I have just received your letter dated October 8th regarding the
x • Regional Development Corporation. I understand from the Mayor that
e he does not intend to veto the Order dated September 26, 1974 regarding
criminal proceedings against the Regional Development Corporation for
violation of the zoning ordinance. Enclosed you will find a copy of
an additional Council Order dated September 26, 1974 requesting immediate
legal action against the Regional Development Corporation in regard to
S, the installing of sidewalks. I am also informed that the Mayor does
not intend to veto this second Order. As of October 10, 1974 both
a
Orders shall come into legal effect.
I hereby designate you to proceed with the strict enforcement of both
Orders and authorize you on behalf of the legal department of the City
C of Salem to commence whatever legal actions are available to the City
., to fulfill these orders. There can be no question of your capacity or
authority to proceed since Section 2-184 of the Salem Code of Ordinances
states that .the Assistant City Solicitor may perform all duties required
of him in furtherance of the tasks of the legal department. I am also
confident of your qualifications and your previous actions in regard to
this situation gives me confidence that you will accomplish the objectives
desired by the City Council. I further authorize you to report directly
to the City Council on the steps that you are taking to implement the
Council 's Orders as long as you keep me advised.

Dear Mr. Tinti:
I am on this day in receipt of a copy of the September 26, 1974 order #830
of 1974 to be presented to the Mayor for approval on September 30. I hereby
acknowledge that as City Solicitor it is your responsibility to begin appropriate
criminal proceedings against the owner or owners of Regional Development Corporation
or alternately advise the Mayor to veto such order. If the Mayor does not wish to
veto such order on your advice then I suggest you contact the Clerk of the First
District Court of Essex and make application for criminal complaint under Section
10of the zoning ordinance relating to a certificate of occupancy.
It is my impression, such a duty or responsibility as the City Council has
placed on you, should be borne by the building inspector if we had one. If the
Mayor appoints a building inspector and vetoes the order, the City Council should
be advised that such order be taken to the building inspector instead of overriding
the Mayor's veto. Further alternative is that you advise the Mayor to veto such
order, appoint such building inspector, and when the order is returned to the
Council have the Mayor assure the Council that he will approve such an order.
In any event I shall be pleased to draft a report in writing for your
signature for the City Council along whatever lines you direct and will be pleased
to accompany you to District Court if you wish to seek such a complaint on or by
October 10, 1974. It is possible the Clerk of Courts may wish to expedite this
matter and bring it to a head in the court since the owner or owners of Regional
Development Corporation appear to have been on notice since at least the middle of
August that they appear to be in repeated violation of Section 10 of our City
Ordinance.
Kindly letter advise your thinking as to the above.

We have purchased batteries, battery chargers, transfer
switches and inverters for the fire alarm system backup
at the Salem Heights project. The batteries and transfer
switches have been received and are already installed.
The inverters and battery chargers are en route from the
Terado Transformer Company in St. Paul, Minnesota. They
left there on September 12th. Yesterday we started a
tracer to determine the location of these; however, the
usual shipping time from that area is about two to three
weeks. We, therefore, expect to receive these within
the next eight to ten days.
We are doing everything possible to expedite the receival.
We will install these within two days of their arrival.

Gentlemen:
I am enclosing an opinion from our consulting engineers on the
suitability of the outdoor installation of the emergency generator. I would
like to add my own comments, as follows:
Because this unit is designed and engineered for outdoor installa-
tion and because the engine is electrically heated at all times and is fired
with natural gas, thereby eliminating viscosity and vaporization problems
at low temperatures, it is my opinion that the outdoor installation is entirely
proper, and the reliability'of the unit will be at least as high as if it were
installed inside a building. The indoor installation would require some
! modification of the unit and would pose a serious possibility of overheating,
stalling out after a short period of operation.

We recommend that the generator not be enclosed by anything
` other than an open fence, which might be of some help in that it could prevent
anyone tampering with the unit.

As a result of an electrical inspection made on August 16,
1974 of Building "A" , Salem Hei_gh.ts , I found the wiring and elec-
trical equipment to be in good order.
In the interest of "Public Safety" I concur with the Building
Inspector, that the emergency generator should be enclosed in a
heated and properly ventilated room.
When this complex has been approved in its entirety by all
local inspection authorities , I shall submit to you the National
Fire Prevention Association and the Commonwealth of Massachusetts
Electrical Code requirements for the proper maintenance test and
inspections of your Fire Alarm System and Emergency Generator.

If the inclusion of the battery back-up system described
below will result in the issuance of the Occupancy Permit,
we will agree to provide it by September 9, 1974.
The back-up system will be designed and engineered by us
and will comprise of lead-acid, storage batteries , sufficient
capacity to operate the Fire Alarm System under alarm
conditions of two hours.
Batteries will be equipped with an automatic transfer
switch and a charging device to keep them permanently
fully charged and a disarrangement signal.

As a result of a re-inspection this date of the real estate situated
on Pope Street, and known as Building A, Salem Heights; the following
conclusions have been made regarding the fire protection.
Numbered in order of appearance on letter dated August 16, 1974.
1. Annunciator Zones: Permission granted to Mr. John Parry on July 29, 1974
for a four-week extension on customizing of zoning. This will not hold up
occupancy, but should be in process stage at this time per letter from
Mr. Parry dated July 29, 1974.
2 Annunciator in Lobby: An attempt to provide designation by use of
gummed labeling, for each annunciator is not satisfactory. Because of
vandalism, this designation by building shall be a permanent plate attached
to the annunciator.
3 Lobby corridor doors: Wedges have been removed. It now appears that
the corridor doors from Building A leading to the main egress and held open
by electromagnetic door holders, should be opening in the opposite direction.
This matter should be resolved by your office.
4. Occupancy of apartments continues, under fire watch protection.
5,,, Sprinkler bell has been provided for both structures.
6. Fire hose nozzle has been replaced with a new nozzle.
7. Fire lane barricade has been provided. Key has been provided,
No Parking sign should also be posted at upper end of Fire Lane.
8. Sprinkler flow switch test was conducted this date. The switches are
apparently sticking and the proper annunciator zones would not light up.
Work will be started on August 27th to correct this problem.
9. Armour Elevator has promised to send an elevator key.

to ask you to reissue the building permit issued to Regional Development Co. ,
Inc. , on March 29, 1973, to the Salem Heights ApartmentCompany.
When the permit was applied for on October 25, 1972, the application
was made by an officer of Regional which is a general partner in Salem Heights.
Because of an administrative oversight the name on the application was not
changed to Salem Heights when that partnership came into being. This incon-
sistency is causing some difficulty in dealing with F.H.A. which is financing
the project.

of each apartment, and connected to the master fire alarm through the
nearest sone.
b. Corridor doors shall be held open with electro-magnetic devices
controlled by a smoke detector adjacent to each side of the door and
connected to the master fire alarm box for automatic operation.
c. Heat detectors on 10th floor stairwells shall be replaced by
approved sprinkler heads.

standpipe valves shall be zoned on the level by use of a flow switch.
e. One annunciator light shall be tied in to the os and y valve.
13. Plans should show complete ten inch fire supply line from source at
public main. This water main shall be looped from Pope Street out
to Proctor Street
At least one Darling fire hydrant shall be provided at the circle,
located to be available to incoming fire apparatus.
It is therefore recommended that no building permit be issued
until a conference with all code enforcement officials is conducted
by Building Inspector O'Brien.

In accordance with the applicable provisions of Chapter 121A of
the General Laws , the Planning Board is pleased to submit herewith, and
in response to your request , its report concerning the application of
Salem Heights , a limited partnership, Joseph Corcoran and Joseph Mullins,
General Partners , to construct,` operate and maintain a development off
Pope Street under the provisions of Chapter 121A of the General Laws.
In accordance with the letter of transmittal from William Richardson,
Deputy Commissioner of the Department`,of Community Affairs , we hereby
,§ file the following report..

k The letter of instruction from the Department of Community Affairs
includes the following
"Such findings must include the following:
1. Whether the project area is a blighted open area, or a substandard
area, or a decadent area. See definitions in Section lone) of
Chapter 121A. )
2. Whether the proposed project conflicts with the Master Plan of the
City.
3 . Whether the project would in any way be detrimental to the best
interest of the Public or the City or the Public Safety and con-
venience , or inconsistent with the most suitable development of the
City.

4. Whether the project will constitute a public use and benefit.
The Planning Board, after the Public Hearing, shall submit to you a report
approving or disapproving the- project together with the above findings ,
and with the reasons for such approval or disapproval" .
As required by Section Six of Chapter 121A, the Planning Board held
a hearing on September 7, 1972 , of which notice was published August 17 ,
and August 21 , 1972 , in the Salem Evening News , in accordance with the
statutory requirements.
The applicants were represented at the hearing by Attorney Jacob
Segal .
The Statute requires that the Planning Board find that the area in-
volved is either a "blighted open area" , or a "decadent area" , or a "sub-
standard area" . Review of Chapter 121A, Section One , clearly indicates
that the project can only be considered under the definition "blighted
open area" since the other two definitions make reference to buildings or
dwellings.
Evidence was presented to the Board in the form of testimony from
a Mr. Doherty, Engineer with the developer, who testified that the area
is almost a solid block of granite, has steep grades , and slopes , and is
composed of such terrain as to make development difficult . He estimated
site preparation costs to be $1 , 500.00 per unit , or almost $500,000.00.
The Board has in mind that one of the criteria for finding a
"blighted open area under the Law is evidence of rock or ledge making it
difficult to develop conventionally" . While the Board would agree that
there exists in this area conditions that would make construction diffi-
cult and expensive , it can not state with certainty that development
without Government subsidy would never occur.

The Planning Board is further required to find whether or not the pro-
posed project conflicts with the Master Plan of the City. The Master Plan
of the City of Salem consists of a series of documents which have been ac-
cepted from
c-cepted .from time to time as guidelines to the Planning Board and the Public
in its review of projects and proposals . One such document is the Salem
Zoning Ordinance which was revised substantially in 1969 , including the
revision to permit in the project area and an adjacent area occupancy use
for multi-family residential purposes . The plans show that the project ,
if constructed in. accordance therewith, will be in accordance with the
applicable requirements of the Zoning Ordinance . No ,conflict therefore ,, '.
between this proposal and the Master Plan of the City can be seen to exist .
The Board is further required to determine whether or not the project
would be in any way detrimental to the best interests of the Public , or
the City, or to the Public Safety and Convenience, or be inconsisten-t with tine
most suitable development of the City. The Planning Board is aware that
the City has one other housing project under contract financing by the
Massachusetts Housing Finance Agency for low and moderate income families
eligible for rental 'assistance pursuant to Section 236 of the National
Housing Act, as this project is proposed to be .
The providing of 284 units of housing for such families in the project
area would appear to be beneficial to the best interests of the City and
the Public Safety and Convenience, and to be consistent with the suitable
development of the City. Since the majority of units will be of one and
two-bedroom type , this project will provide housing for the sector of the
rental market where this type of housing is in demand. There is question
on the part of the Board whether the financial return to the City as pro-
vided under Chapter 121A will be adequate to the City in the long run, and
whether or not this type of financing might not indeed be detrimental to

the long range financial planning of the City. There is also some question
as to whether such a large development at this particular location might in-
crease an already difficult traffic problem. The areas served by Proctor,
Pope and Boston Streets will be affected by this development . There is pres-
ently a "Topics" study in the area of Boston and Bridge Streets that could be
seriously affected by an increase in traffic from Pope Street.
The Board is further required to find whether or not the project area
will constitute a public use and benefit . The providing of housing in the
project area will constitute a public use and benefit , particularly since
at least forty percent of the dwelling units in the project area must be
occupied for families of low income . In the City of Salem, there are some
850 people on the waiting list for so-called old age housing. A minimum of
40% of the units in the proposedr;project area are being set aside for use by
The Salem Housing Authority for its elderly applicants . The present admin-
istration has declared that housing for the elderly is a number one priority.
The addition of 40% of the units in the project area coupled with the units
to be available in the Pequot Highlands area, previously approved, will give
the City one.half again the number of units currently existing in the City.
Because of various delays , not within the control of the . Salem Housing Author'
ity, new construction of additional units is at a standstill. While ' the
Board is aware of this , it wonders if this is the most efficient way in which
these units may be supplied in view of the limited tax return on the entire
project . It is concerned that the construction of these units may contribute
to a change of character in the nature of the general residential use of the
City which will be detrimental . It would appear that while the supplying of
the City with additional units for "old age housing" would be an advantage,
to the City, there are many facets of the project that might be disadvantageous .

It is the feeling of the Planning Board that it would be in the best
interest of the City to defer any decision on the construction of the pro-
ject in question until such time as the apartment units on Highland Avenue
have been completed and a sufficient time has elapsed to study their effect
on the community.

On behalf of Mr. Mullins and myself I would like to thank you very much for 1
giving us such a warm reception at your office last week.
Since the development of real estate within a city requires much cooperation
on the part of both the Developer and City Officials, we were encouraged by
your positive attitude. We feel, as I believe you do, that a well conceived
apartment complex would be a distinct asset to the City of Salem and would
provide much needed moderate rent housing. We have already met with the FHA
and have submitted an application for a feasibility letter.
At your suggestion I am outlining some zoning considerations which we will
have to resolve prior to our being able to develop this complex:
(1) R-3 height limitation appears to be 3 stories or 35 feet. We are
proposing a 10-story elevatored building, and a special permit or
variance would appear to be necessary.
(2) Two access roads. We can only provide one feasible access road.
(3) Access to our site is over R-2 zoned land on Proctor Street.
A variance will be needed to permit access at this point.
(4) Parking. We can provide 1001. parking on-site, but the zoning
law requires 1501.. This is a burden since we anticipate that
at least 1/3 of the units will be rented to elderly persons.
(The Department of HUD requires only 1001. parking in all their
projects).
We are prepared to move as quickly as possible on this development and feel
confident we can make this a reality in the near future.
