DECISION ON THE PETITION OF THE SPANISH AMERICAN CLUB OF SALEM, INC, TO USE THE EXISTING NON-CONFORMING BUILDING AT 51 SALEM STREET (R-3 DISTRICT) AS A PRIVATE CLUB. Hearing on this petition was held on September 21, 1976 with Chairman John M. Gray, Sr. , and members Jane T. Lundregan, William Abbott, Arthur LaBrecque and Donald Eames present. Notices were duly mailed to abutters and others in accordance with Massachusetts General Laws, Chapter 808. Atty. Maurice Chouinard represented the petitioners, and stated the property is at the corner of Salem and Palmer Sts. , and the club entrance will be on Palmer Street. He stated that he realized there were parking problems in the area, but that most of the Spanish-American people live in the arm and would be walking to the club. He submitted 150 individually signed statements in favor of the club. There were many abutters appearing in opposition to the petition because parking, vandalism and traffice problems already existing, and the fact that a private club would increase these problems in a residential j area. The hearing was closed, and the decision postponed until the October 19, 1976 meeting. The matter was taken up on October 19, 1976 with Chairman John M. Gray, Sr. , and members Jame T. Lundregan, William Abbott, Arthur LaBrecque and Donald Eames present. The Board voted to deny the variance requested, although the Board was in sympathy with the desire of the people in the area to have a social club in the neighborhood. The Board found that it could not grant such a use in a residential neighborhood without detriment to the surrounding neighborhood. Although it would be a private club it is commercial in nature, in that it would attract large numbers of persons and if the petition were granted the club intended to seek an alcohol beverage license. Also there was evidence presented that the neighborhood, at present, has parking problems and that the particular piece of property in question has been the scene of much vandalism and trouble in the past. Therefore, the Board found that it could not grant the variance requested without substantial detriment to the public. Pierre and Joe Barbeau, Fire Prevention inspector Charles Holloran, Board of Health inspector Janet Dionne. City Electrician John J. Giardi was asked to review the site mentioned above for electrical safety concerns. The Fire Alarm system was not working at the time. The audible switch was in the silent position and the panel was in alarm condition. Upon further inspection I found the following violations of the National and Massachusetts 2005 Electrcal Codes. Code Violations are as follows 1.Article 300.1 (a.) all wiring installations 300.4 protection against pysical damage. Non metallic sheathed cables were installed improperly across floor joists and along the face of the foundation. B.X. cables were also installed improperly without clips. I 2.Article 310.60 Table 310.16 allowable ampacities of insulated conductors Rated 0 through 2000 volts. Wire sizes are found to be wrong for the applications. A number of compressors are not sized accordingly. 3.Article 312 Cabinets, Cutout Boxes, and meter Socket Enclosures. 321.5 (a) all openings shall be closed. Junction boxes, switch boxes, and controllers had openings not being used. 4.Article 314.16 Number of conductors in outlet, device, and junction boxes, and conduit bodies. Various juction boxes are under sized with to many conductors spliced in them. 5.Article 334.30 Securing and supporting non metallic sheathed cables. Cables shall be supported at intervals of 4-1/2 feet and within 300mm (12 inches) of every outlet box. 6.Article 422.30 Disconnecting Means. Each Appliance/Motor shall have a disconnecting means. A hot water tank in the basement did not comply as well as a number of Compressors did not have one either. 7.Article 430 Motors. Not only are compressors wired, sized, and fused improperly, the selection of overload relays are not correct. Article 430.32 (a) (1) and 430.32 (b) (1) 8.Article 430.72 Overcurrent Protection for the compressors in the basement was not calculated properly using the wrong size circuit protection. 9.Article 314.17 Junction Boxes. All Junction boes shall be closed and no unused openings should be present. Junction boxes were open and wires were petruding from them. Mr. Bahal the inspectors have been to this location on several occasions for numerous complaints and violations. Please be advised at this time that the violations mentioned above are very serious in nature. The Fire Alarm system is inoperable. The other violations mentioned are of great concern because of the wiring being inadequate to serve the load at hand. All violations shall be corrected upon receipt of this letter. A licensed Electrician shall obtain an permit from the City of Salem Electrical Department. Failure to comply will result in Court action as well as electricity being turned off. Following the inspection the Survey Board held a meeting and all were in agreement with regards to the hazardous condition of the roof, which should be removed. All debris and garbage had been removed prior to our inspection and construction debris was in the process of being removed during our inspection. Our inspection also showed the chimney to be a danger to the public safety and will be removed by days end August 11, 1993. The Board felt the exterior walls were structurally sound and the owner should be allowed to construct a new roof and make all necessary repairs. The owner will obtain and Engineer, as well as an Architect, to help him meet all code requirements and to assure the Building Dept. that the structure has been made safe. Tremblay: On August 9, 1993, I inspected the partially collapsed building at the above location and found the structure to be a danger to life and limb to residents living adjacent to the property and pedestrians using public ways. Of particular concern are the many children in the immediate area of this structure. A substantial roof area has collapsed in the central portion of the building including the structural support system. The balance of the structure in imminent danger of collapse. The brick chimney is dangerously deteriorated, and the masonry bearing wells are severely damaged. I would recommend to the Fire Department and any other personnel that no admission to the premises be permitted. In my opinion, the building should be demolished by licensed personnel forthwith. D e P e r l m e n t "f ENVIRONMENTAL What are the major concerns about used white goods? P R 0 T E c T 1 0 N Many older white goods contain capacitors, lighting ballasts or refrigerants that can be harmful to our health and the environment. Although the federal government banned the production of polychlorinated biphenyls(PCBs) in 1979, many older capacitors and lighting ballasts may still contain PCBs, a known carcinogen and a regulated hazardous waste when disposed. In addition, refrigerants found in freezers, refrigerators and air conditioners may contain chlorofluorocarbons(CFCs), which are harmful to the ozone layer. When these appliances are moved in bulk, crushed, baled or shredded without first removing the capacitors and refrigerants, PCBs and CFCs may be released to the air or soil. How do Massachusetts regulations affect the management of used white goods? Disposal Regulations: In Massachusetts, white goods are banned from solid waste disposal facilities. However, recycling is an acceptable management approach and the value of the materials can be recovered for reuse or recycling. PCB Regulations: Massachusetts hazardous waste regulations require that any waste containing greater than 50 parts per million PCBs must be handled, stored, transported, treated and disposed of as a hazardous waste. Residues from white goods that are crushed or shredded with their capacitors intact typically contain some quantity of PCBs, often in excess of 50 parts per million. CFC Regulations: Individuals servicing and disposing of air conditioning and refrigeration equipment are prohibited from knowingly venting refrigerant into the atmosphere. If refrigerants are recycled or reclaimed, they are not considered hazardous waste under federal or state law. However, the equipment and the technician must be federally certified. How should white goods be handled prior to bulking? The best management practice will ensure that white goods are not crushed or baled prior to removal of capacitors, ballasts or refrigerants. The preparation of discarded white goods for bulking may be done by a municipality, an appliance dealer or a processor. Reduction of the levels of PCBs in processed white goods to below 50 parts per million will permit the handling and recycling of white goods residues as solid waste, not hazardous waste. The first step is to determine whether you will remove PCB capacitors, lighting ballasts and refrigerants from the white goods. If you offer this service, then you need to train your employees to identify and remove PCB capacitors, lighting ballasts and refrigerants in a safe and effective manner. Removal of CFCs requires use of special equipment. Be sure to inspect every white good prior to processing to ensure that every PCB capacitor and lighting ballast has been removed and the CFCs collected. It is necessary to manage PCB capacitors and lighting ballasts that test greater than 50 parts per million PCBs as hazardous waste. If the commercial shredder determines that you must remove all PCB capacitors, lighting ballasts and refrigerants, you are required to sign a statement. Portions of the roof were being cut away; the remaining portions were in a state of decay and severely stressed and falling. (b) Portions of brick & block walls were breached. Partial but substandard repairs were made to secure these openings. (c) A brick chimney was in a state of disrepair and was in danger of falling. Upon my first inspection of this property on Friday, August 6, 1993, the first level to the right of the main building (#24 Palmer Street) was littered with debris and building materials, and was in a state of partial collapse due to failure of beams and columns constituting a severe fire, health and safety hazard. On a subsequent inspection this date, much of the debris had been cleared away and work was in progress to mitigate the potential for collapse of the roof sections. - 2 - The Salem Fire Department has no objection to the owner making corrections to the building (removal of the roof and chimney) to mitigate the fire and collapse hazard and to effect reconstruction of the building with closure to the elements within a time limit acceptable to the Inspector of Buildings. Such building shall be made secure to insure the safety of the public. In view of the work being performed by the owner, this property is no longer dangerous and need not be removed as outlined in Section 124.2 of the Code. Robert W. Turner, Acting Chief THE MASSACHUSETTS STATE BUILDING CODE down or to be made secure; and, if the public safety so requires, said building official may at once enter the structure, the land on which it stands or the abutting land or buildings, with such assistance as he may require, and secure the same; and may remove and evict, under the pertinent provisions of Chapter 239 of the Massachusetts General Laws Annotated as amended, or otherwise, any tenant or occupant thereof; and may erect such protection for the public by proper fence or otherwise as may be necessary, and for this purpose may close a public highway. In the case of such demolition, the said building official shall cause such lot to be levelled to conform with adjacent grades by a nonorganic fill. The costs and charges incurred shall constitute a lien upon the land upon which the structure is located, and shall be enforced in an action of contract; and such owner shall, for every day's continuance of such refusal or neglect after being so notified, be punished by a fine in accordance with Section 121.4. The provisions of the second paragraph of Section 3A of Chapter 139 of the Massachusetts General Laws Annotated as amended, relative to liens for such debt and the collection of claims for such debt shall apply to any debt referred to in this section, except that the said building official shall act hereunder in place of the mayor or board of selectmen. During the time such order is in effect, it shall be unlawful to use or occupy such structure or any portion thereof for any purpose. 124.3 Remedy of person ordered to remove a dangerous structure or make it safe: An owner, aggrieved by such order may have the remedy prescribed by Section 2 of Chapter 139 of the Massachusetts General Laws Annotated as amended; provided that any provision of said Section 2 shall not be construed so as to hinder, delay or prevent the building official from acting and proceeding under Section 124.2; and provided, further, that .this section shall not prevent the city or town from recovering the forfeiture provided in said Section 124.2 from the date of the service of the original notice, unless the order is annulled by the jury. 125.0 RESERVED SECTION 126.0 BOARD OF APPEALS 126.1 State Building Code Appeals Board: Whoever is aggrieved by an interpretation, order, requirement, direction or failure to act under this code by any agency or official of the city, town or region, or agency or official of the State charged with the administration or enforcement of this code or any of its rules or regulations, excepting any specialized codes, may appeal directly to the State Building Code Appeals Board as provided in Section 126.0. If it appears that such structure would be especially unsafe in case of fire, it shall be deemed dangerous within the meaning hereof, and the building official may affix in a conspicuous place upon its exterior walls a notice of its dangerous condition, which shall not be removed or defaced without authority from him. 123.2 Removal or making structure safe: Any person so notified shall be allowed until twelve o'clock noon of the day following the service of the notice in which to begin to remove such building or structure or make it safe, or to make it secure, and he shall employ sufficient labor speedily to make it safe or remove it or to make it secure; but if the public safety so requires and if the mayor or selectmen so order, the building official may immediately enter upon the premises with the necessary workmen and assistants and cause such unsafe structure to be made safe or demolished without delay and a proper fence put up for the protection of passersby, or to be made secure. SECTION 124.0 EMERGENCY MEASURES 124.1 Failure to remove or make structure safe, survey board, survey report: If an owner of such unsafe structure refuses or neglects to comply with the requirements of such notice within the specified time limit, and such structure is not made safe or taken down as ordered therein, a careful survey of the premises shall be made by a board consisting; in a city, of a city engineer, the head of the fire department, as such term is defined in Section 1 of Chapter 148 of the Massachusetts General Laws Annotated, as amended, and one disinterested person to be appointed by the building official; and, in a town, of a surveyor, the head of the fire department and one disinterested person to be appointed by the building official. In the absence of any of the above officers or individuals, the mayor or selectmen shall designate one or more officers or other suitable persons in place of the officers so named as members of said board. I have also contacted Charles Quigley, City Engineer, he was unable to make the survey on August 11, 1993 but he assured me he had inspected the sight on August 10, 1993 and I have enclosed a copy of his written report. Following the inspection the Survey Board held a meeting and all were in agreement with regards to the hazardous condition of the roof, which should be removed. All debris and garbage had been removed prior to our inspection and construction debris was in the process of being removed during our inspection.
