To permit the land described and identified by Symbol B to be used for commercial uses, including retail and other accessory uses. This petition was first brought to the Board on February 2$, 1966. It appeared at this hearing that the City of Salem should have permission to enter into any building on this location in order to inspect the easement over which the City of Salem has control. The Board at this hearing was of the opinion that a legal question was involved' and it was the unanimous decision of the Board to continue this hearing until the execution of a proper agreement. On May 31, 1966 petitioner again appeared before the Board whereas a proper agreement authorized by the City Council, dated May 4, 1966, has been duly executed by Lorus Realty, Inc. , and approved by Mayor Francis X. Collins, and record- ed with Essex South Registry of Deeds, Book No. 5360, Page 413, a copy of which has been filed with this Board, pro- tecting the City of Salem from any and all liability in connection with the construction of the proposed building over the City of Salem's easement, and further in no way extinguishing the easement running to the benefit of the City: The Board voted unanimously to grant this petition on the grounds that the relief granted would be without detriment to the public good and would not substantially derogate from the intent and purpose of the zoning ordinance. The use for general business Purposes such as retail which is wrought in this petition is a more restrictive use than that permitted by the Zoning Ordinance, for all but a small part of the parcel of land involved. (a) This Variance is requested because of the. words used in S.ect'on V-A-7. (Page 20 of the Zoning Ordinance)=g 4 District- the woiSing of which section spells out specific uses and omits the words general Business or Retail-which are more restrictive uses than those specified. It seems it was hardly the intention .toukeep rsta1L buaine$,Q out of such district, for district uses as thq progress down the line bd7cdme"Hess-restrictive4and4R:-.4. District is just one category removed from the Industrial District which is the most restrictive. 2. The Land involved in this petition is especially adapted for the, use sought an it consists of approximately 78,000 square Peet and such s use ms retail requires adequate parking area. 3. There is uncertainty about the District Boundary between the B 4 and R 2 line in this area. (a) The uncertainty pertains to the depth of the B 4 District in this area on Canal Street in tame of number of Peet, there being no notes available as to the exact figure. It seems the line drawn on the zoning map does not reflect the true depth as intended in terms of the number of feet. (b) tinder sect. 9 1-1 (pe a 46 of the Zoning Ordinance) which relates to lots in 2 Districts t to provided that the regulation for the less restrictive portion of such lot may extend to 30 feet into the more restrictive portion. The maximum depth of the lot to be used for General Business is approximately 363 feet. 4. The 20 feet strip in R 2 would be used only as an access road. 5. The requestto .permit the,rear wall of the proposed b; ilding to be less then' 25 feet ie to provide ample parking and fsser movement of traffic 6. Economic and Land considerations.' The' granting of titin petition would be of greast. benefit to our City. (a) It will make this land which description borders on mar- ginal, more productive and useful and thus increase the tax base. It will provide substantial revenue from the improvements which would be brought about, without requiring s parallel outlay by the city for .services which under other types of developments would require large outlays of expenditures. This would help strengthen the economic base of our City. ` (b) Salem has a definite Land Scarcity problem. We have an unusually small land area for is city having our population, plus our commercial and industrial activity. To provide for our present and potential business activity, we must make use of our limited land resources to their most constructive uses and highest potentiate. (c) As limited as our land potential is, we have here, with the dynamic expansion and growth of Salem State College, a constant and increasing shrinking of land available for private use. As the State College is taking more and more land,• our limited .land erees are decreasing at an alarming rate. It is thus,. imperative to make the beet and most productive use possible of our available land. 7. Aesthetic Considerationst In its present state, this land is unsightly, cluttered and looks more like scrub land. Furthermore,, Canal Streeat is one of the main access roads and g€ateweay# into our City. In this development, the land mill be cleared and beautified. The architechtural design calls for an attractive building of a die- tinct colonial appearance. This would be in keeping with the Petition of. Ernest R. Thus, from all points of views,. latsthetic, economic and land use, this developement would not on y improve the neighbor- hood but would also prove a distinct bot to our City.
