Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting a Variance from parking to allow a two family dwelling in this R-2 district. Before hearing the merits of this petition, the Board of Appeal has to consider whether or not there is a substantial and material change from a previous petition for variances from use, parking, side setbacks and rear setbacks to allow the property to be converted to a three family dwelling and to construct a deck and stairs which was denied by the Board of Appeal on May 15, 1991 . The Board of Appeal, after hearing the evidence presented, and after receiving Consent from the Salem Planning Board, voted unanimously that there was a substantial change, said change being, the request is now for a two family and there will not be construction. The Board will hear the petition. The Variance requested may be granted upon a finding of the Board that: 1 . Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or structures in the same district. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1 . The petitioner has been the owner of this property for many years during which there were multiple kitchens in the house. 2. The present petition includes plans to remove one of these kitchens presently located in the house. 3. No exterior changes will be made to the house as the result of the petitioners plans. 4. The properties in the immediate neighborhood are predominantly two family or multi-family dwellings. Stefanski-s own one-half of the house, and, . Sammartano owns the other half., If Saamrartano is allowed to have her half become a two-family, then a precedent has been set for the Stefanskils or any future owner to convert their half to a .two-family. THE POTENTIAL EXISTS FOR A TWO-FAMILY HOUSE TO BECOME A FOUR-FAMILY HOUSE IN AN ALREADY VERY CONGESTED NEIGHBORHOOD. PARKING As was presented at the May 15th appeals meeting, on-street parking on Boardman Street and the Common neighborhood at times can be virtually impossible. During the recent Heritage Days activities on the Common, neighborhood residents who are usually forced to park at the Common, had to resort to parking on the sidewalk on the No-Parking side of Boardman Street. This could be an indicator of parking problems to come especially with the expected increase in tourists for the 300th anniversary of the witch trials. Isdditionally; we feel that it is worth mentioning that since May 16th an unregistered Toyota has occupied one of the two driveway spaces of 13 Boardman Street. For the past two weeks, the other space has been used by Kathryn's mother .for her Ford Escort. OTHER ISSUES During the June 6th Planning Board hearing, the Board asked Kathy if she was going to remove the kitchen facilities from one of her three units. She indicated she would, saying, "Probably from the 3rd floor". My wife and I haven't seen any activity whatsoever such as the presence of contractors or removed facilities in the trash to substantiate that that has happened. To the contrary, Kathryn's mother, sometimes another woman and less frequently Kathy have been living on the 3rd floor. The 2nd floor has been vacant since this past spring, the let floor has been vacant since the end of July. At the May 15th Appeals Board meeting, Kathy presented extensive plans for a roof deck, an exterior staircase and parking for 5 cars. My wife and I presented issues related to her absenteeism as a landlord. One of those issues being the unkemptness of her property. To this day, it has been about a year since her grass was last cut. On one hand she presents great plans but on the other she hasn't even attended to such a simple thing as having the grass cut. ARCHITECTURAL SIGNIFICANCE Describe important architectural features and evaluate in terms of other buildings within the community. 13-15 Boardman Street is a well-preserved example of a Second Empire style double house. The symmetrical facade consists of a paired center entry sharing a bracketed door hood, flanked by bracketed and panelled second story bays, while second-story central windows have bracketed hoods. The mansard roof is pierced by pedimented dormers. Other features include a high brick foundation, cornice brackets, and transoms over the two main entries. HISTORICAL SIGNIFICANCE Explain the role owners played in local or state history and how the building relates to the development of the community. Boardman Street was laid out in 1879, and was quickly developed with one and two-family houses. By the late 1880s the street was fully ocoupied, with development concentrating on the north side of the street in the first five years of construction, and the south side of the street beginning about 1885. According to Tolles, "For the most part, these stylistically diverse houses were built by individual landholders, although there were some instances of real estate speculation when two or more buildings were financed by one investor:" Built in 1881 , this double house appears to have been a rental property owned by John Kinsman of 2 Winter Street., It was first occupied by Reverend William A Keese, pastor �of Calvary Baptist Church at the corner of Essex and Herbert Streets, and William L. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting variances From use, parking, side setbacks and rear setbacks to allow the property to be converted to a three family dwelling in this R-2 district. the Variances which have been requested may be granted upon a finding of the Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district. b. Literal enforcement. of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. c. Desirable relief may be granted without substantial detriment to the public good and withoutnullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented, and after viewing the plans, makes the following findings of fact: 1 . There was vigorous opposition from abutters and neighbors relating to density and parking. 2. Regina Flynn, President of the Salem Common Association, speaking for the Association, expressed their opposition to the granting of this petition. 3. Kevin Harvey, Councillor Ward 2, spoke in opposition to the granting of this petition, citing the extreme congestion of this neighborhood and the severe parking problems. 4. There was no show of support for this petition. 5• The petition failed to demonstrate or to meet her burden of proof relative to legal hardship. . Therefore, the Zoning Board of Appeal voted unanimously, 0-5, ,against the motion to grant, having failed the garner the required four affirmative votes to pass, the motion is defeated and the petition is denied. Bencal : On June 6, 1991, in accordance with Massachusetts General Law Chapter 40A, Section 16, the Salem Planning Board met to discuss the application of Kathryn Sammartano for a "Determination of Specific and Material Change" to her plans for 13 Boardman Street which were denied by the Board of Appeal on May 15, 1991 . Ms . Sammartano' s amended plan includes a request for a two family dwelling rather than a three family dwelling . In addition, the amended plan does not include any exterior additions or changes to the existing dwelling. The Planning Board voted unanimously that "Specific and Material Changes" have been made to the petition which was denied by the Board of Appeal . The Planning Board would, however, like to request that the Board of Appeal require the applicant to prepare a plan which will detail the kitchen to be removed from the existing dwelling. In addition, the Planning Board would like the Board of Appeal to consider allowing Ms . Sammartano to rearrange the three ( 3 ) proposed parking spaces .
