Bencal. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance n o with Massachusetts General Laws Chapter 40 A. W _ C y H LL the petitioner has requested a Special Permit to change from one non- W Itonforming use, a survey office, to another non-conforming use, a law office. The petitioner also wished to construct a connecting passage Lj `_ < Qay from 47 to 49 Federal St. c _ w Lj 'ie provision of the Salem Zoning Ordinance which is applicable to this > E; a �: _ tz request for a Special Permit is Section V B 10, which provides as follows: - = Notwithstanding anything to the contrary appearing Z J in this Ordinance, the Board of Appeal may, in u1 1 a z accordance with the procedure and conditions set a = o forth in Section VIII F and IX D, grant Special Permits for alterations and reconstruction of nonconforming U w L 6 C F structures, and for changes, enlargement, extension or G expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, - o enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the - neighborhood, In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after consideration of the evidence presented at the public hearing, makes the following findings of fact: 1. No. opposition was raised by neighbors, abutters or others. 2. The property would be in more harmony with existing structures in the area such as the court house and the county offices. The Board of Appeal, after careful deliberation voted unanimously 4-0, to grant the Special Permit subject to the following conditions. 1. A building permit for the connecting passage way be obtained.
