Petitioners are requesting a Special Permit to construct a carriage house on an existing foundation and variance from lot size to convert single family dwelling into two family dwelling in this R-2 district. The provision of the Salem Zoning Ordinance which is applicable to this request for a Soecial Permit is Section V B 10, which provides as .follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F and IX D, grant Special Permits for alterations and reconstruction, of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after hearing the evidence presented and after viewing the plans, makes the following findings of fact: 1 . A Special Permit is necessary because the foundation is attached to the dwelling unit; 2. Neighborhood was in favor of the project; 3. No opposition. On the basis of the above findings of fact, and on the evidence present, the Board of Appeal concludes as follows: 1 . The proposed carriage house will not be substantially more detrimental to the neighborhood; 2. The relief requested does not create a substantial detriment to the public good, nor does it substantially derogate from or nullify the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted unanimously in favor of granting the Special Permit requested on condition: DECISION ON THE PETITION OF JOHN & SARAH HAYES FOR A tir' 1 SPECIAL PERMIT AND VARIANCE FOR 21 FAIRMOUNT ST. , SALEM page two I 1 . Carriage House is for storage of cars and household goods only and not for human habitation; 2. Carriage House/garage to be constructed on existing foundation as per plans on file; 3. A Certificate of Occupancy. be obtained. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would in- volve substantial hardship, financial or otherwise, to petitioner; and c. desirable relief may be granted without substantial detriment. to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after hearing the evidence presented, makes the following findings of fact: 1 . There was neighborhood opposition to the two family dwelling. On the basis of the above findings of fact and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1 . Literal enforcement of the Ordinance would not involve substantial hardship; 2. Relief requested cannot be granted without substantial detriment to the public good. Therefore, the Zoning Board of Appeal voted unanimous 5-0 against granting Variance from lot size in order to convert single family to a two family dwelling. SHEEP I OF 10 CRRR,I Ac C Nou S This design, of early American heritage,provides a two-cargarage and ample space on the second floorprimarily for an offi Thce, the space could also be used for a studio, work room, play room, etc. The rear wall of the second floor has more than sufficient height to accommodate a standard four-drawerfile case. The skylights in the rear roofare located to provide natural light to not only the second floor area, but also the garage area. Inside stairs provide access to the second floor. The drawings are to standard scales, and are in unusual detail to facilitate construction and the compiling of a materials list, they are presented on 8-1/2" x 11" sheets for ease of handling during review, or on the job. Importantly, the sheet size accommodates easy reproduction by duplicating methods available almost universally today, to make up theplan sets required for construction purposes, a method of reproduction should be chosen which minimally distorts the scale of the drawings. While the drawings are copyrighted to protect us from malicious infringement, the purchaser of our designs may feel free to make copies for his own use in his construction efforts. 1.
