Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner is requesting a Variance to allow a commercial structure and a Vkriance from all applicable density and setback requirements for a lot located W _ w at 509 Loring Ave. and in an R-1 district. Lj J G Y W_ Tfge Variance which has been requested may be granted upon a finding of the Bird that: > a. special conditions and circumstances exist which especially affect u z = r �t the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; U NI r z b. literal enforcement of the provisions of the Zoning Ordinance would in- _ volve substantial hardship, financial or otherwise, to petitioner; and - W " o z c. desirable relief may be granted without substantial detriment to the ` o public good and without nullifying or substantially derogating from the `_ intent of the district or the purposes of the Ordinance. N W Z The Board of Appeal, after considering the evidence presented at the hearing, makes the following findings of fact: _ 1 . Much opposition to the plan was voiced by neighbors and - = y other concerned people; 2. The granting of the variances would be a detriment to the - - neighborhood and its quality of life; - _ U 3. The granting of the variances would worsen a very poor traffic situation already existing and create a hazard for the neighbors and other travelers in the area. On the basis of the above findings of fact and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1 . The granting of the variances requested would be substantially detrimental to the public good; Therefore, the Zoning Board of Appeal voted unanimously 4 - 0 to deny the variances requested. 1chard A. Variance from all applicable density and setback requirements for 509 Loring Ave. (R-1) Dear Mr. Hacker: The Planning Board wishes to express its opposition to the above-named petition. The area in question, while bordering on a commercial area is residential, with primarily single-family dwellings. The Board is opposed to any encroachment of commercial use upon an R-1 area. The Planning Board would further request that should any variances be granted, the proposal be strictly conditioned to protect the bordering residential neighborhood.
