Fleming, Chairman; Richard A. Bencal , Vice Chairman; Edward Luzinski , Richard Febonio and Associate Member Peter Dore. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting a Special Permit in order to allow construction of a 123 bed nursing home in this R-3 zone. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section IX D, which provides as follows: "In hearing and deciding applications for Special Permits, the Board of Appeal shall decide such questions as are involved in determining whether such Special Permit should be granted, and shall grant Special Permits with such conditions and safeguards as are appropriate under this Ordinance or shall deny Special Permits when not in harmony with the purpose and intent of this Ordinance. The Board of Appeals shall not have the power to grant any Special Permit where use of land or structure is specifically excluded from the district. " In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal , after careful consideration of the evidence presented at the public hearing, and after viewing the plans, makes the following findings of fact: 1 . The proposed use is in harmony with the intent specified in the City of Salem Zoning Ordinance as it pertains to the R-3 zone with the grant of a Special Permit. 2. Various letters of support for the project were read, as well as actual testimony being voiced by health care professionals and others. 3. Opposition,in the form of letters, was read and actual testimony was also voiced by abutters and others. 4. The ownership and operation of the proposed nursing home would be by persons with long experience in this industry. They have owned and operated such facilites in the area. DECISION ON THE PETITION OF VINNIN ASSOCIATES REALTY TRUST FOR A SPECIAL PERMIT AT 7 LORING HILLS AVENUE (MAP 21 , PARCEL 96) , SALEM page two 5. The need for nursing home bed space , as stated by petitioner and others, is very acute. 6. Petitioner presented an actual recent traffic count study for visitors, employees and delivery vehicles at similar facilities. 7. The 2 acre lot of the proposed nursing home is in close proximatey to an area of mixed uses, such as commercial and residential . 8. The proposed use of a nursing home would be less of a traffic burden than residential . The area is served by major roadways. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows : 1 . The proposed use will promote the public good by meeting the need for nursing homes. 2. The proposed nursing home is in harmony with the intent of the Zoning Ordinance. 3. The proposed nursing home will promote the public health, safety convenience and welfare of the City's inhabitants. Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the Special Permit requested, subject to the following conditions: 1 . Petitioner meet all requirements of the Salem Fire Department. 2. Property Street numbering be obtained the the City of Salem Assessors Office. 3. All construction be done as per existing City and State building Code and as per plans and dimensions submitted. 4. Proper shrubbery shall be placed, and maintained in perpetuity, along lot lines and throughout the property with the approval of the Salem Planning Department. 5. Any and all dumsters shall be placed away from the present adjacent condominiums site line and these dumpsters shall also be properly screened. 6. Property approvals, if required, be obtained from any and all other applicable City and State Boards or Commissions, such as, but not limited to, the Planning Board, Conservation Commission or Board of Health. 7. A Certificate of Occupancy be obtained. 8. Petitioner explore, and make good faith effort to secure traffic lights for interseciton of Carol Way and Loring Avenue. 9. Petitioner shall abide by all decisions of the Salem Planning Board relative to traffic flow for this and adjacent projects. Petitioner shall , in conjunction with adjacent condominium associations, work out a proportionate payment for shared common areas and facilities. 12. The immediate vicinity has a cemetery, a funeral parlor, a fast food establishment, another shopping area containing a bank, pizza parlors, other stores, two convenience stores, gas stations, etc. The addition of a nursing home, which will add ambulances, delivery vehicles, visiting friends and relatives; staff personnel, etc. will add to traffic problems, hazards to safety, and will change the character of the neighborhood. The appraisal was made for bank mortgage purposes and included many of the residential condominium units located within Phases I, II and III of the Village at Vinnin Square Condominium Complex. The formal written appraisal report also included a two acre parcel of land fronting on Loring Hills Avenue that is proposed for.use as a site for the construct- ion of a nursing home. In the appraisal process, the appraiser gives substantial consideration to locational features and neighborhood influences. In the subject case, I made a full investigation of the neighboring land uses and assessed what effect, if any, the same would have on the value of the property being appr- aised as well as on the neighborhood of which the appraised property is a part. With reference to the proposed nursing home, I examined the plans of the proposed building as well as the site and topographical plans that are in attendance to the building. My review of these plans suggested clearly to me that the design of the building, its architectural style and its set- ting on the two acre parcel would be very compatible with existing building of its locus and as such, I concluded that the construction of such a fac- ility and its presence in the 'locus would have no adverse effect on the value of neighboring properties or the overall utility of the ways and streets of the locus. Re: Proposed Nursing Home at 7 Loring Hills Ave, Parcel 96 Mar 22, 1990 Comments of close abutter, Norma Teague, 6 Loring Hills Ave. , Unit A-2 Drainage - a few years back this parcel was swamp-land, sometimes turning into a po nd where ducks would congregate. The Loring Hills Condos were constructed on the same type of wetlands. As a result, we have a very high water table. Basements in Al and A2 flooded seriously until the Trustees installed a heavy- duty sump pump. At times this pump operates 24 hours a day. It is my most far- reaching impact concern that the use of this land, covered by such a large build- ing, will compound the current drainage and flooding. Access to Loring Hills Avenue from Loring Avenue - The Village Shopping Plaza and the Professional Building use this entrance exit for their customers and personnel. At times, when the Stanestsky Fun eral Home has a large funeral cortege, I use the Village Condo's road in order to get out. Basements in Al and A2 flooded seriously until the Trustees installed a heavy- duty sump pump. At times this pump operates 24 hours a day. It is my most far- reaching impact concern that the use of this land, covered by such a large build- ing, will compound the current ,drainage and flooding. I commend Mr. Zieff for his desire to build a nursing home, as I'm sure there is a definite need .for such a facility. However, I and many t others here at the Village question the highly visable, choice location he would like to use in this endeavor and would welcome his selection of a more suitable location. Properties is the managing agent for Summit Estates Condominiums , 261 units, located at 1000 Paradise Road in Swampscott, The Glen Condominiums, 60 units, located at One Loring Avenue, in Swampscott and Loring Hills Condominiums, 38 units located at 6 Loring Hills Avenue, in Salem. All properties are in the proximity of the Vinnin Square area . Numerous unit owners and residents have contacted me regarding the proposed 123 bed nursing home to be constructed on the parcel of land located at 7 Loring Hills Avenue per the Assessors Mop 21 , Parcel 96 . The purpose of this letter is to express deep concern on this subject to the Planning Board/Board of Appeals . During the past three years there has been much- development in--this area. The construction of the Village At Vinnin Square will add approximately 350 new homes . In addition, a new office building was built at 530 Loring Avenue, along with the Village Shops . Residents of the condominium communities, office personnel of The Contemporary Building and customers/staff of the Village Shops use Loring Hills Avenue as a means of entrance and exit . Residents in this area do not feel Loring Hills Avenue can handle additional traffic . The construction of the nursing home will generate vehicles due to staffing, visitors, vendors, ambulances, etc . Many residents are concerned with inadequate parking facilities and the flow of traffic from Loring Hills Avenue and Carol Way on to Loring Avenue. These are extremely dangerous intersections . An accident recently occurred in this area which resulted in a fatality . Due to the many businesses located at the junction of Loring Hills Avenue and Loring Avenue, vehicles are currently parking on both sides of said roadways . The nursing home will basically be in the back yard of residents at Loring Hills Condominiums and many residents of The Village at Vinnin Spare .
