DECISION ON THE PETITION CF GIOVANNA QUARTERONE FOR VARIANCE
AT 98 MARGIN STREET (R-3)
A hearing on this petition was held January 25, 1989 with the following Board
Members present: James Fleming, Chairman; Messrs. , Bencal, Nutting, Strout and
Associate LaBrecque. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts .General Laws Chapter 40A.
Petitioner, owner of the property is requesting Variances to allow the existing
deck and fence to remain in this R-3 district.
The Variances which have been requested may be granted upon a "finding of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented, and
after viewing the plan of land, makes the following findings of fact:
1 . Fence and deck are needed for privacy;
2. Topography of the land makes in unfeasible to locate the deck on any
other part of the lot.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
but not the district generally;
2. Literal enforcement of the Ordinance would work a substantial hardship
on the petitioner;
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district of the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted, 4-1 , to grant the variance to allow
the existing fence as requested. Mr. Bencal voted in opposition. The Board
of Appeal voted unanimously, 5-0, to grant the variance to allow the existing
deck as requested.

3 . That the Defendants, James M. Fleming, Richard
Bencal , John Nutting, Peter Strout and Arthur Lebrecque
were at the time the Application of Giovanna Quaterone
as hereinafter described, members of and did .constitute
the Board of Appeal of the City of Salem; and that
said Defendants at the time of the Application of
the Defendant, Giovanna Quarterone, was approved as.

4 '. That by application dated November 21 , .1988 and
filed December 1 , 1988, the Defendant,. Giovanna
Quarterone, applied to . the Board of Appeal of the
City of Salem for variances from the City of Salem
Zoning ordinance to allow the existing deck and fence
to remain at the property located at 98 Margin Street,
Salem, Massachusetts . Her application included the
following requests :

1 . A variance to permit the continued use of
a deck in violation of density regulations set
out in Section VI of the Salem Zoning Ordinance.
2 . A variance to permit the continued use of
a fence in violation of the height requirements
set out in Section VI of the Salem Zoning . Ordi-
nance .

as Exhibit "A" .
5 . That a public hearing was held on this
Application on January .25, 1989 , at which time the
Board voted four ( 4 ) in favor, and one ( 1 ) opposed ,
to grant the variance to allow the existing fence
as requested and voted five ( 5 ) in favor and no ( 0 )
opposed to grant the variance to allow the existing
deck as requested. A copy of that decision attested
to by the City Clerk is attached hereto as Exhibit
"B"
6 . That the above decisions of the . Defendant
Board is in excess of the powers granted to the members
of the Board by M.G. L. , Chapter 40A, Section 10 .
7 . That for all times relevant to the Application
and decision, the Plaintiffs were the owners of the
property which directly abuts the "Premises" and are
parties in interest as set forth in Massachusetts

General Law c. 40A §11, and persons aggrieved by
a decision of the Defendant Board, in accordance with
Massachusetts General Laws, Chapter 40A, Section 17 .
9 . That in granting the requested relief the
Defendant Board did
not make specific findings as
to the statutory prerequisites for the granting of
a variance pursuant. to Massachusetts General Laws
c . 40A §10 .
10 . That there would not be a substantial hardship
to the Defendant, Giovanna Quaterone, to use the
"Premises" for those purposes set forth in the Salem
Zoning Ordinance.
11 . That the use of the "Premises" as requested
would be a substantial detriment to the public 'good
and would derogate from the purpose and intent of "
the Salem Zoning Ordinance.
12 . That the failure of the Defendant Board to
make specific findings as to the existence of the
statutory prerequisites for determining a variance
was in excess of the powers granted . to the Board
pursuant to Massachusetts General Laws , Chapter 40A,
and the grant of the appealed decision was in excess
the Board pursuant to

WHEREFORE, your plaintiffs hereby request that
this Court grant the following relief :

Dear Mr. Fleming:
I have been asked to contact you on behalf of my mother-law
Margaret DeFrancesco, owner of property at 96 Margin Street. She
resides at that address, as do I and my family. Mrs. DeFrancesco
is presently confined to the hospital and neither she nor I are
able to attend your meeting. The facts in this matter are quite
clear and are as follows:
1 . There is not now, nor has there ever been, a building permit
issued for the structure.
2. There is nothing unusal about the soil conditions, shape, or
topography of the lot in question. It is a flat, almost
rectangular lot with no special soil conditions. Any financial
hardship has been self inposed by the erection of the structure
without benefit of the necessary permits. I would remind the
Board that unless ALL the statutory findings are met the Variance
cannot be granted.
3. The fence resting atop the deck exceeds the height permitted in
Table I of the residential density regulation in an R-3 zone by
approximatel three (3) feet.
To erect this structure without permits, knowing full well that
the Building Inspector lives next door is the ultimate of disrespect
for the laws and ordinances of the City of Salem and an insult to me and
the Building Department.
I am sure that after considering the facts the Board will vote
to deny the Variance and order the structure removed.
