The City Solicitor's office stated that the Commission as a body should not have discussed the issue (and
voted to send a violation letter to the developer) because it did not first notify the developer that the issue
was going to be discussed at a meeting (a potential violation of the open meeting law). Therefore, a
violation letter has not yet been issued. The City Solicitor's Office requested that the Commission first try
again to work with the developer on a resolution.

Apparently the faux chimney was not constructed well enough to carry the load of the additional brick and
the owner's engineer(?) feels it might not survive an extremely strong wind (which is why they took off the
bluestone cap) ... so I'm thinking it does not matter how strong the roof is unless we can also find a way to
add more bricks to the chimney itself. So does it appear to you that the only options are to leave it at the
current height (along with the proposed 9" brick corners)... or... completely rebuild it from the roof up to
the taller height? Can you ascertain from the old and current photo, how much shorter the current
chimney is from the old chimney?

Hi Jane,
Sorry not to get back to you. I was sort of expecting that you'd be at the site walk-thru last
weekend so could review it then - hadn't remembered that you tend not to go on those.
Anyway, it's a bit of an interesting problem. Putting an additional piece of structure in the
chimney to support the top is quite a difficult (and expensive) thing to do. They should be
able to lay additional courses of brick on the top of the existing brick so long as the roof
framing is sufficient to carry the load of the additional brick. If not, then they'll need to add
some reinforcing to the roof. I can show you quick sketch in person.
Also, not sure if I'll be at this coming hearing on the 15th. I'm scheduled to take my son to
Brown for interview so not sure if we'll be back in time. Let me know if you need me for a
quorum and I can review schedule with him. Otherwise I'll come to the hearing if we're
back.

Some members did not like the idea of it being faux chimney, but I told them that he has the right under non-applicability to repair
or replace as long as there is no change in outward appearance. It is really the owner's call on whether he wants it to be a
working chimney or not.
This has been a somewhat difficult development-the owner did several things without approval and a few times had to come in
asking for forgiveness after getting caught. This has not sat well with some members. They feel the faux chimney should have
been built sturdier so it would replicate the original (the owner actually wanted to completely remove the chimney, but he got
denied). There is also a very difficult neighbor who adds fuel to the fire.

Hi Larry,
In October, 2010, the Commission issued approval for the chimneys at 60-62 Washington Sq. to be repaired or replaced in kind
(conditional that existing be documented photographically prior to commencement of work, which was never done). It was known
that the chimneys would be replaced as faux chimneys. Once completed, some Commission members felt that the rear chimney
had been reconstructed shorter than the original.
Shortly thereafter, due to leaking, the developer applied to alter the faux rear chimney in December, 2011. He claimed that his
engineer advised against having a bluestone cap on top of the faux chimney. He since took off the blue stone cap as well as the 4
brick corner extensions. However, in response the Commission voted to add l' of brick course and an additional 1' of brick
extensions on the corners... but to eliminate the blue stone cap and instead have a light weight metal flat cap in matte black.
The developer has now offered a new option -which essentially includes only 6-9" of brick extensions with a flat metal cap.... and
he does not want to have to come to another meeting (and he has since sold all the condos). I have told him that he can either
proceed with what was already approved or apply with a new application to alter it.
I have attached pics (#361, #363 ȷ) of the current chimney (which he has capped supposedly temporarily until the issue is
resolved). We never got very good pics of the original chimney, but I have scanned the only decent one I have (60-62wash.jpeg).
I believe the old chimney was leaning a bit, but I do not know in which direction. I also had David take a current photo from the
same angle as the old photo, to try to compare the height(60-62 chimneys.key.pdf).
I am wondering if there is a way to get the chimney finished as was approved(in red above) by inserting some kind of metal
frame/sleeve inside the existing chimney, that would hold a metal plate that the 2' of brick would sit on, without it really sitting on
the faux chimney. There is also a plumbing pipe coming up through the chimney, so there would need to be a hole in the plate.
Since there would be a flat metal cap on top of the brick extensions, someone looking down from a neighboring house would not
be able to see into the chimney to see that it is a separate piece. Not being an engineer, I don't know if this is feasible -
particularly how the bricks would stay on the metal plate and whether mortar between the existing bricks and the plated bricks
could be added in between to achieve the look that it is all one piece.
Ideally, we would like a solution that achieves what was approved to keep this from going back to another meeting. If not, can you
suggest a solution that gets as much height as possible(so we can satisfy the one angry neighbor and the few unsympathetic
commission members, and not require the developer to rebuild the entire chimney -which he would likely refuse to do). Maybe
hearing a fresh prospective from you might get this project resolved.

I was kind of taken aback by the meeting Wednesday and I have some thoughts.
I-First of all the design that we discussed doesn't work.After consulting with my team, raising
the height of the chimney 2 feet- 1 foot built up and 1 foot by brick steps at the corners is not
practical. In light of the framing of the new chimney which currently exists, going up another
foot is not possible as the frame is built for the current height.
2-There were questions of how high the original chimney was compared to the new one. I
checked with my mason and in fact his dog did get the phone as I thought.He assured me it was
slightly shorter-less than a foot. Remember, we had discussed this last Spring and everyone was
OK with the new height.Please drive by again and look at the rear chimney-it is huge and
stately.Whether it is 6 or 8 " shorter means absolutely nothing except to Andrew. Again we
agreed on this height back in the Spring.
3-Remember, this structure was dangerously weak and leaning. It had a large, old style TV
antenna perched at the top, probably there for many, many decades. This has historic relevance?
I wonder if anyone had complained to the former owners about this?
4-The tone of the Commission is adversarial. Most members have an angry tone and continue to
be upset with me and influenced by Andrew's incessant badgering. You continue to listen to his

insanity. This building has gone through a complete renovation and updating and you should be happy but rather until
the end, there is not any flexibility.
5-It is so ironic that he has this holier than thou attitude as he lives in an old, deteriorating aluminum sided house with
vinyl replacement windows. It's the the ugliest building around the area.There isn't a trace of historic significance on
his building. Listening to him, one would think he lives in a gorgeous, historic property.His concern for historic
preservation is laughable as his home is one step above trailer home quality.He has a personal vendetta that is
unexplainable.
5-I am willing to do the design whereby we build up the 4 corners with brick and a metal covering at the top as
discussed. I just cannot raise the height of the chimney by a foot.Using the brick at the corners will get us app 9inches.
6--The wiser and handsomer choice is to treat the rear chimney as the 2 upper chimneys. It would look great. My
opinion.
7-I am no longer affiliated with the condominium association legally as all units have been sold and occupied but I
would like to resolve this. There is a minor leak there that will be resolved by putting a metal sleeve/cover over the top
of the chimney-copper or otherwise. I will be proceeding with that.
Let me know if you agree with the design we came up with minus raising the chimney height a foot or treating the rear
chimney as the 2 upper chimneys.
7-I will not be attending anymore meetings. I find them too distasteful and unproductive.
You can discuss this issue and let me know what your decision is. I would appreciate that.

McBrie LLC was the structural engineer of record during the renovation at the above referenced
project. As part of our investigation of existing conditions we reviewed the rebuilt wood chimney.
We observed minor flex in the chimney as it is currently built. The chimney's current height in
combination with the chimney's small footprint creates a slender structure. Increasing its height will
increase the wind loading on the structure and increase the deflection/flex which would be detrimental
to the chimney structure.

Hello Jane,
Again, we have a situation on the rear chimney .. It was only capped with the copper(metal)without any
addition of feet or the brick corners as in the minutes from 12/7/11. The cap also had a hole in it to
accommodate the "plumbing pipe"as was confirmed would not be the case and it still goes above the
chimney.
To Clarify: My statement about the chimney clearing the roof was to convey that it acomplished this well
below the p the highest point of the roof. It was still to point out that the chimney was originally built so
smoke would not bounce back against the highest point of the roof. It is simple logic that Ms. Herbert
seems to miss here.
Ms.Herbert stated that from the photographs,the rebuilt chimney did not clear the 3`d floor. It is shorter. She did not think a
height was specified,only that it be rebuilt to the height of the original.
I will attach pictures of what currently exists if need be.
Ms. Bellin was one member that was quite clear in confirming with Mr. Legon that he will comply with
what he is agreeing upon from the meeting and not come out of this as he has once again done. I also
agree with Ms. Bellin in clarifying to Mr. Hart that the Commission was not"redesigning"the builder's
project but this was a condition of the original agreement in the request for the original chimneys to be
removed.
Mr.Hart stated that he was getting increasing frustrated that the Commission is designing people's projects. He stated that he felt
the proponent should bring in a design and we should approve it or not. He stated that he did not think it was the Commission's

Hello Jane,
Again, we have a sit-lation on the rear chimney .. It was only capped with the copper(metal)without any addition of feet or the
brick corners as in the minutes from 12/7/11. The cap also had a hole in it to accommodate the"plumbing pipe" as was confirmed
would not be the case and it still goes above the chimney.
To Clarify: My statement about the chimney clearing the roof was to convey that it acomplished this well below the p the highest
point of the roof. It was still to point out that the chimney was originally built so smoke would not bounce back against the highest
point of the roof. It is simple logic that Ms. Herbert seems to miss here.
Ms.Herbert stated that from the photographs,the rebuilt chimney did not clear the 3rd floor. It is shorter. She did not think a height was specified,only that it
be rebuilt to the height of the original.
I will attach pictures of what currently exists if need be.
Ms. Bellin was one member that was quite clear in confirming with Mr. Legon that he will comply with what he is agreeing upon
from the meeting and not come out of this as he has once again done. I also agree with Ms. Bellin in clarifying to Mr. Hart that the
Commission was no:"redesigning"the builder's project but this was a condition of the original agreement in the request for the
original chimneys to be removed.
Mr.Hart stated that he was getting increasing frustrated that the Commission is designing people's projects. He stated that he felt the proponent should bring
in a design and we should approve it or not. He stated that he did not think it was the Commission's roll to design other people's property. He stated that he
understands there is an approval to rebuild a specific chimney and that the owner can go back and see if he did take photographs of the existing. Based on that
lie can also bring forward a different design that he would like to build that will meet our approval.
Ms.Bellin stated this would not be redesigning,but would be clarifying what the original approval was but with one alteration of using a light metal piece
instead of natural bluestone. She stated that we want the original design to be implemented,but are clarifying that we think what was attempted was a foot too
short and we are also trying to facilitate replacing the actual bluestone with a piece of metal.

PROCEDURES FOR FILING APPLICATIONS
A. Be prepared to apply for approvals well in advance of commencing any exterior work. Be-ore making any changes to the exterior of property
in an historic district,the owner should call or visit he Commission representative at the Department of Planning&Community Development to
discuss proposed alterations and to determine the category of the application(Appropria:eness,Non-Applicability or Hardship).
B. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City Hall. The meetings are I.eld at
120 Washington Street,3rd floor,and begin at 7:30 p.m. All meetings are open to the public and any person is entitled to appear and be heard
on any matter before the Commission before it reacies a decision.
C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in
order to make the agenda. An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the
meeting. In some cases,a Certificate of Non-Applicability maybe issued by the Clerk,without review by the fill Commission,after notifying
Commission members and allowing 24 hours for any objection. There is no fee for any applications.
D. All applications for Certificates of Appropriateness or Hardship require a public hearing. Notice of the hearing must be posted with the City
Clerk 14 days before the hearing and abutters must be notified in writing. Commission staff will handle these procedures. A public hearing is
not required for a Certificate of Non-Applicability.
E. Applications must be submitted by the owner of the property. A contractor for the owner,at the owner's request,may submit an application on
the owner's behalf. In case of tenant,a waiver of the owner's appearance maybe granted at the discretion of the Commission if it is.equasted

G. An application will not be considered complete unless all work items are thoroughly described on scaled drawings and include specifications
regarding dimensions, materials, and any other in'ormation needed for the Commission to visualize the changes in order to mace a
determination. Applications for paint colors should include a paint chip or chart. The following items should be included in your drawings as
applicable:
1. Site plan showing location of improvements;
2. Elevation drawings of the specific improvements;
3. Details/profiles(i.e.moldings,fence caps,cornices,vents,etc.);
4. Materials(i.e.wood,brick,etc.);
5. Dimensions(i.e.size of trim);and
6. Transformers,heat pump and condenser locations,electrical entries and meters, .amp posts,stove pipes.
H. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners
having professional consultants such as architects or contractors are urged to have them be present at the hearing. If the application is approved,
a Certificate will be mailed to the mailing address provided on the application and copies wi I be sent to the City Clerk and Building Inspector.
Please note that the application can be continued until the next meeting if the Commission deems necessary(i.e. for reasons of incomplete
drawings,to perform a site visit,etc.). In any case,the Commission must make a determination within 60 days from the date the application is

Spoke to Jessica this am.
Here's the update. There were some fine cracks in the new rear chimney and some leaking
although the roof is new. It was a curious problem with everything being new.
I brought in an engineer to review the chimney. He told me that the top plate was too heavy in
light of strong wind conditions. He thought it was potentially dangerous.
He encouraged me to model the rear chimney the same as the upper chimneys (with caps)
which I want to do . We also sealed the brick with a special masonry coating to address the leak.
I wanted to wait through several heavy rains to make sure we got it right. Looks like we are good
now.
How shall I proceed?

require more time to complete the work, I suggest you submit a request for an extension of
the deadline for a specific time period that you need to complete the work. Your request

Hello Jane,
Attached is a picture behind the Narbone House looking straight on to our property at 70 Essex St..
If you look to the left you can see an 'oversized" chimney in the distance with a brick cap and on the right
you can see an another one; both identical to the chimney in question. These were very characteristic of
the neighborhood and there are a few remaining ones in Salem Common area. I would think that the
mission of the Historic Commission would be to preserve what remains in the architectural skyscape of 1
the neighborhood. Just to remind the board members, none of the promises for any of the chimneys to
be in kind has been enforced and I frankly blame shoddy workmanship for the current so-called leJ
problems.(Plywood, Brickface, See below) It is interesting to me that the size of many of these au
brick structures were never affected by wind for hundreds of years as Mr. Legon blames for short
the one to be addressed on December 7th.
I also wonder what other surprises are inside the current structure (ie: more ventpipes)that could
exposed if it is removed or"reconfigured."

The comment in the minutes about the condos having been sold was with regard to the storm window
paint color, not the chimney. The chimney will remain the responsibility of Mr. Legon.
Mr. Legon has been in contact with us in regard to the chimney leakage problems and the work
remains unfinished. I believe he will likely be applying to the Commission for a change to what was
approved. Applications are due by November 215t to get on the December 7th meeting agenda.

Hello Jane,
Thank you for bringing these issues to the Commission on Oct 5th.
In reading the minutes I see that the promise was to have the chimney completed in one week. The duct
tape wrapping was removed and it seemed work was done on the chimney for leakage but the top part
was left off. This was a significant piece of history with this chimney and I wonder what the intention is
now.. to leave it as is?? We are coming up to one year and the chimney is left incomplete and not in kind.
Previous minutes documented that the height was shorter because of the wind load.
The chimney was originally constructed to clear the upper roof as it is on the lower roof. There is no
possbility that a real working chimney could be that short with those dynamics. I have had people ask
how that chimney could exist without clearing the upper roof and I was not allowed to make a public
comment when the question of height was raised by Ms. Herbert.
Maybe Plywood and brickface was not the way to go in the original construction of the replica if wind was
considered an issue; which fmakly I highly doubt.
The fact that the condos (except one) have been sold should not alleviate Mr. Legon of responsibility for
this particular issue. The applications were made by him, not the present owners.

I read your email to the Commission at last night's meeting.
With regard to the chimney, Mr. Legon was contacted and the chimney pointing will be completed within a week or
so. They have had to go through a process of elimination to find the cause of the leak and the problem has now been
solved.
The Commission has jurisdiction over paint colors,but does not have jurisdiction over storm windows. While the
Commission advises that storms be the same color as the sash or trim,on those few occasions where someone has
added storms that were a different color,the Commission has not taken any action. Nevertheless,the Commission
has asked me to put a letter in the file so that in a few years from now when the house needs repainting,the
Commission can ask the condo association to match the sash and storm window colors.

I have issues that I would like to bring to the attention of the commission.
How long, as the abutting neighbor, will we have to be looking at a duct tape wrapped "Faux Chimney" which is the one in the
rear. I was told months ago by the new owner of the unit below the chimney that it is leaking and that Mr. Legon will be
"repointing" it. It remains wrapped and looks hideous.
Also, months ago all the windows had brown storms covered them which I do not recall receiving any notification of an application
submitted for this to be approved. I recall alot of discussion made to have the originals installed as they were with no mention of
these covers being included. What was the point of requiring these original windows to be maintained if brown storms were to be
installed? It completely changes the look of the building.

Ms. Harper was one member who was originally opposed to a solid fence being placed there and Ms.

The motion that was carried from the May 18th meeting indicated there would be two step downs which would have
extended further into the driveways, making for better visibility of cars coming from the common on Washington Sq.

neighbor and the community.

the rest of the six foot high fence will have a 12 inch lattice section at the top, the"swoop" section will have a fence cap at the top.

If that is the case then I would expect Louis to provide the addresses of the homes with such vents
coming out of the chimneys so you can check whether they were approved in the past by the
Commission; rather than a decision be made based on his arbitrary statement that there are others in the
neighborhood. This is an important issue and should be a determining factor in how they vote this week.
If you do not remember the commission ever approving something like this in the Historic District than the
writing should be on he wall. (in other words, such vents do not belong in the Historic District on a
chimney that was to be in kind) Caps I feel are also not appropriate or relevant as they are not real
chimneys and there is no need for cap to camouflage what should not be there. If a screen that one
cannot see to keep animals out that is understandable but it should be BELOW the chimney line. Painting
or some other alteration of these vents should also not be considered acceptable as the vents will still be
visible and frankly will still look ridiculous. There is no reason for the contractor to not go through the
slate roof for vents.

While Lewis provided a couple photos, I do not know the specific addresses of the houses that he claims
have similar vents. I would need to be provided with the actual addresses to determine if they are even in
the historic district(most of Washington Sq. E is not in the district). I do not recall reviewing a similar vent
request in the past, but would need to check the address files that are within the district to be certain. I
would also have to check if the"vents"were put in before or after the district was formed.... and, if after, if
by the current owner. If the properties are in the district and the vents were put in after the district was
formed without Commission approval, the Commission would need to decide if they want to pursue them
as a violation. Typically, if a homeowner does something in violation and the property has since changed
hands without the Commission having noticed the violation, they tend not to put the burden on the
new/current owner. As I see it, for 60-62, the Commission will need to weigh a few factors, such as ...
the chimneys did not have vents prior and were therefore not rebuilt in kind as required..... if the
Commission hasn't ever noticed the vents in the other nearby chimneys, are those at 60-62 noticeable
enough to deny.... if denied, where would alternative venting go(i.e. through the roof) and would that
alternative venting be a better alternative than inside the chimneys. The Commission could also approve
a chimney cap(many homeowners have come before the Commission to install chimney caps and the
Commission has routinely approved them).
With regard to the rear chimney, the Commission will also need to determine whether or not to enforce
what was approved .. or allow it to remain as built.

I am writing re: the discussions from the last meeting.. I am wondering if it is relevevant that the "buildings with similar vent

Mr. Legon stated that the vents in the chimneys are actually air exchange vents to feed the HVAC system as an option to venting through the slate roof. He

I happen to like the way the rear chimney came out but I know there is a chimney near the Essex St. Library that is exactly the

Answer: MAYBE I FT SHORTER AS IT WAS UNNECESSARILY TALL.
Mr. Legon stated that his structural person, regarding the height of the rear chimney with consideration to the wind load, advised

My mistake by the way, there are 4 windows altogether [not 61 across the 3rd floor rear. There
are 2 Andersen 200's in the middle, which replaced the 2 double hung vinly windows and 2
Brosco divided light windows on each side of those.
The Brosco windows are true divided light windows. You are welcome to come by and see for
yourself. You are welcome there anytime and I would be happy to show you what we are doing
and answer any of your questions.Picture worth a thousand words....

Last eight foot section of fence to "swoop" down to termination at the sidewalk,approximating the view
shown in the Princeton photo.The post at the sidewalk to be slightly higher than the "swoop", which will be
four feet above grade at the sidewalk.While the rest of the six foot high fence will have a 12 inch lattice
section at the top,the "swoop" section will have a fence cap at the top. We confirmed that the "good" side will
face out towards the property to the south,and the fence will be white cedar, unpainted. David

Hi Jane,
These 2 photo illustrate the approach we would take with the 8 It fence section nearest to the street. The slope
would start at approx. 6 feet and wind down to 4 feet,with a decorative cap on the entrance way side.
Additionally,the distance from the fence and the street is 6 112 feet. I had guesstimated 4-5 feet at the
meeting so this would ensure good sightlines.
I would like to get with Dave and Susan as soon as possible as I am installing soon. It maybe useful to meet at
the property. If not, we can meet at the offices in town.

PROCEDURES FOR FILING APPLICATIONS
A. Be prepared to apply for approvals well in advance of commencing any exterior work. Before making any changes to the exterior of a proForty
in an historic district,the owner should call or visit the Commission representative at the Department of Planning&Community Development
to discuss proposed alterations and to determine the category of the application(Appropriateness,Non-Applicability or Hardship).
B. The Commission normally meets on the first and thirc Wednesdays of each month and notices are posted at City Hall. The meetings ae held at
120 Washington Street,3rd floor,and begin at 7:30 p in. All meetings are open to the public and any person is entitled to appear and be heard
on any matter before the Commission before it reaches a decision.
C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in
order to make the agenda. An application for a Certificate of Non-Applicability may nornally be added to the agenda up to the day of the
meeting. In some cases,a Certificate ofNon-Applicability may be issued by the Clerk,without review by the full Commission,after ratifying
Commission members and allowing 24 hours for any objection. There is no fee for any applications.
D. All applications for Certificates of Appropriateness o-Hardship require a public hearing. Notice of the hearing must be posted with the City
Clerk 14 days before the hearing and abutters must be notified in writing. Commission staff-will handle these procedures. A public hearing is
not required for a Certificate of Non-Applicability.
E. Applications must be submitted by the owner of the praperty. A contractor for the owner,at the owner's request,may submit an applicatior,on
the owner's behalf. In case of a tenant,a waiver of the owner's appearance maybe granted at the discretion of the Commission if it is rc quested
by the owner.
F. All applications must include three to four 35mm photographs of existing conditions. No certificates can be issued prior to re-cipt of
photographs.
G. An application will not be considered complete unless all work items are thoroughly described on scaled drawings and include specifications
regarding dimensions, materials, and any other information needed for the Commission to visualize the changes in order to make a
determination. Applications for paint colors should include a paint chip or chart The following items should be included in your draw ings as
applicable:
I. Site plan showing location of improvements;
2. Elevation drawings of the specific improvements;
3. Details/profiles(i.e.moldings,fence caps,cornices,vents,etc.);
4. Materials(i.e.wood,brick,etc.);
5. Dimensions(i.e.size of trim);and
6. Transformers,heat pump and condenser locations,electrical entries and meters,lamp posts,stove pipes.
H. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners
having professional consultants such as architects or contractors are urged to have them be present at the hearing. If the application is apFroved,
a Certificate will be mailed to the mailing address provided on the application and copies wil.be sent to the City Clerk and Building Inspector.
Please note that the application can be continued until the next meeting if the Commission deems necessary(i.e.for reasons of incomplete
drawings,to perform a site visit,etc.). In any case,the Commission must make a determinatian within 60 days from the date the applicztion is
received,unless the applicant waives that requirement in writing.
I. A property owner or a contractor cannot receive a building permit unless a Certificate has been issued. Please be sure to obtain apprapriate
permits from the Inspector of Buildings(or other necessary permits and approvals)prior to commencing work.
J. The homeowner may opt not to commence the work approved(unless it relates to resolving an outstanding violation). Work commenced must
be completed within one year from the Certificate date unless otherwise indicated.
K. The City of Salem reserves the right to inspect the project to determine compliance with the conditions set forth in the Certificate issued.
Violations
A person commencing or completing work to the exterior of a building in an historic district without the necessary approval of the Commission is subject
to fines of up to$500 per day from the date of violation. The Commission is not responsible for an owner's neglect to inquire about necessary City
permits and approvals. All records are public and we will confidentially assistyou ifyou are concerned that someone in your neighborhood is in vioiatim.

The Commission's guidelines are available for viewing at the Salem Planning Department and the Salem?ublic Library. The guidelines provide examples
of what is historically appropriate(or inappropriate)for Salem's neighborhoods including trim,siding,doors,fences,gutters,masonry,paint colors,
parking solutions,porches,roofing,satellite dishes,secondary egress,skylights,utilities,windows,e.c. These guidelines help you understand wbat
changes are likely or unlikely to be approved. The Commission supports your efforts to improve your property and can guide you on his.orical

Hi Jane,
I have been thinking about the porches at Washington Square and don't believe I have a shot with
the Commission so you should take me off the agenda for the next meeting-Feb 2nd. Three
members said they would not support it so the odds are stacked against me.Not worth spending
the $$ on renderings, architects, etc. It's unfortunate but that's what we have. Porches there would
be both a terrific touch and greatly appreciated by customers. Too bad.There is precedence for
porches in the area but I guess the Commission sees it otherwise.
As far as the deck on the other side of the building that we discussed,you had said that Essex
Street is not a Historic Street and therefore views from there wouldn't/shouldn't stop me from an
Historic perspective.This is the only way you could see the deck.
Is this correct? My understanding is that now it is just a zoning board issue, if I chose to move
forward. Please confirm.

I became aware yesterday that Lewis Legon, the developer has demolished the glassed-
in porch at the above building. I was at the site last Friday and observed the existing
conditions of the porch and when told by General Contractor of their wish to demolish
and rebuild it in kind, I advised them not to do so without SHC approval. I spoke to
Mr. Legon yesterday by phone and reiterated my opinion and advised him to contact
you immediately. I haven't issued a stop work order but have notified Mr Legon in
writing that he is violation of the terms of the Building Permit, that no work be done in
the area of the porch until resolution of the issue has been made with SHC and no
occupancy permits will issued before sign off from the Historic Commission.

PROCEDURES FOR FILING APPLICATIONS
A. Be prepared to apply for approvals well in advance of commencing any exterior work. Before making any changes to the exterior of a property
in an historic district,the owner should call or visit the Commission representative at the Department of Planning&Community Development
to discuss proposed alterations and to determine the category of the application(Appropriateness,Non-Applicability or Hardship).
B. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City Hall. The meetings are held at
120 Washington Street,3rd Floor,and begin at 7:30 p.m. All meetings are open to the public anc any person is entitled to appear and be heard
on any matter before the Commission before it reaches a decision.
C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in
order to make the agenda. An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the
meeting. In some cases,a Certificate of Non-Applicability maybe issued by the Clerk,without review by the full Commission,after notifying
Commission members and allowing 24 hours for any objection. There is no fee for any applications.
D. All applications for Certificates of Appropriateness or Hardship require a public hearing. Notice of the'iearing must be posted with the City
Clerk 14 days before the hearing and abutters must be notified in writing. Commission staff will handle these procedures. A public hearing is
not required for a Certificate of Non-Applicability.
E. Applications must be submitted by the owner of the property. A contractor for the owner,at the owner's request,may submit an application on
the owner's behalf. In case of a tenant,a waiver of the owner's appearance maybe granted at the discretion of the Commission if it is requested
by the owner.
F. All applications must include three to four 35mm photographs of existing conditions. No certificates can be issued prior to receipt of
photographs.
G. An application will not be considered complete unless all work items are thoroughly describer,on scaled drawings and include specifications
regarding dimensions, materials, and any other information needed for the Commission to visualize the changes in order to make a
determination. Applications for paint colors should include a paint chip or chart. The following items should be included in your drawings as
applicable: .
1. Site plan showing location of improvements;
2. Elevation drawings of the specific improvements;
3. Details/profiles(i.e.moldings,fence caps,cornices,vents,etc.);
4. Materials(i.e.wood,brick,etc.);
5. Dimensions(i.e.size of him);and
6. Transformers,heat pump and condenser locations,electrical entries and meters,lamp postsstove pipes.
H. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners
having professional consultants such as architects or contractors are urged to have them be present at the hearing. If the application is approved
a Certificate wilt be mailed to the mailing address provided on the application and copies will be sent to the City Clerk and Building Inspector.
Please note that the application can be continued until the next meeting if the Commission deems necessary(i.e.for reasons of incomplete
drawings,to perform a site visit,etc.). In any case,the Commission must make a determination within 60 days from the date the application is
received,unless the applicant waives that requirement in writing.
I. A property owner or a contractor cannot receive a building permit unless a Certificate has teen issued. Pleasebe sure to obtain appropriate
permits from the Inspector of Buildings(or other necessary permits and approvals)prior to commencing work.
J. The homeowner may opt not to commence the work approved(cnless it relates to resolving an outstanding violation). Work commenced must
be completed within one year from the Certificate date unless otherwise indicated.
K. The City of Salem reserves the right to inspect the project to determine compliance with the conditions set forth in the Certificate issued.
Violations
A person commencing or completing work to the exterior of a building in an historic district without the necessary approval of the Commission is subject
to fines of up to$500 per day from the date of violation. The Commission is not responsible for an owner's neglect to inquire about necessary City
permits and approvals. All records are public and we will confidentially assist you ifyou are concerned that someone in your neighborhood is in violation.

of what is historically appropriate(or inappropriate)for Salem's neighborhoods including trim,sid.ng,doors, fences,gutters,masonry,paint colors,
parking solutions,porches,roofing,satellite dishes,secondary egress,skylights,utilities,windows,etc. These guidelines help you understand what
charges are likely or unlikely to be approved. The Commission supports your efforts to improve your property and can guide you on historical

RE: 60-62 Washington Square South
On Wednesday, September 5, 1990, the Salem Historical
Commission unanimously denied an application for a Certificate of
Non-Applicability from Sarah Pickering on behalf the estate of
Beatrice Lesses and Mr. Gerald Leland for the property at 60-62
Washington Square South regarding repainting. The application
was denied due the Commission ' s belief that the repainting, which
has already commenced, does not match the existing colors and
therefore could not be approved under Non-Applicability. I
attest that this is an accurate record of the vote taken, not
amended or modified in any way to this date.
