Dear Mr. Auberton;
On March 14, 2005 a letter was sent to you regarding the illegal use of your
basement as a dwelling unit. This space had been created without the benefit of a permit,
I understand that you are currently engaged in correcting this situation, but it seems that
the continued use as a dwelling unit has not changed. Be advised that such use is illegal,
and any such use must immediately cease, failure to do so would cause the revocation of
any issued permits, and an order by this department to immediately begin to disassemble
this basement room. As I know that this is not your desire, I thank you in advance for
your cooperation.

Dear Mr.Auberton;
On the March 11, 2005 I was allowed to tour the basement of this address, in response to my letter
of February 28,2005. This basement has a finished room that is currently being used as a sleeping room,
this is not allowed under the provisions of 780 CMR,the State building Code, Section 1010.4;which
requires one approved emergency egress window. Use of this space as a sleeping room must cease and
desist immediately. Also,this space was constructed without the proper permits,and therefore needs to be
properly permitted and inspected,this is stipulated under the provisions of 780 CMR Section 118.1.
Within this space is also new wiring and plumbing that was also installed without the benefit of permitting,
and this too needs to be permitted and inspected. As was also mentioned during my visit the lock and hasp
on the outside of this rooms door must be removed to prevent someone from being accidentally locked into
this space.
You are directed to secure the necessary permits and have all the required inspections completed
within 30 days of the receipt of this letter.

DECISION OF THE PETITION OF RENE AUBERTIN REQUESTING A VARIANCE
FOR THE PROPERTY LOCATED AT 21'"SALTONSTALL PARKWAY R-2
A hearing on this petition was held October 20, 2004 meeting with the following Board
Members were present: Nina Cohen Chairman, Stephen Harris, Bonnie Belair, Edward
Moriarty and Richard Dionne. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
At the request of the Petitioner, the Salem Board of Appeal voted 5-0, to grant leave to
withdraw this petition without prejudice requesting a Variance from the number of stories
to allow the expansion of the existing third floor for the property located at 21 Saltonstall
Parkway located in an R-2 zone.
