It was stated to you at the conclusion of my inspection that smoke detectors in the front and rear stairways of the property need to be reinstalled and operational at all times. The covering of the smoke detectors in the stairwells is permitted while construction work is proceeding, but covering must be removed upon work stoppage at day's end or when the stairwells are unoccupied during the day. To date, no action has been taken to address the code violation. This failure to maintain a required means of egress violate section 116.1 through 116.3of the eighth edition of the Mass Building Code with Mass amendments. You are hereby ordered to reinstall all smoke detectors immediately in all stairwells. Munroe, Inspector of Buildings One Salem Green Salem, MA 01970 Dear Bill: Re: 47 Roslyn Street On August 7, 1987 an inspection was conducted by this department and cited the owner. Among violations were lack of ballusters and handrails on back porches. On September 3, 1987 a reinspection was conducted. The porches were not repaired. On October 27, 1987 another reinspection noted the porches were still unrepaired. On October 28, 1987 a hearing was scheduled at Salem District Court before Clerk Magistrate. Mr. Richard did not appear. The matter was continued until November 12, 1987. On November 12, 1987 Mr. Richard did not appear for the 2nd District Court hearing. On December 15, 1987 an arraignment was initiated at Salem District Court and Mr. Richard did not appear. A pre-trial conference was set for December 22, 1987. On December 22, 1987 Mr. Richard did not appear for the pre-trial conference and a warrant was issued. Meanwhile on November 12, 1987 an inspection was conducted by this department at the request of the first floor tenant whose wife has difficulty walking and among his other concerns were the lack of ballusters and railing on the first floor. To date, nothing has been done to these porches. The Health Department has actively pursued every legal remedy available as far as to an arraignment and issuing of a warrant. The third floor porch has a portion of the railing and ballusters missing, but the tenants use the porch because of a clothesline. Mr. McSwiggen of Salem Housing has been in dispute with the landlord relative to the lack of railings and ballusters; the owner stating that the porch is just 30 inches from the ground and therefore does not require railings or ballusters.
