323 LAFAYETTE STREET - STEVENS, MUREEN - ZBA 323 Lafayette St. R-2 — -- - — - Maureen Stevens (Petitioner) "— - Gregory Rand (Owner) J J t Ctu . of Salem, 184 ARR -3 P? :51 DECISION ON PETITION OF MAUREEN STEVENS TRUSTEE, MISxrri - rF REALTY TRUST FOR A SPECIAL PERMIT FOR 323 and 323R LAFAYETTE STREET, SALEM A hearing on this petition was held on March 21 , 1984 with the following Board Members present: James Hacker, Chairman; Messrs.; Charnas, Hopper, Luzinski, and Strout. Notice of the hearing was sent to abutters and others acid notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner requests a Special Permit to allow her to convert into condominiums the vacant five unit building at 323 R Lafayette, St., as well as the two family building located at 323 Lafayette St. The owner of the property is Gregory A- Rand. Property is located in an R-2 district. This proposed condominium conversion is covered by the terms of the City's Condominium Conversion Ordinance. The Special Permit that ahs been requested may therefore only be granted upon a finding by the Board of Appeal that (1 ) the grant of the Special Permit will not adversely-,impact upon the City's existing stock of rental units for low and moderate income families and elderly people on fixed incomes; (2) that the grant of the Special Permit. is not con-. _ trary to the City's Master Plan; and (3) the grant of the Special Permit wi11 not..have.an adverse effect on the neighborhood. The Board of Appeal, after consideration of the evidence presented at the hearing and after viewing plans of the property, makes the following findings of fact: 1 . No opposition was presented to the plan; 2. The buildings are vacant and were not .made vacant by petitioner for the purpose of condominiumizing the units; 3. Petitioner's plan will not have a negative impact on the City's existing stock of low and moderate income rental units nor on elderly people on fixed incomes; 4. Petitioner's plan will not have a negative impact\on the neighbophood; I 5• Petitioner's plan is not in conflict with the Master Plan of the city; 6. There are no tenants and thus no hardship caused by the conversion. On the basis of the above findings of fact, and on the evidence presented at 'the hearing, the Board of Appeal concludes as follows: .- 1 ollows: .1 . The relief desired can be granted without substantial detriment to the public good; f =+ DECISION ON PETITION OF MAUREEN STREVENS, TR. FOR SPECIAL PERMIT FOR 323 & 323 R LAFAYETTE ST. page two 2. The proposed conversion to condominiumswill not be substantially more detrimental to the neighborhood than the existing use of the property. Therefore, the Zoning Board of Appeal voted unanimously to grant the relief requested for a Special Permit to convert to condominium units. SPECIAL PERMIT GRANTED Scott E. Nash 109 Aldrich Road Wilmington, Massachusetts RE: 323 & 323 Rear Lafayette Street Salem, Massachusetts ' Dear Mr . Nash: With regard to the above referenced property , my decision to terminate tenancies there resulted from a party that was given on or about April 30 , 1983 by the tenants . The police were called to end that party , but not before there was severe damage inflected to the premises. Immediately, I began to move tenants from the property in order to upgrade the tenancy and property. Subsequently , I entered into a Purchase & Sale Agreement with yourself. With my approval , you took over the property and continued to vacate tenants , most of whom were students and not good quality tenants. Your condominizing the property was not a motivation for vacating tenants. Sinc e G go A. Rand GAR/las -LACUS Z rt i a BEST A 7- u SQLEM %!F_. LEW/5 45 .
