represented by City .Planner Gerald-Kavanaugh, is proposing to
subdivide the present 5.06 acre lot located at map 34 lot 475, Margin STreet
v into two (2) lots! Parcel A-2, (3.725 acres) will be retained by the current,
owner,: New England Power Company, Westborough, Massachusetts. Parcel A-1
x -( : 1 .337 acres) will be owned by the City of Salem, which will construct a new
police headquarters on said site. The petitioner is seeking Variances for lot
frontage for Parcels A-1 and A-2, and Variances for front yard depth and side

yard width for parcel A-1 , the location of the site is in an Industrial District_
*` The Variances which have been requested may be granted upon a 'finding of the
Board that:
a. Special conditions and circumstances exist whichespecially affect the
land, building or structure involved and which are not generally affecting
other lands, buildings or structures in the same district;
W b. Literal enforcement of the provisions of the Zoning Ordinance would involve
«t substantial hardship, financial or otherwise, to the petitioner; and .
C. Desirable relief may be granted sithout substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordiance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . No opposition to the petition was offered at the hearing.
2. The proposed site is the best location for the new police station.
3. If the requested Variances were not granted, the public safety needs
of the City cannot be met as desired.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
but not he district generally;
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship to the petitioner;

3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 4-0 to grant the
'Variances requested by the petitioner, subject to the following terms and
conditions:
r 1 . . That the new police headquarters ve constructed in accordance with the
plans submitted to the Board.
E2. That the petitioner obtain all necessary permits from the Building
Inspector.
3. That the new construction comply with the provisions of the Massachusetts
i ? State Building Code and the-City of Salem Fire Prevention Ordinances.
