DECISION ON THE PETITION OF ALICE L. PITREAU F03 A
VARIANCE FOR 18 BARCELONA AVE. , SALEM
A hearing on this petition was held on June 13, 1984 with the following Board
Members present: Ed Luzinski, Acting Chairman; Messrs., Charnas, Gauthier, and
Strout. Notice of the hearing was sent to abutters and others and notices of
the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner requests a Variance to allow her to use the premises as a two family
dwelling inthis R-1 district.
The Variance which has been requested may be granted upon a finding of the Board
that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings or structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship, financial or otherwise, to petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance
The Board of Appeal, after hearing the evidence presented at the hearing,
makes the following findings of fact:
1 . No opposition was raised to petitioner's plan; -
2. No construction is necessary to accomplish this conversion;
3. Petitioner's circumstances are such that it would be a financial
hardship to her if the premises could not be used as a two family
dwelling;
4. This conversion would haveno appreciable ef_`ect of the neighborhood.
On the basi's of the above findings of fact, the Board of Appeal concludes as
follows:
1 . Special conditions exist which affect the premises which do not
affect the district generally;
2. Literal enforcement of the Ordinance would work a substantial
hardship upon petitioner;
3. The Variances can be granted without substantial detriment to the
public good and without substantially derogating from the intent
and purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously to grant the Variance
requested, provided that it shall expire immediately upon petitioner's vacating
the premises.
