Notice of the hearing was sent to abutters and others and Notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner requests an extension of a Variance which was granted January 25, 1984 to allow the premises to be used as an emergency shelter for the homeless in this B-3 district. The original Variance allowed this for a period of eight (8) months. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; „--_ b. ' literal enforcement of the provisions of the Zoning Ordinance would in- volve substantial hardship, financial or otherwise, to petition; and c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after considering the evidence presented at the hearing, makes the following findings of fact: 1 . There was vigorous support as well as vigorous opposition by neighbors and other persons and groups; 2. The plight of the homeless in this community is real and life threatening, particularly in the winter months; 3. The Crombie Street Church, because of it's location in the center of Salem, it's dedication to principles of charity, and the facilities available in it's building, is in a special and unique circumstance within the district; 4. Within the parameters of the rules and conditions under which petitioner proposes to run it's shelter, there will be no substantial detriment to the health, safety and welfare of the neighborhood; 5. Without this Variance, petitioner (specifically it's staff and con- �! gretation) will- be unable to fulfill perhaps it's primary goal and reason for existing - that is, the provision of charitable services to the neediest of this neighborhood and community in the form it is most needed by them. This inability to perform these services while having the facilities and finances to do so would work a spiritual and moral hardship upon the clerge, lay staff and congregation of petitioner. Special circumstances affect the premises of peC tioner whictlFdbFnot generally affect the district; S 2. Literal enforcement of the Ordinance would work a substantial hardship upon petitioner; 3. The Variance can be granted without substantial detriment to the public good and without substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Board of Appeal voted unanimously to grant petitioner the Variance requested for a period not to exceed eight (8) months from the date the decision was originally filed in the office of the City Clerk, February 6, 1984, under the following terms and conditions: 1 . All terms and conditions described in the petition, which is expressly incorporated in and made a part of this decision; 2. The emergency shelter will be staffed by both paid and volunteer workers. Workers will arrive at the shelter one hour before the shelter's scheduled opening. Prior to the shelter's opening, workers will be involved in inspecting the. overall security and condition of the building, as well as preparing the sleeping area in Choate Hall. 3. When the shelter-opens, guests will be admitted to the shelter. Before , being admitted to the shelter each guest will be expected to:. a. Sign a release form and guest book, b. Submit to a search of their person and possessions by a shelter worker of their own sex, c. Read or have read to them a copy of the rules governing the emergency shelter, d. Surrender all prescribed medications, matches, and any valuables that they may wish to have locked up of the evening. 4. Once a guest has been admitted for the evening, a worker will assign him/her a mattress, cot and appropriate bedding in the designated area (separate sleeping spaces for men and women) . 5. Each mattress and pillow will have its own plastic cover and they will be scrubbed with an appropriate disenfectant when they are assigned to a new guest. Each guest will receive clean linen. 6. At 11 :30 p.m. all lights in Choate Hall will be shut cff and all guests will be expected to be either asleep or in a quiet situation for the re- mainder of the evening. Shelter workers will supervise guests at all times and in all parts of the shelter. 7. At 6:16 a.m. the shelter workers will begin waking guests. You probably have also heard that the Crombie .Street Church has v ted to provide that space and has signed a contract with the North .Shore .Shelter -Committee_ We believe that the situation faced by the poor and the powerless in :today's F= constricted housing -market requires the attention and concern of .ail responsible is citizens. As we .considered ..the .situation we found that we could not, _in ,good con- science, turn. :down the North .Shore .Shelter Committee's request for .space. We do realize :that .the -presence of their EMERGENCY SHELTER at our premises at 7 Crombie Street will present problems .and -inconveniences for our Cnurch community and our neighbors. However, the North Shore Shelter .Committee has convinced us that they will make -EVERY effort to minimize those inconveniences. With regard :to :health :and safety concerns, they have assured :us that they will operate a facility that -will take every reasonable precaution :to protect the health and _safety ofztheir-guests, -staff and the Crombie Street community (see pages -4 -- 6.).. With-regard,-to.loiteriag,:::tbey Shave assured :us :that they will-do :all :that -is necessary :to .keep-their -guests away from the neighborhood :during :non-operational hours -for the SPIELTER. These two people (husband and wife) had been re- leased from Danvers State Hospital and could find no place to live. .They sought shelter in the .sand :box because they had NO OTHER PLACE TO GO. e a ..Some of you who are close neighbors of Crombie .Street Congregational Church are probably familiar with the story of our friend Bobby "R- ' , .who used to .live ° in a boat down in .Salem harbor_ Because of an auto accident .a few years ago Bobby has significant brain damage and frequently goes into extended periods of seizure activity. Bobby had one of these periods in late October. He was ad- mitted to the neurological unit at Salem 'Hospital, .and was treated there for two weeks. Bobby's condition was stabilized enough to no longer require the intensive services and attention available on the neurological -unit. Bobby still needed a supervised-environment to complete his recovery., :but -the staff at the hospital, .and .his fr-iends :at Crombie Street .and elsewhere, .could :find :no � u appropriate place for -him'-."ANYWHERE on the North .Shore. Because-Bobby no .longer r needed to be on the•neurological :unit, and because there-was -no other :place -for r him -to go, :Bobby-'!R."' .had to -be :admitted to :Danvers .State .Hospi:tal. Because.h,e d d ,:not ;have a K place to'1ive, Joe ouad it, diffTcul.t, impossible,oto move in—Me-.direction of, -sobriety.__ Joe Giz�ckl's body.V4s .found-in a stream :behind a .gas ,station :in -Peabody, five days ;before -Thanksgiving, ,� ,W m -2 5 Most recently you surely must have read or heard about Susan Carr, the woman 'who died a few hours after she was struck by a train in the Salem Depot (Salem Evening News, December 19, 1983) . Susan .was known to us at Crombie Street. She used to sleep underneath .the stairs that led down into the Depot, not far from where she was struck. Susan Carr seldom, if ever, had a stable place to live, so she sought shelter when she had to, beneath the stairs in the depot. Susan had many problems and much suffering in her life. It is +not possible to be sure, but it .seems..most probable to -us at Crombie Street that, if Susan had a place to live, she would be alive today_ All of the incidents mentioned above are a direct result of the lack of A PLACE 'TO GO for the poor, the displaced or the powerless here in Salem and on the North Shore in-general. These stories are merely .some of the -more tragic examples. Communities on the North -Shore can no longer offer safe and .affordable -shelter to those who lack the personal, financial, or social resources to care for themselves. A number of circumstances have created the increased number of .poor and power- less people :here on the North .Shore; increased unemployment, deinstitutionalization of mental patients in the ..State Hospital system, cut backs in state and federal funds for ,social -°services, .to -mention only a few. The -situation -has been severely aggravated by:the lack of.affordable housing in this area. Workers will arrive at the SHELTER one hour before the SHELTER's scheduled opening. Prior to the -SHELTER's opening, workers will be involved in inspecting the over- all security and condition of the building, as well as preparing the sleeping area in Choate Hall. When the .SHELTER opens, guests will .be admitted to the SHELTER. Before be- ing admitted to .the SHELTER each guest will be expected to: 1 . Sign a release form and the guest book. 2. ..Submit to a :search of their person and possessions by a shelter worker of their own sex. 3. Read or have read to them a copy of the rules governing the EMERGENCY SHELTER. 4. .Surrender all prescribed medications, matches, and any val- uables that they may wish to have locked up for the evening. Once a guest has been admitted for the evening a worker will assign him/ her .a .mattress, cot and appropriate bedding in the designated area (separate sleeping spaces for men and women) . ' :Each-mattress and pillow .will have its own plastic cover and they will be scrubbed with an appropriate disenfectant when they are assigned to a new guest. Of course,each -guest .will receive clean linen. At '11.:30 p.m. all lights in Choate Hall will be shut off .and all guests will be expected to :be either .asleep or in 'a quiet .situation for the -remainder of the evening. _SHELTER workers will supervise guests at ALL times ..and :in ALL -parts of the SHELTER. Although the clergy of the church have been trying to convince everyone that this was a unanimous decision by the church members , this is not the case . At the first church meeting , at which it was voted provisionally to allow the North Shore Shelter Committee to establish a shelter at the church , the vote of. the members was two- thirds in favor and one-third opposed. At a second meeting , the proportion of the votes was almost exactly the same . The building itself is very old , originally built in 1828 , with the interior rebuilt after the disastrous fire of. 1934. Like all old buildings , it has many maintenance problems , the most seri- ous of which is recurring leaks in Choate Hall ( the large room on the ground floor where the proposed shelter would be located) . The floor is cement , which , even with mattresses , would be hard , and also extremely cold and damp in winter. . It is doubtful whether enough heat can be provided in this room for overnight sleeping conditions , especially with leaks , and , perhaps , people coming in with wet clothes . The church has only three principal rooms--the sanctuary on the .second floor , which must not , under any circumstances , be used for anything but church services; the Choate Hall on the first floor, referred to above ; and the old , original vestry , known as the Williams Room, at the rear of the first floor , which is used as the dining room for the meals programs. In addition , there is the kit- chen , which is relatively small and completely taken over by the groups providing free meals three times a week . Obviously , this leaves no room at all for any church activities except for its church services. The plumbing was not designed for use by so many people on a daily basis. There are two toilets in the viomen' s room and a com- parable number of facilities in the men' s room. From time to time , there have been problems with malfunctioning pipes and drains , etc . Another small toilet near the kitchen is supposed to be reserved for "Staff. " 2/ Other questions of health and safety include the following: How can it be determined that the people coming in do not have serious diseases or illnesses? - . Currently , the garbage and rubbish generated by the three weekly meals programs are put into a dumpster-type container near the back door of the church. This is bound to attract rats scanner or later. Some of us do not know how , or how often , this rubbish is disposed of. A shelter program can only mean an increase in the amount of this unsanitary material . Does this meet with the approval of the Board of Health? How often will they inspect? - There have been several break-ins and thefts of church property.. The ni"lber of "characters" hanging around the church creates an un- + L1;1 or a s - Those of us who have been life-long members of the church, and remember the fire of 1934 , are extremely afraid of another fire occurring. So far , all our "No Smoking" signs have been pulled down and removed by someone (we don' t know who) , and we certainly don` t want a repeat performance of a conflagration. Crombie Street has only a few buildings on it, and they are all residential . In addition , the new Heritage Plaza Condominiums or Norman Street adjoin -the church (garden. We know there are " street people" going in and out of the garden, and we cannot prevent this , as our property at 9 Crombie Street is used by t,,vo social service agencies--Help for Abused Women and Their Children ( HA'IC) , and the Office for Children. The presence of these street people , sometimes entering the offices and often drunk , is very disturbing to the people running the offices and to their clients coming in for con- sultation. The petition submitted to the Appeals Board in the name of Crombie Street Congregational Church, for a hearing to permit a variance so that an emergency shelter may be established in the church building , was. presented to the Appeals Board without the knowledge of the church as a whole or the Church Council . -K-6 knew nothing about it until the notice first appeared in the Sa-lem News— , Some of us cannot attend the next hearing on January 18 at- 1 t1 Salem Green, but we hope this petition will be rejected , as we feel that Crombie Street Church is most unsuitable for the pro-- posed shelter. I had been living in the western part of the state. Salem has lived up to my expectations and I expect to stay here forever. As a citizen of Salem, I care about the city and the city must include all its people . There are some people in Sales who are living in cars and tents . and doorways . I believe that we must ensure that everyone in our city has a safe warm place to live . This would seem! to be a basic necessity that should guarantee every citizen of our city. I find it extremely painful to know someone and look in their eyes and know that that very night they are going to sleep in a car! I can not bring them to my house as I do not have room and I have no solution for them. Salem people do not want to live on the streets of Boston and go to Pine Street Inn. They live in this community and consider it home and feel most comfortable here. They belong to Salem. As for other citizens of Salem who are concerned mostly about themselves and their rights and safety , I can assure them that a supervised shelter is much safer for a community than no shelter at all. The first night I moved to Salem in January 1983 , I had put some things in my landlord ' s basement on Flint Street. I left the hatchiway unlocked but closed because he was away and I needed to put more things in the next day. At 2 a. m. or so I heard the hatchway close . I .was frightened and called r_he police. They came and the person fled. They said it was someone trying to find a warm place to live. Before the Bowditch School was tightly secured , people were sleeping there. I was always frightened because of the possibility of fire. Just last week in another city , a homeless man was sleeping_ :in an apartment building basement and set fire to a mattress there. It is so -:uch safer for our city to have a supervised night shelter! ! 0 1r. They will get it wherever they can in order to survive . How much better to have a supervised shelter where they can be safe and we can be safe from. fire. If they are out on the street with out any connections with services , they have problems ever changing their situation. lie wish for every citizen of Salem to have a permanent safe home and can best assure this by establishing a shelter. 1 can think 0' no better location for a sh^lter' than the Crombie Street Church at this time. It is in the center of the city and has been ministering to this population for a number of years. Re: Hearing on Emergency Shelter at Crombie Street Church As a member of Crombie Street Congregational Church, I am writing to express my opinion concerning the. proposed emergency shelter to be located in Crombie Street Church, 7 Crombie St. While many of us at the church recognize the need for such a program, our objections relate only to the use of this particular building and its immediate neighborhood. Although the clergy of the church have been trying to convince everyone that this was a unanimous decision by the church members , this is not the case . At the first church meeting , at which it was voted provisionally to allow the North Shore Shelter Committee to establish a shelter at the church, the vote of the members was two- thirds in favor and one-third opposed. At a second meeting, the propo$tion of the votes was almost exactly the same. The building itself is very old, originally built in 1828 , with the interior rebuilt after the disastrous fire of 1934. Like all old buildings ,. it has many maintenance problems , the most seri- ous of which is recurring leaks in Choate Hall ( the large room on the ground floor where the proposed shelter would be located) . The floor is cement , which, even with mattresses , would be hard , and also extremely cold and damp in winter. It is doubtful whether enough heat can be provided in this room for overnight sleeping conditions , especially with leaks , and, perhaps , people coming in with wet clothes. The church has only three principal rooms--the sanctuary on the second floor, which must not, under any circumstances , be used for anything but church services; the Choate Hall on the first floor, referred to above ; _and the old, original vestry, known as the Williams Room, at the rear of the first floor, which is used as the dining room for the meals programs. In addition, there is the kit- chen, which is relatively small and completely taken over by the groups providing free meals three times a week. Obviously, this leaves no room at all for any church activities except for its church services. The plumbing was not designed for use by so many people on a daily basis. There are two toilets in the women' s room and a com- parable number of facilities in the men' s room. From time to time , there have been problems with malfunctioning pipes and drains , etc. Another small toilet near the kitchen is supposed to. be reserved for "Staff. " 2/ Other questions of health and safety include the following: - How can it be determined that the people coming in do not have serious diseases or illnesses? - Currently , the garbage and rubbish generated by the three weekly meals programs are put into a dumpster-type container near the back door of the church. This is bound to attract rats sddner or later. Some of us do not know how, or how often, this rubbish is disposed of. A shelter program can only mean an increase in the amount of this unsanitary material . Does this meet with the approval of the Board of Health? How often will they inspect? - There have been several break-ins and thefts of church property-I The number of "characters" hanging around the church creates an un- fi5 attractive addition to an otherwise dignified old Federal-type building on a residential street. - Those of us who have been life-long members of the church, and remember the fire of 1934, are extremely afraid of another fire occurring. So far, all our "No Smoking" signs have been pulled down and removed by someone (we don' t know who) , and we certainly don' t want a repeat performance of a conflagration. - Crombie Street has only a few buildings on it, and they are all residential. In addition, the new Heritage Plaza Condominiums on Norman Street adjoin the church garden. We know there are "street people" going in and out of the garden, and we cannot prevent this , as our property at 9 Crofnbie Street is usedby two social service agencies--Help for Abused Women and Their Children (HAWC) , and the Office for Children. The presence of these street people , sometimes entering the offices and often drunk , is very disturbing to the people running the offices and to their clients coming in for con- sultation. The petition submitted to the Appeals Board in the name of Crombie Street Congregational Church , for a hearing to permit a variance so that an emergency shelter may be established in the church building, was presented to the Appeals Board without the knowledge of the church as a whole or the Church Council. K16 knew nothing about it until the notice first appeared in the Salem News , Some of us cannot attend the next hearing on January 18 at 1 Salem Green, but we hope this petition will be rejected, as we feel that Crombie Street Church is most unsuitable for the pro- posed shelter. Hacker , I was disappointed last evening by the postponement of the hearing on the Crombie Street Church request for a variance relative to a shelter for the homeless. As this property abuts the Heritage Plaza Condominium, where I live, I would like to registar my protest by letter as I will be unable to attend the :January 25th meeting. I understand that the building is not ' suitable for housing and many members of the church are opposed to the idea. Personally; I feel that this proposal will be counter productive to the goal of solving the alleged "homeless" problem. It will attract more of these street people to Salem and further the deterioration of the downtown area. I also believe it will have a depressing effect on the value of my property and all . of the others who invested in Heritage Plaza. It is bad enough thatwehave to put up with these people badgering us for money on the streets , sleeping in our lobby, stealing from our lobby, but to centralize them in one location in our backyard seems to be overdoing it . - We also have loud, raucous drunks every xhursday, Friday 'and _Saturdaa nights screami ctir3in� �_f._ 9nt, __g and blowing horns at 1 : 00 AM when the Beef and Oyster and One Barton Squ,are 'Bars close. I understand, we have just issued another liquor license up the street to add to the early morning bedlam. To have a "flop house" started in the other side of us is too much to bear . I can appreciate the feelings of the misguided people who are proposing this but I am certain that establishing such a place will only allow these people. to spend more money on liquor and drugs and attract more unsavory characters to our beautiful city . I am also a resident of Salem who picked this town to move to over a year ago. I fell in love with Salem many years ago and was determined to settle here at some point in my life. I had been living in the western part of the state. Salem has lived up to my expectations and I expect to stay here forever. As a citizen of Salem, I care about' the city and the city must include all its people. There are some people in Salem who are living in cars and tents and doorways . I believe that we must ensure that everyone in otr city has a safe warm place to live. This would seem` to be a basic necessity that we should guarantee every citizen of our city. I find it extremely painful to know someone and look in their eyes and know that that very night they are going to sleep in a car! I can not bring them to my house as I do not have room and I have no solution for them. Salem people do not want to live on the streets of Boston and go to Pine Street Inn. They live in this community and consider it home and feel most comfortable here. They belong to Salem. As for other citizens of Salem who are concerned mostly about themselves and their rights and safety , I can assure them that a supervised shelter is much safer for a community than no shelter at all. The first night I moved to Salem in January 1983, I had put some things in my landlord ' s basement on Flint Street. I left the hatchway unlocked but closed because he was away and I needed to put more things in the next day. At 2 a.m. or so I heard the hatchway close . I was frightened and called the police. They came and the person fled. They said it was someone trying to find a warm place to live. Before the Bowditch School was tightly secured, people were sleeping there. I was always frightened because of the possibility of fire. Just last week in another city, a homeless man was sleeping in an apartment building basement and set fire to a mattress there. It is so much safer for our city to have a supervised night sielter! ! f Ar. They will get it wherever they can in order to survive. How much better to have a supervised shelter where they can be safe and we can be safe from fire. A shelter also has an added benefit to all of us . The persons working at the shelter will give love and care and work hard to find more permanent solutions for the homeless . If they are out on the street with out any connections with services , they have problems ever changing their situation. We wish for every citizen of Salem to have a permanent safe home and can best assure this by establishing a shelter. . I can think of no better location for a shelter than the Crombie Street Church at this time. It is in the center of the city and has been ministering to this population for a number of years. We must immediately provide a safe refuge for our less fortunate citizens and I hope you will vote for this so we can get people out of cars and doorways this winter and hopefully not lose anyone to the cold. Although many of us may not want to admit it, there are homeless people spending days and nights "on the street" in this area. The most recent case that comes to my mind is that of Susan Carr, the woman who died a few hours after she was struck by a train in the Salem Depot. Ms. Carr was known to have slept underneath the stairs at the depot. Perhaps if a shelter had been available such a tragic event could have been avoided. This is just one instance; I am sure there are many others. 1 believe it is imperative that this request be granted without any further delay. At Heritage; street people have been found late at night in the foyer_ During the three years or so that the programs have been carried on/the neighbors have not been consulted when these programs were instituted. Those working on the programs don' t live in the immediate area so _don' t have this problem around their homes_ We understand that the shelter would be open every night for- at least a year opening at 9:30 or 10:00 at night. Anyone trying to - get in would be around the neighborhood long before that and if they are not admitted in all probability they would most likely still be in the neighborhood long after that. When it was known that a shelter existed there, more street people from other communities would congregate in the neighborhood. People were already afraid to go out at night and now are even nervous about going out in the daytime. Please consider very thoroughly our situation and our concern. I believe that, we must ensure that everyone in our city has a safe warm place to live. This would seem` io be a basic necessity that we should guarantee every citizen of our city. I find it extremely painful to know someone and look in their eyes and know that that very night they are going to sleep in a car! I can not bring them to my house as I do not have room and I have no solution for them. Salem people do not want to live on the streets of Boston and go to Pine Street Inn. They live in this community and consider it home and feel most comfortable here. They belong to Salem. As for other citizens of Salem who are concerned mostly about themselves and their rights and safety, I can assure them that a supervised shelter is much safer for a community than no shelter at all. The first night I moved to Salera in January 1983 , I had put some things in my landlord ' s basement on Flint Street . I left the hatchtaay unlocked but closed because he was away and I needed to put more things in the next day. At 2 a. m. or so I heard the hatchway close . I was frightened and called the police . They came and the person fled. They said it was someone trying to find a warm place to live. Before the Bowditch School was tightly secured, people were sleeping there. I was always frightened because of the possibility of fire. Just last week in another city , a homeless man was sleeping in an apartment building basement and set fire to a mattress there. It is so Much safer for our city to have a supervised night s21e1'cer! ! :lr. James Hacker, Chairman 2 If a shelter is not established in Salem, the same people will still live here and will still be seeking 9shelter in our midst . They will get it wherever they can in order to survive . IIow much better to have a supervised swelter where they can be safe and we can be safe from, fire. A shelter also has an added benefit to all of us . The persons working at the shelter will give love and care and work hard to find more permanent solutions for the homeless . If they are out on the street :::-itl? out any connections with services , they have problems ever changing their situation. We wish for every citizen of Salem to have a permanent safe home and can best assure this by establishing a shelter. James Hacker 7 Hugo Road Salem, Massachusetts 01970 Dear Mr. Hacker: As a concerned citizen of the City of Salem, I support the Crombie Street Congregational Church's effort% to obtain a zoning variance in order to provide a shelter for the homeless of the City of Salem. I read with interest the article in the North Shore Sunday (January 1, 1984) regarding "Shelter:still on hold,". and the efforts of the North Shore Shelter Committee to obtain the Salem ` Board of Appeals' _approval of the shelter plan. I trust that the request to open the shelter will be voted upon without fail at the January 18 meeting. If you had been present on Christmas day at the Crombie Street Church dinner given by the concerned citizens of the City of Salem to the so-called street people of Salem, I am sure you would not hesitate to see the need for this shelter; yet, after the day's activities, we had to close the door on many of them who had no place to go but a doorway. The North Shore Shelter Committee is attempting to provide a much needed service with its proposed shelter, a service which all citizens- in Salem and on the North Shore,should support. It comes as no sur- prize to me that the people of the Crombie Street Congregational Church are offering space for this service, since they are one of. bhe few groups on the North Shore that act upon their "professed" concern for the needy. Given the efforts and sacrifices made by these two grouros, I believe that it is incumbant upon all other members of the community to d5 all that they can to expedite the approval and opening of an emergency shelter on the Norah Shore.
