ON 07-08-2007, AT APPROXIMATELY 010C HOURS, OFFICER DUNN AND
MYSELF (OFF GAUDET) , RESPONDED TO 63 SALEM ST, ON A ?SPORT OF THREATS.
UPON ARRIVAL CONTACT WAS MADE WITH LISA CCRREA/VICTIM AND HER
SISTER JESSICA CORREA. CORREA REPORTED THAT ON 07-04-2007, SHE WAS
THE VICTIM OF A VIOLENT, DOMESTIC ASSAULT AND BATTERY. CORREA WAS
ASKED IF SHE HAD ALREADY REPORTED THIS INC--DENT, TO WHICH SHE STATED
THAT THE POLICE DID RESPOND TO HER ADDRESS ON THAT DATE. WITH THIS
IN MIND A WARRANT CHECK WAS CONDUCTED ON FR4NCISCC VLAUN/DEFENDANT,
WHO IS THE FATHER OF CCRREAS' DAUGHTER. THIS CHECK SHOWED THAT THERE
WAS NO WARRANT IN EFFECT. AT THIS POINT CORREA WAS ASKED TO GO TO
THE SALEM POLICE STATION TO PROVIDE A DETAILED STATEMENT OF THE
INCIDENT. CORREA RESPCEMED DIRECTLY TO TAE SALEM POLICE STATION AND
PROVIDED THIS STATEMENT. THE FOLLOWING AREA EXCERPTS FROM CORREAS '
STATEMENT.
ON 07-04-2007, AT APPROXIMATELY 0500 HOURS, THE FATHER OF HER
DAUGHTER ARRIVED AT HER APARTMENT AT 183 OCEAN AVE. WEST. WHILE IN
THE APARTMENT VLAUN WAS ACTING WIERD. ALI OF THE SUDDEN VLAUN JUMPED
ONTO CORREA WHO WAS LAYING IN HER BED AND STARTED TO CHOKE HER.
CORREA STATES THAT SHE TOLD HIM THAT SHE COULDN'T BREATHE, VLAUN
THEN PULLED HIS HANDS OFF OF HER NECK AND PUNCHED HER IN THE MOUTH.
AN INSPECTION OF CORREAS' MOUTH SHOWED A BRUISE ON THE OUTSIDE OF HER
TOP LIP AND A PURPLE BRUISE ON THE INSIDE OF HER TOP LIP. CORREA
GOES ON TO REPORT THAT SHE RAN IOWNSTAIRS IN AN ATTEMPT TO CONTACT
A NEIGHBOR BECAUSE SHE WAS SCARED FOR HER LIFE. AFTER THIS VLAUN
DROVE OFF IN HIS VEHICLE. CORREA THEN ADDS THAT ON 07-07-2007 SHE WAS
AT A LUAH. ON 07-08-2007 AT APPROX. 0005 HRS, SHE RECEIVED A CALL FROM
VLAUN. VLAUN TOLD CORREA OVER THE PHONE THAT WHEN HE CATCHES HER SHE
IS DEAD. CORREA ADDS THAT VLAUN STATED THIS BECAUSE HE FEELS THAT
SHE FLATTENED TWO OF HIS TIRES .
WHILE CORREA WAS AT THE SALEM. POLICE STATION (12) DIGITAL PHO--CS
WERE TAKEN OF THE INJURIES SUSTAINED. CORREA STATES THAT SHE HAS
(17) OTHER PHOTOS CN HER CELLPHONE CAMERA, WHICH WERE TAKEN SHORTLY
AFTER THE ASSAULT. CORREA STATES THAT SHE HAS BEEN DATING VLAUN
FOR NINE YEARS AND HAS NEVER SEEN HIM ACT THIS WAY.

IT SHOULD BE NOTED THAT BASED ON THE OBSERVATIONS MADE, THERE
APPEARS TO BE THREE ILLEGAL APARTMENTS IN THE BASEMENT OF 63 SALEM
ST. THE BUIjDiNG INSPECTOR WILL BE FOWARDED A COPY OF THIS REPORT.
CORREA WAS ADVISED OF HER RIGHTS UNDER THE DOMESTIC ABUSE LAW.

On Wednesday, April 18, 2001, I was called to 63 Salem Street to investigate an illegal
apartment located in the basement of 63 Salem Street. Jeff Vaughn from the Health
Department accompanied me.
What we found was four separate rooms that have been constructed illegally as well as a
bathroom that was built without permits.
Five people were living in this extremely dangerous situation.
We were told by 3 of the people living there that they were each paying you$100.00 cash
only, per week to occupy these rooms.

Dear Sir or Madam:
In accordance with Massachusetts General Law,Chapter 111, Sections 127A and 127 B and 105
CMR:410.000: Chapter H,State Sanitary Code,Minimum Standards of Fitness for Human Habitation,an
inspection of the above cited area was conducted by me,Jeff Vaughan Board of Health Sr. Sanitarian. Tom
St.Pierre of the Building Department was present also.
The following was observed in this unit:
One means of egress,4-5 unrelated people living in basement, inadequate kitchen facilities,rodent
infestation,chronic dampness/wet carpets,lack of electricity,lack of proper ventilation,unfinished floors,
malfunctioning smoke detectors. The area is set up as a typical common area basement with exposed
piping,boiler,water heater etc,with three rooms sectioned off. A full inspection was not completed.
Based upon these observations,the Board of Health determines that the basement is unfit for Human
Habitation. The danger to the life or health of the occupants is so immediate that immediate
condemnation is ordered and the hearing requirements of 105 CMR 410.831B and C are waived.
The occupants are being ordered to vacate the basement immediately. If any person refuses to leave
the basement they may be forcibly removed by the Board of Health or by local police authorities on the
request of the Board of Health.
The basement unit must be secured.
No dwelling or portion thereof which has been condemned and placarded as unfit for human habitation
until written approval is secured from,and such placard is removed by,the Board of Health. No person
shall deface or remove placard,except the Board of Health shall remove it whenever the defect or defects
upon which the condemnation and placarding action was based have been eliminated.
Should you be aggrieved by this Order,you have the right to request a hearing before the Board of Health.
A request for such a hearing must be received in writing in this office of the Board of Health within seven
(7)days of receipt of this Order. At said hearing,you will be given the opportunity to be heard and to
present witness and documentary evidence as to why this Order should be modified or withdrawn. You
may be represented by an attorney. Please also be informed that you have the right to inspect and obtain
copies of all relevant inspection or investigation reports,orders,and other documentary information in the
possession of this Board,and that any adverse party has the right to be present at the hearing.

410.600: Storage of Rubbish and Garbage
�._ Garbage or mixed garbage and rubbish shall be stored in watertight receptacles
with tight-fitting covers. Said receptacles and covers shall be of metal or other
durable, rodent-proof material. Rubbish shall be stored in receptacles of metal or
other durable, rodent-proof material. Garbage and rubbish shall be put out for
collection no earlier than the day of collection.
(3)` Plastic bags shall be used to store garbage or mixed rubbish and garbage only if
used as a liner in watertight receptacles with tight-fitting covers as required in 105
CHI{ 410.600(x) provided that the plastic bags may be put out for collection except in
those places where such practice is prohibited by local rule or ordinance, or except
In those cases where the Department of Public Health determines that such practice
constitutes a health problem. For purposes of the preceding sentence, in making its
determination, the Department shall consider, among other things, evidence of strewn
garbage, torn garbage bags, or evidence of rodents.
(C) The owner of any dwelling that contains three or more dwelling units, the owner of
any rooming house, and the occupant of any other dwelling place shall be responsible
for providing as many receptacles for the storage of garbage and rubbish as are suf-
ficient to contain the accumulation before final collection Or ultimate disposal, and
shall so locate them to be convenient to the tenant that no objectionable odors enter'
any dwelling.

garbage, rubbish or other refuse. The owner of such parcel of land shall correct any
condition caused by or on such parcel or its appurtenance which affects the health or
safety, and well-being of the occupants of any dwelling or of the general public.

(B) Dwe11Ln R, units. The occupant of any dwelling unit shall be responsible for
maintaining in a clean and sanitary condition and free of garbage, rubbish, other
filth or causes of sickness that part of the dwelling which he exclusively occupies
or controls.
(C)' Dwellings Containing Less than Three Dwelling Units In a dwelling that contains
less than three dwelling units, the occupant shall be responsible for maintaining in
a clean and sanitary condition free of garbage, rubbish, other filth or causes of
sickness the stairs or stairways leading to his dwelling unit and the landing adjacent
to his dwelling unit if the stairs, stairways or landing are not used by another
occupant.
(D) Common Areas. In any dwelling, the owner shall be responsible for maintaining
in a clean and sanitary condition free of garbage, rubbish, other filth or causes of
sickness that part of the welling which is used in common by the occupants and which
is not occupied or controlled by one occupant exclusively.
(1) The owner of any dwelling abutting a private passageway or right-ofway,
owned or used in common with other dwellings or which the owner or
occupants under his control have the right to use or are in fact using
shall be responsible for maintaining in a clean and sanitary condition
free from garbaga, rubbish, other filth or causes of sickness that part of
the passageway or right-of-way which abuts his property and which he or
the occupants under his control have the right to use, or in fact using,
or which he owns. -

CONTAINERS OR OR BUNDLES OF HOUSEHOLD AND ORDINARY COMMERCIAL WASTE GARDEN AND LAWN
WASTE These shall be placed at the outer edge of the sidewalk appurtenant to the
premises of the owner not later than 7:00 a.m. on the day of collection and not
before 6:00 p.m. on the day preceding the day of collection, and shall be removed
from the sidewalk on the same day as emptied. No commercial establishment shall
place or cause to be placed more than four barrels or other containers of ordinary
commercial wastes or any extraordinary commercial or industrial wastes or tree
waste upon any sidewalk or way for disposal.
Should you be aggrieved by this Order, you have a right to request a hearing before
the Board of Health. A request for a Hearing must be received in writing in the
office of the Board of Health within seven (7) days of receipt of this Order. At
this Hearing, you will be given an opportunity to be heard and to present witness
and documentary evidence as to why this Order should be modified or withdrawn. You
may be represented by an Attorney. Please also be informed that you have the right
to inspect and obtain copies of all relevant inspection or investigation reports,
Orders, Notices or other documentary information in the possession of the Board
and that any adverse party has the right to be present at the Hearing.
Failure on your part to comply within the specified time can result in a complaint
being sought against you in Salem District Court.
One or more of the above violations constitutes a condition which may endanger or
materially impair the health or safety and well-being of the occupant(s).

1..Rent WiLhholdino(Massachusetts General Laws,Chapter 239,section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if.
A. You can prove that your dwelling unit or common areas contain code violations wbich are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
your.rent
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rentI-=court if a judge orders you to pay it(For this,itis best to put the,
rent money aside in a safe place.) _
2. RUair and D eon t(Massachusetts General Laws,Chapter 111,section 127L):The law sometimes allows you to use your rent .
