(R-2) A hearing on this petition was held May 15, 1991 with the. following Board Members present: Richard Bencal, Chairman; Joseph Correnti, Richard Febonio, Edward Luzinski and Mary Jane Stirgwolt. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting variances from use, parking, side setbacks and rear setbacks to allow the property to be converted to a three family dwelling in this R-2 district. the Variances which have been requested may be granted upon a finding of the Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. c. Kevin Harvey, Councillor Ward 2, spoke in opposition to the granting of this petition, citing the extreme congestion of this neighborhood and the severe parking problems. 4. There was no show of support for this petition. 5. The petition failed to demonstrate or to meet her burden of proof relative to legal hardship. PARKING AND DENSITY OF NEIGHBORHOOD Having lived at 11 Boardman Street for nearly -8 .years, we have been witness and subject to a very congested; and at times, dangerous parking - situation. Some -'of-- our observations related to parking and density are as follows: a: Approximately 3 years ago a variance to convert 12 1/2 Boardman Street to a 3 family was denied. b. About 2 years._ ago a variance to convert 10 Boardman street to a 3 family -was denied. - We attended the hearing, we didn't oppose the variance but we expressed concerns about parking. At the time, landlord and tenants were using garage and driveway for parking. (Piggy-backing of cars was necessary, this piggy-backing seems to create a musical cars-like comotion in the mornings and at night. More importantly, it is a potentially dangerous situation) The Kaufman's sold the property. Presently 4 or 5 cars at that address but only I - 2 use the driveway, the rest on Boardman Street and at the Common. C. 9 Boardman Street, which we believe is R-3 zone, presently has 8 - 9 cars at that address. 5 is the most we have ever seen in the driveway. Piggy-backing is,. also necessary at that address. Again, we're talking overflow parking on street and at the Common. d. For the time we have lived at 11 Boardman\ Street, we have witnessed many instances of people - who are unable to find parking and take the risk of parking at the hydrant in front of our house. Many of these cars have been ticketed and/or towed. More importantly is the fire hazard that this creates for the neighborhood. e. Additionally, we are opposed to Kathryn Sammartano's requests for variances from use, setbacks and parking as well as construction of deck and stairs and conversion to a three family 2. ARCHITECTURAL/HISTORICAL NATURE AND SIGNIFICANCE OF 13 BOARDMAN STREET a. Given that 13 Boardman Street is an over ,100-year old Victorian home with a Mansard roof, we believe that the cutting and opening into the Mansard Roof, the buildingof the outside deck and four flight' 'staircase, as proposed by Kathryn Sammartano, would greatly detract from the historical nature and significance of 13 Boardman Street, as well as the neighborhood. :F , i 3. ABSENTEE LANDLORD: a. Trash At times left to accumulate. We get tired of looking at it, we ., bring trash out--many times empty trash barrels are left on the sidewalk- or. street for days _ and eventually we'll put them away. b. Grass and Shrubs - Often left uncut, often we have main- tained to alleviate the unkemptness. - C. Snow Shoveling More often than not, shoveling is not done. Again, many times we will shovel her front walkway. (mainly for the postman, pedestrians, safety) d. Parking - To further illustrate her absenteeism, as well as her insensitivity to the parking needs of the neighborhood, Kathryn left a car parked in front of 9 Boardman Street from about May 1990 until the police had the car towed as an abandoned car on Sept. 26, 1990. It seems that around November was the first time that Kathryn was on Boardman Street to realize that her car was missing. We later saw in the Salem News that she was cited for abandoning a motor vehicle. Appears to 'be eligible for inclusion if district boundaries were to be expanded. v ARCNITECTURAL SIGNIFICANCE Describe important architectural features and evaluate in teras of other buildings within the community. 13-15 Boardman Street is a well-preserved example of a Second Empire style double house. The symmetrical facade consists of a paired center entry sharing a bracketed door hood, flanked by bracketed and panelled second story bays, while second-story central windows have bracketed hoods. The mansard roof is pierced by pedimented dormers. Other features include a high brick foundation, cornice brackets, and transoms over the two main entries. HISTORICAL SIGNIFICANCE Explain the role owners played in local or state history and how the building relates to the development of the community. Boardman Street was laid out in 18T9, and was quickly developed with one and w - t o family houses. By the late 1880s the street was Pully occupied, with development concentrating on the north side of the street in the first five years of construction, and the south side of the street beginning about 1885. According to Tolles, "For the most part, these stylistically diverse houses were built by individual landholders, although there were some instances of real estate speculation when two or more buildings were financed by one investor." Built in 1881 , this double house appears to have been a rental property owned by John Kinsman of 2 Winter Street. It was first occupied by Reverend William A Keese, pastor of Calvary Baptist Church at the corner of Essex and Herbert Streets, and William L. Welch, of Massachusetts National Bank, Boston.
